Yes, atty. Carbon is engaged in the practice of law. According to the case of Cayetano vs Monsod, the practice of law is not restricted to litigation and trial in court only. Practice of law is anything that requires the application of legal knowledge and training. In this case, Atty. Carbon has been teaching negotiable law instruments in a university that requires legal knowldege and training. Therefore, Atty. Carbon is engaged in the practice of law.
According to the case of Cayetano vs Monsod -> Reword to "According to jurisprudence," delikado kasi mag-cite ng case name mismo unless sure ka na on all fours ang case pag nasa bar exam kana.
"the practice of law is not restricted to litigation and trial in court only." -> you can actually take this out already. sayang ang precious seconds just to write that down.
"Atty. Carbon has been teaching negotiable law instruments in a university that requires legal knowldege and training" -> move mo yung key word na "requires legal knowldege and training" sa tabi ng NIL.

In the case of Cayatano Vs. Monsood the court defined that practice of law is not limited to litigations and appearing in court trial but also in any private practice as long it involves legal knowledge and intervention.
In the case present, Atty. Carbon is teaching law subject to law school that requires application of legal knowledge and intervention.
Therefore, Atty. Carbon is still engaged in the practice of law.
I'm not studying law but I need examples for good writing and this is still applicable. Thank you. 😄

I delayed my second take for three years. I know of someone who passed after YEARS of not taking the bar. It's not about momentum, it is about learning new things that are covered by the bar, and unlearning old doctrines and law.

When citing from decided cases po when answering exam questions do we need to answer in verbatim as to how the court specifically wrote it in the decided cases po; or do we just need to get the main idea/concept of that decision po and re-state it po without it having to exactly look like as to how it was stated in the court decision po?
Example:
ANSWERING USING THE ORIGINAL STATEMENT IN THE DECIDED CASE: (VERBATIM)
According to Tanada v. Angara, G.R. No. 118295,
the sovereignty of a state therefore cannot in fact and in reality be considered absolute. Certain restrictions enter into the picture: (1) limitations imposed by the very nature of membership in the family of nations and (2) limitations imposed by treaty stipulations.
ANSWERING BY JUST RE-STATING THE IDEA OF THE DECIDED CASE (NON-VERBATIM)
According to Tanada v. Angara, G.R. No. 118295, the Philippines is subject to restriction by its membership in the family of nations, and the limitations imposed of treaty limitations.
Sana po masagot nyo po ito. It would really help me and my classmates po on how to better study since we would know kung kailangan ba talaga word per word na i memorize yung case decisions, or kung okay lang na yung primary ideas/concepts po ang ma intindihan namin ng maigi since we could just paraphrase or re-state the decision when answering questions po without it having to exactly look like how it was written in the SC decision po. Yup. UP suggested answer is one.
You can answer that way if you want, but you run the risk of presenting a confusing answer.
The 4 paragraph method is used to make sure you present an answer that is logical and easy to understand.

You need to spot the issue po. Usually, isang article lang kelangan mo to answer a problem.
Minsan kelangan mo talaga ng multiple articles to answer a question. Ex: para maresolve ang vicarious liabilty kelangan mo sagutin kung may quasi delict ba muna.
On which ones to use, use the call to guide you kung alin.
Kung open ended essay yan, yun talaga kelangan mo matuto mag issue spotting.

"Yes, Atty. Carbon is qualified to become a Regional Trial Court Judge.
According to Sec 15 of Batas Pambansa Blg 129: A person must be natural born citizen; atleast 35 years of age; atleast 10 years engaged in practice of law in the philippines.
In the case at bar, Atty Carbon is 36 years of age; he is engaged in practice of law for 12 years. However, being in trial or litigation work is not a requirement; it must be emphasize that having practice for law for more than 10 years is the most indispensable requirement to be qualified since practice of law requires legal training, knowledge and experience.
For these reasons, Atty. Carbon is qualified to be a Regional Trial Court Judge."

Basta po galingan mo basic English at logic mo po, at yung destress mo. Yan ang best prep for law school.

Because it is risky to cite specific provisions or case titles.
If mag cite ka mismo ng provision or case title dapat verbatim mo i cote yun.
Also, my concept ng stare decisis. So dapat swak na swak yung case na i-cite mo dun sa problem.
Factor in mo pa na our memory fails in times of great stress.
Thus, it is risky to cite exact provisions of law and cases.
Wag mo gamitin ang "Civil Law" napaka lawak nun hihi
Kahit na Civil Code ay sobrang lawak pa din noon.

Ask yourself WHY you NEED to enter law school?
In my case, it's the only profession I saw myself doing for the rest of my life since grade 6 or maybe 1st year HS.
Qualified is subjective anyways, and it is not like you can't learn law.

Hindi pala all around yung mga lawyers? Kasi may nakita akong mga family lawyer, criminal lawyer, etc.
Opo. Kahit nga sa Family Law may estate lawyer at may annulment lawyer, etc.
Law is too broad to master, in my own opinion. Imagine, you study 8 bar subjects that are further divided into atleast 3 more subjects in law school (i.e. Criminal Law 1, Criminal Law 2, and Special Penal Laws are major components of Criminal Law).
In my own opinion, corporate law is the best field of law in terms of salary.

Bar exam is a licensure exam for you to practice legal law
Board exam is under the regulation of PRC while the bar exam is under the regulation of the supreme court. In fact, even though you passed the bar exam pero may di ka na meet na requirements di ka padin pede mag practice ng law.

@@baconpalacio oo naman kaso di ko alam kung kaya ko... I mean mahirap naman school namin due to advance curriculum na kaya ko naman pero di ko alam kung kaya ko ng law school o hindi... Imprumtu at extemporaneous wala talaga ako jan tsaka debate konti lang experience ko grade 10 pa po ako nag dedecide lng naman kung ano ba talagang worth it kunin. Dati may passion na gustong gusto ko talga ako sa law tas nawala na dahil nga kaklaseng toh makaka discourage pero ngayon nasa isip ko na kung e persue ko ba o hindi... At tsaka turuan ba tayo sa popesor the art of being bias?

2. Some are saying that you should not answer "it depends". If the answer calls for a qualification, how will you answer the question without using the words "it depends".
3. Do you answer questions with "partly correct"?
1) wag mo na ilagay yung NO.
2) RARE po kasi na "It depends" ang sagot sa bar eh. Kaya pumili ka nalang po ng side.
3) Rare din na merong partly correct sa bar. So as a rule, pumili ka ng side.
Ang gulo po, yung comment and like dapat po sa dulo iyon nilalagay.

With that being said, him teaching Negotiable Instruments Law in a law school is considered practice of law ince this requires knowledge, training, and application of the law
Therefore, Atty. Carbon is engaged in the practice of law.
b) Yes, Atty Carbon is qualified to be a Regional Trial Court judge, if appointed.
According to B.P. 129, Qualifications of an RTC Judge shall be 35 years of age and shall be engaged in the practice of law for at least 10 years
Since Atty Carbon is 36 years old and has 12 years in the practice of law, he is qualified to be appointed as Regional Trial Court judge.
