      @@sathyanarayanrajakumar7334I think : “There should be a constitutional body of Federal Judicial Council consisting of senior most judges each from 25 High Court + Supreme Court along with a secretariat which will select and shortlist names by the preferential voting system and according to the procedure established by the law. Then the name should be forwarded to the Rajya Sabha who will scrutinized it and approved it. So that the President can appoint”. I don't know if I am right or wrong but I think federal systems are best cause it don't monopolies anyone. Moreover, Rajya Sabha scrutiny is necessary because the Parliament represents the mandate of the people and most importantly no political instability effects the functioning of the Rajya Sabha cause it never dissolves as well as represents ever states as a union.

      @@pkmkb7412 Appointment of judges is a 'JUDICIAL MATTER" under our Constitution and being part of the "BASIC STRUCTURE', its permanent. Your opinion doesn't matter because it violates this BS doctrine. Rajya Sabha is a part of the Parliament and therefore it doesn't have the Constitutional right to scrutinize judicial appointment. The Judiciary represents the mandate of the Constitution, not of the People, that part is reserved for the other two branches.

      There are exams to become a district judge, but to become a high court judge u have to be picked by the top high court judges and same goes for the supreme court judge appointment

      @@AnkitSingh-fs2sl Me being a part of lgbtq community, I know what is happening currently relating to lgbtq community is harsh, but even if the parliament does not approves special marriage, the SC is working on it. but judiciary should hold responsibility in many other cases & our country is the only one which has this kind of system to select judges.

      @@AnkitSingh-fs2sl cos I am studying law, I can tell u a couple of problems. The biggest problem is transparency, u know what, the chief justice rn is the son of one of the SC judges. People are saying supreme court judges are picking not qualified judges which may help them later. I want to go to judiciary so bad, but i don't have connections that i can climb the ladder fast 🥲.
      And cos they pick what they think is right, we are short of about 10 judges in supreme court and so many in high and district courts.... EVEN IF THE SUPREME COURT HELPED US, but the high court and district court cant help us cos it takes years and literally constant ghosting of the court when finally ur number comes.... Till the time u get the judgement, every thing is already done 😭.... the ra*e cases and other even lgbtq cases take years to get a judgement, do u think a person can wait and get that humiliation till that time

    The Collegium is unconstitutional. It is a by-product of a judgement of 7:6 of 1973 which stated some features of the Constitution as “basic structure” which cannot be altered by the Parliament. These were not stated in the Constitution nor subsequently passed as an amendment to the Constitution with tightly defined definitions. This Basic Structure has empowered the Supreme Court to overrule any law or amendment to the Constitution by expansive meaning of Basic Structure or even whimsically. With the same wrongful empowerment, NJAC was rejected by the Court. The Supreme Court in a sense has become all powerful, never envisaged by the Constitution makers. So we have 1.4 billion people are expected to bow down to the oligopolistic sway of a bunch of judges. Either the Judges see reason or the Govt should defy the Court -not a happy prospect but both have an option: judges should resign or the Govt should seek a fresh election / plebiscite with this issue .

      If this kind of a system does exist, then it is not fair & just....Judges are supposed to be unbiased & just while selecting Judges, but unfortunately in this system there appears to be some bias & favouritism which would go against the just JUDICIAL system...

    There has been many Supreme Court judges from same families where as many HC judges couldn’t get into SC because of this nepotism and it depends how close you are to those top 5 judges.It’s absolute disgrace..If they don’t want govt to interfere then fine have some people outside Govt- judiciary in your selection panel ..

    Superb mom ,absolutely this is the burning 🔥 problem in our judesery system. Recently in Andhra Pradesh high court judges asked one I.A.S OFFICER DO YOU KNOW ENGLISH. And one judge asked one I.P.S. officer read the law in the court. Amaravathi land scam, judges gave gag order stop enquiry on land scams. How com with out enquiry it's scam or not. Shame on them. Our judesery system is highly carapted. Hat's off to you mom you take up such a wonderful topic.

    The Justice System was "the beacon of hope during the dark days of Emergency" - I believe she got this part totally wrong. I remember a famous journalist during those times say "The Honourable judges were asked to bend but they chose to crawl" in front of Indira Gandhi. Emergency even suspended the fundamental Right to Life of an individual Citizen and the Justice System didn't intervene. Only one - Justice Khanna stood against Indira Gandhi and he was forced to resign. Not upto the standard I am used to see from Palki Sharma, in the past

    Which ever org does not have check and balance ,is unbridled . Some sort of system has to be there in checking the judicial functioning too.Although our judiciary has been excellently performing role ,but has to have some checks by others and not by themselves only.Amaxing analysis by Palki is appreciated as it has tremendous clarity.

    A well-balanced argument which on, the surface, is entirely rational. My concerns can be laid out quite simply: can you imagine, for example, an India in which the BJP weald power in deciding the appointment of judges or perhaps the PM of India has the power to nominate future Supreme Court judges as is the case in the USA. What a fiasco the country would descend into should this be allowed to happen. Leave the present legal system to the judiciary and free from polical and religious influence as much as it is possible in a country like India.

