      Wrong. That's what is called a conditional threat. A conditional threat is not illegal. The case against this guy was dropped because he was right. The cop had no reason to enter his dwelling, he had no warrant, and him saying "enter my house and I'll fuck you up" is perfectly legal. They were there for a noise complaint. They had no reason to do anything more than tell him to turn it down, and all they can do is refuse he do so, since according to Indian River County's own laws, there is no noise ordinance. He wasn't breaking any laws to begin with, and was well within his rights to threaten to defend his home against an intruder. Under Florida law, a cop forcing unauthorized entry into your home IS an intruder. Florida has Castle Doctrine, which means I can lethal force on anyone entering my property without consent or a court ordered warrant. Fail to produce one, you catch the smoke. Why the fuck do you think no-knock raids don't happen in Florida anymore? One wrong address too many resulted in one dead cop too many, and the courts refused to convict homeowners for protecting their homes.

    Clarification at 32:49. The officers did NOT search the residence. They cleared it and secured the scene while they processed the warrant. At that time, Mario gave up the location of the backpack willingly.
    Also, The "refusal to allow a search" was not the reason he was arrested. He was arrested because of the evidence found in the trash and the discovery of the backpack in open view within the residence.

    • @BryonYoungblood
      @BryonYoungblood 6 місяців тому +27

      Yep. As I said in other takes to this, Mario was the smart sibling, while Chertisha was scared shitless at being caught and so she resorted to violence and threats, as well as her being a repeat offender/frequent flyer with the police system.

    • @brteller
      @brteller 6 місяців тому +2

      It's a thin line though, entering the residence wasn't worth it when they could of just got a warrant pretty easily with the evidence they did have. If for some reason they were innocent, the police would of had a very hard time over this interaction which is why they shouldn't of done it this way, they were fortunate they were guilty. The police "cleared" the home, but they didn't have probable cause to do that. Claiming a smell is a weak point, really would of only been a strong reason if they believed someone to be in immediate danger.

      @Invisius1 6 місяців тому +13

      @@robertvera9205 has nothing to do with any of it. So many times you hear the words "he was drunk" like it is an excuse to act like an idiot. Literally the first thing he does when he opens the door is sling threats of physical violence towards law enforcers.
      In my eyes, there is no worse excuse than "i was drunk" because it is almost like a get-out-of-jail-card. Obviously a lot of the times, it does nothing for you, but there is also a lot of times when it does. Like my mothers ex-boyfriend who tried to assault her, smashed her car window with his bare fists, and was trying to stop her from leaving with walking out on the road to block her, but he "got off" because he was so drunk he doesn't even remember getting picked up by the cops that took him.
      Like how is that an plausible excuse for being an idiot that should still be in jail?
      And i know that a "small" mistake (depending on the situation) should not ruin your entire life because of what you did while you were drunk, but it does, and it also can ruin other peoples lives because of your "small mistake" while being drunk.
      so, in my honest, unasked, opinion. Drunk people should get no leeway. none at all. Like how a drug like weed can be illegal, where the only person you're a threat to is the fridge and the snackshack, while daydrinkers and the like literally throw violence around, drives under influence, and even worse crimes that has been commited while being drunk.
      I guess there is laws about public intoxication is there for a reason in the states that have those, idk i am not an american.

    It is truly astonishing how many people escalate these situations so quickly, at times raising very simple misdemeanors to multiple felonies. Then again, in the heat of the confrontations different people will react differently, which is still not an excuse. As to the road rage incident, I, too, may have been extremely pissed off that the other driver was nowhere near the traffic stop.

    I've noticed something surprising from having watched SO MANY Body Cam & True Crime channels.
    When I see civilians/criminals flat out lying (poorly) and then becoming SUPER obnoxious, whiny, and aggressive when their lies aren't immediately treated as 'gospel truth' I no longer respond with;
    'SERIOUSLY?! HOW CAN PEOPLE BEHAVE THIS WAY?!'
    Like I did when I first started watching these videos.
    Instead I now find myself thinking;
    'Yep. Here's another person just abandoning all their dignity to try and get out of this situation. I guess this is just how people are deep down when confronted.'
    Anybody else experience that?
    I wonder if cops go through the same thing over their careers? Surely they must.

      I fully agree that those two are prime examples of pointlessly rude people... but that's not a crime and the officers just simply abuse their power and ignore people's rights. In the first example the guy screams that *if* the officer should violate his rights by coming into his home without a warrant, there will be consequences. The officer knows full well that this is *not* a threat if he abided by the law, but he intends from the beginning to violate that right, so automatically he perceives it as a real threat... that's why he arrests the guy for threatening him.
      The second example is a girl also assuming her brother has a right for his home not be searched without a warrant, that's why she gets mad when the officers find a BS excuse (like they always do) to ignore that right. So they arrest her vor resisting arrest, which is mindbogglingly inconsistent with basic rights... but it is what it is in the US... what she's convicted and punished for is her genuine anger issues after she has been wronged... I'd be angry too, but she takes it to another level and has no self control... still, seeing this footage as a non-American I now understand why people really dislike the police and say things like abolish it etc...
      edit: just to be clear on the second example, the police had a genuine reason to go in - the evidence that there is stolen property inside via the tracking technology - so they didn't violate that dude's right, that's not what I'm arguing. They violated his sister's rights by arresting her for arguing with a loud angry voice.
      come to think of it, even though they had a potentially valid reason for going in with a warrant, they used the quicker excuse to get around his rights (unfalsifiable "smell", they can always say that or "disturbing the peace" etc, they have several options they apparently use on the regular).

    I'm watching this from Poland and even though I'm not educated in law, I'm amazed at how different our legal systems are. On the one hand, the police in the USA can use weapons in many more cases than in our country, but this is due to the fact that we have fewer weapons (you can have them, but you have to go through a certain process to obtain a permit). On the other hand, I see how these people talk to the police because they can. Well, in our country, a policeman is a representative of the nation and, like every public service, he is, in a sense, an extension of its majesty. Therefore, insulting a policeman results in a fine or a year in prison. Of course, they turn a blind eye if you say something out of emotion, but they don't have to.

    • @TheMrJizzus
      @TheMrJizzus 6 місяців тому +8

      Same thing here in Portugal. If too many people have guns, police enforces guns use and criminals will get more guns to fight back. If less people have guns then the fields are more leveled. And people respect the officers, trust comes first to our minds because we are not hiding anything and we will need them much more than fear them.

      @@alastor8091 well, definitely not in that sense. you can say whatever you want as long as you don't insult anyone (even an ordinary civilian). but this is quite soft and subject to court interpretation (we have no law of precedent). Usually you have to apologize, e.g. in the newspaper or something. oh, and you can't promote totalitarian systems like Nazism and communism (we have sweet neighbors on both sides and both systems killed enough of our citizens in the years '39-'89). For me, it was a shock to see Nazi pickets in the Blues Brothers, for example.

    My worst cop encounter was when I got a migrane while driving and I felt it became unsafe to drive before I could get home. So a cop pulled over and saw me hiding from light on the floor of the back seat, looking like I was having a mental health issue or on drugs. There were pills all over the back seat from them spilling as I got 2 out, that probably looked bad too. But I managed to convince them I would be okay and when they realised I was just having a problem they helped me get a cheap tow home and i rode back in the truck. (You cannot drive on those pills)
    This was over 20 years ago. I am scared what would have happened to me if I it happened today.
