At 5:28 yellow left at most 3 troops on their capital. Would you have been able to capture it by putting the 9 troops on the 6 cap?

He would have been able to, yeah, but he wouldn't really have enough troops on either cap, and then theres the possibility of him being backdoored into spain and losing his +4 further slowing him down
