Annulment due to not factual daw eh ive been abused and my ex cheated me .7yrs na ako abandoned by him after 4yrs fighting sad to say it was denied.now appeal to MR if denied again will go to court of appeals to fight for my right. Hi Po, marking or pre-marking means your documentary evidence will be marked as exhibits before the branch clerk of court’s presence, para po mabilis lang ang pre-trial. Mamarkahan ang documents as Exhibits A, B, C onwards or Exhibits 1, 2, 3 onwards for easy reference during hearing. Hope this helps!

Attorney, tanong ko lng po, kc po yung annulment case ko nasa PaO Caloocan, dhil po indigent ako, naaoprobahan naman na mag file sa Pao, kaya lang po,
December 2019 ko binigay lahat ng requirements ko dun, tpos ng pandemic, lalo tymagal po, tpos nakapag file lang po ako sa judicial 10the ave Caloocan nung December2,2021.
Until now wala pang pre trial. Since nabigay ko yung documents ko kay Attorney Mores ng Pao, sabi po mag antay ng schedule sa judicial.
March napo wala pa rin. Ang tagal po kc Pao. Wala naman akong sapat na pera para kumuha ng private attorney. 😥 200k daw magagastos, grabe 😢
Sana maaprobahan na divorce baka sakali mapabilis. 2001 pa po ako separated.

Hello Ma’am, medyo matagal po talaga ngayon whether private lawyer or PAO lawyer po ang kunin especially since lockdowns and court closures. Basta po naifile na umaandar na po yan, sayang po kasi start kayo ulit if magpapalit pa po kayo ng counsel. Sayang po oras at sayang po ang pera nyo. Follow up lang po kayo regularly sa PAO lawyer nyo. Mahuhusay rin po sila, di kayo mapapabayaan :) ingat po.

Hello sir, first i am sorry to hear about your situation. You did the right thing by saving evidence. Organize it and compile the timeline of events in your marriage and the events leading to your wife’s infidelity and other acts of neglect to your marital and child’s needs. Best to have those thoughts in writing para po mas madali maintindihan ng abugadong hahawak ng kaso. Apart from that, have PSA marriage contract and birth certificates of your children ready. If you intend to seek custody, which you can file po alone or together with the annulment, best to prepare the following: PSA issued birth certificate of our children and marriage contract, proof of financial capability to provide support like COE, bank records, OR/CR of vehicle owned or property title, if any. In custody cases, the court will judge based on the best interests of your child po. Best to consult with and engage a legal counsel: if you do not know any, your local hall of justice or IBP branch/chapter would be able to help you access one. Ask ko lang need pa ba ng witness sa side nya para sa annulment ?
Good morning mam. Based on experience, hindi po necessary na may witness sa side ng kabila. Ang importante po ay yung witnesses sa side ninyo, people who know you both well, who have known you both prior to the marriage and during the marriage. Jackpot witnesses for me are relatives of the other spouse who can testify for you and the marriage. Hope this helps!

Hi Ms Judith, from my experience, most judges allow videoconferencing especially when the witness/parties are away/travel restricted. It would be best to have your lawyer call the court to find out what the judge’s style is, or file a motion to conduct the hearing via videoconferencing and state your reasons there. Stay safe!

Hi Mam! Although the Andal case decided to that effect, I would still recommend an expert psychologist as witness so that you are covered. Best to overprepare than the reverse, ika nga po. Hope this helps!

Hello Ma’am, you can use documents as evidence, like yung birth certificate po ng anak nila, photos, screenshots of text messages. Pwede rin po testimonya ninyo or ng mga nakakakilala sa inyo. Mas maraming ebidensya, mas maganda po. Stay safe!

Hello Ms. Moxie. After your petition is filed, and after the Prosecutor conducts his or her collusion investigation/hearing, the court may send a notic of pre-trial. Some courts allow online videoconferencing but you need po to confirm with your lawyer - courts now are back to face to face hearings and might not allow videoconferencing. It is very important to attend pre-trial personally, best opportunity for the judge to see you and assess if you are serious in pursuing the case. Best to attend confirm with your lawyer at all stages of the process. :) Ingat po!

Re verifying if a case is really pending, you need the complete case caption, title and number and email/call the court concerned or the Office of the Clerk of Court of the City where the case is filed if indeed pending po ang case.
