Kari Lake in Panic Mode, Pretends to Oppose Civil War-Era Abortion Ban Upheld by AZ Supreme Court

  • Arizona’s Supreme Court upheld a Civil War-era near-total abortion ban, but thankfully, the State’s Democratic Attorney General has said she won’t enforce it. Nonetheless, the ruling has put the GOP’s U.S. Senate candidate, Kari Lake, in an awkward position. Lake has recently tried to downplay her opposition to abortion, and claims to support a “state’s rights” approach like Trump, but due to the unpopularity of this draconian law, she’s now coming out against her own state’s position on abortion.

    As an Arizona resident, my jaw literally dropped at this ruling. We have laws on the books that were enacted by ELECTED members of our STATE's legislature. How they can justify reverting back to a law that predates statehood is mind boggling, and surely had to involve a whole lot of mental gymnastics by extremists who wanted any excuse to ban abortion.
    But our AG has already stated clearly that no one in AZ is going to be prosecuted for violating this law.
    Ultimately, the net effect is that the court just handed Democrats the whole election on a silver platter. Arizona will be a blue state after the election.

    As an Arizonan, I can’t emphasize enough just how much of a leftward shift this state has undergone in recent years. It’s thanks in no small part to immense organizing, activism and hard work from lefties all across the state. The left here is galvanized, energized and tuned in. The state Supreme Court knows they’re the last domino to fall, and they’re desperate. That’s where this ruling comes from.

    What I like about this ancient law is that it still does not recognise a foetus as a person, the sentence is less than even manslaughter and is its own law rather than intergrating abortion into murder laws.
    The foetus isn't a person to the people in charge of the forced-birth movement, they just don't think women should have that power, much like people in power in the past who thought women shouldn't vote.

    Becoming pregnant now is a terrifying prospect, even if you want a baby. Anyone can develop life-threatening complications that will then be ignored. Having worked in a church school, a colleague of mine was against abortion for ANY reason. Until her daughter had an ectopic pregnancy. Then she was on a plane to go help her daughter get through the abortion. Everything changes when someone you love suddenly NEEDS an abortion.

    I also want to point out the newest abortion ban on the AZ law books was a legislative law. That's due to the fact that Arizonans wouldn't have voted for it. In fact most of the state is more progressive than the legislature. Which is why the AZ legislature is trying to make it easier for citizen initiated bills to be sued for being unconstitutional and making it harder to collect signatures. This legislature is crazy.

    The problem is, doctors aren’t going to perform abortions with this law on the books even if Gov Hobbs said the Attorney General won’t enforce it. I believe the law is going to have devastating effects for women despite what Governor Hobbs said.

I just know from seeing how these laws have been playing out throughout the country where medical professionals take an over abundance of caution when it comes to their license. Also, individual police departments could decide to arrest the doctor if someone turns them in for breaking the law. Even if the AG doesn’t prosecute, it’s still a violation of the law and cops can arrest the doctor for breaking it even if they know it won’t be enforced. And rogue prosecutors throughout the state could try and prosecute it anyway despite what the AG says. We’ve seen mass amounts of infighting in states with MAGA and forced-birthers who will put their jobs on the line to get their draconian laws enforced. I don’t doubt it’ll happen in Arizona too where their government is so polarized. It’s just maddening that it’s even come to this.

    The legislature must take action. All they need is a bill to repeal the 1864 law. Simple as that.
    I do think Kari Lake MUST address her previous support of that law though. She DID change her position on it.
    Also, I am a bit curious if abortion doctors could be chargec under both the 1864 and the 2022 law simultaneously. That would be the kind of unethical charge stacking we see often in federal criminal cases when they throw the book at someone. Though that's a question only a lawyer could answer unfortunately.

    Every emergency care doctor and ob/gyn or medical professional that might be put into the position of dealing with female reproductive needs have to file suit and state that their sincerely held belief and oath is violated by a law that forces them to deny care out of fear of going to prison.
    And like Idaho, they need to get out of Arizona until it is safe to practice medicine there.
    I know…it sucks for normal people who don’t make laws that essentially turn women’s bodies and fetuses into state property, but why do you go to a doctor? For your health. And when a doctor CANNOT provide help without risking prison, then what’s the point in going? Move someplace where your body belongs to you.

      @@erincoco612 The problem is that one law, no matter which state wrote it, sets precedent for other states to pass a similar law. And no IVF is not a whole different ball game. It is also considered abortion and doctors can still be prosecuted for it if some lawmaker decides to do so.

    I cannot believe the coverage of this story. Over 100 years no in legislative position bothered to revise the criminal code. And now everyone does suprised picachu face, when the Supreme court decides that everything revising the Roe abortion right does not apply any more?
    The decision explains in litteraly the first paragraph, that it is not about the constitutionality of 13-3603, but just about an interpretation of 36-2322 and its interaction with 13-3603. This is the question put before the court and this is what they answered - correctly in my humble opinion.
    Maybe the legislature should revise the criminal statute, if they feel that doctors should not be criminalised. It is their job after all.

    I'm surprised that more women haven't gone to court and tried to get child support for their unborn child. You know since so many want to say that life begins at conception, then that means that You've got a "child" at the moment of conception ergo you need to pay child support.