    Exactly. Noone in this world is beyond scrutiny. Or should be. Why are the courts not willing to be transparent? Why are they against a body which appoints judges. eg. A person gets life in the lower court. He is acquitted in a higher court. What happens to the agony faced by that person. Some judge decides wrongly, causes agony to another person and still cannot be questioned or action taken against him. Then where is equality before the law, which is the fundamental basis of the Constitution. And to top it all the judges are there to uphold the Constitution. Simply does not jell at all.

    Transparency is needed but don't support the idea for appointing by winning party alone.. maybe by a group that include national party members and judges together

    If Mafia is allowed to appoint the judges then the Mafia( Politician) who is Yadav would appoint Yadav, Jatav politician would appoint Jatav judges and Yogiji would appoint people of his caste. The minorities like Sikhs and Parsees and Jews and Christians and Jains and Muslims would be left with no option of becoming Judges.

Already there have been (and there are currently) many Sikhs, Muslims and Christians appointed to the Indian Supreme Court, High Court as well as State and local jurisdictions. Trying to create outrage where it doesn't exist and also obfuscating the truth is the only thing you liberals are good at. By the way CM Yogi Adityanath has appointed people of all castes to his cabinet positions. He doesn't play the jati card, that's why we all love him in UP. This includes many Yadavas and I'm one of them.

    If government appoint judges then judiciary will move according to wishes of government.government should appoint similar committee for the post of governor.

    She has not covered why the NJAC was struck down. It was because it gave powers to Govt to appoint any 2 eminent persons of govt choice who will have veto powers over appointment if judges. Meaning if govt (politicians) do not like a person ( obviously if they think that he will not bend to govt pressure) they will simply not allow him to be appointed through veto. Over a period of time all judges would have been govt stooges.

THE GOVERNMENT MUST NOT HAVE A SAY IN THE JUDICIARY. WE JUST CANNOT LET IT HAPPEN. In a democratic system, the judiciary, the legislative, and the executive branches are intended to operate as separate and independent branches of government, with each serving as a check and balance on the power of the others. The judiciary's role is to interpret and apply the law, including the constitution, in a fair and impartial manner, and to ensure that the government acts within the bounds of the law.
    If the government wants to exert more control over the judiciary, it is important to ensure that this does not compromise the independence of the judiciary and its ability to serve as a check on the power of the government. The independence of the judiciary is essential to the preservation of the rule of law and the protection of individual rights and freedoms.

    it ensures the independence of judiciary yes government should not be allowed undo interference in the judicial process but neither can the courts be given the unchecked powers because as they says power corrupts, an absolute power corrupts absolutely. indian courts have been bedrocks of democracy. to maintain credibility of institution that rule on matter concerning 1.4 billions indians the judiciary with all due respect judiciary should open up itself upto scrutiny

    Tax payer money goes to those judge wages. Tax payer democratic rights selects a government in a democratic way under constitution of India. Then HOW COME THESE MY LORDS drawing salary from Tax payers money appoint a collegium for their dictatorial blood relationship My Lord dictorial rights of My Lordship transfer!! God bless India. I fully support MODI Government on this issue.
    To Honble Chief Justice, we poor lowly citizens entrust you for maintaining law and order to last mile , while your house is dictatorial is not at all right. Pls adhere with Govt and other honest media options and lowly citizens My Lord and get away with this COLLEGIUM!

    Supreme Court have been the single obstacle in Indias transformation.
    They have become a goverment on their own, and wish to trample on majority rule,
    Where's the independence of Hindu temples, on that they are silent, they do not find it undemocratic. When majority Indians do not have control over their own religion, their own places of faith or wealth of their temples, instead they go out of their way to protect right of minorities at the expense of majority.

    One can recall that during British Raj there used to be a Privy Council where the litigant can appeal for final judgement. Similarly, such a system should be made in India by removing some powers of Supreme Court as the final authority on cases as well as the powers of Constitutinal matters. The juducial council should be made retired Supreme court judges, members from LS &RS ( with legal background) and President of the bar council with rotation. The term should be for 3 years with no extension. Such a system can be tried here. The chairman of the council should be the Vice President and continue till he remits the post.

    Collegium system need arrived when upa govt appointed judges on their will and use them in their favour thus independent judiciary is must above any political will. But a the same time we need transparent system and thus name list should be prepared by collegium but final names should be decided by cji, pm, leader of opposition.
    We need to strengthen alternative dispute redressal mechanism plus more appointments and judicial infra because at the end of the day all we need to solve the pendency of cases with justice at its core.

    Government has to appoint meritorious retired judges as advisors to existing judges. When a judge has any complicated or difficult cases, judges can ask for their advice. Many judges work in tribunals, they will have specialization. Its humanly impossible to be specialized in all variety of cases, this is where their advise become critical.
    Their experience and wisdom will be reflected in judgements. They'll have experience and expertise to advise existing judges.
    It will improve justice for litigants. Sitting judges will learn a lot from advisors to judge. There will be a huge skill and knowledge transfer.
    It will also speed up judicial process. Advisiors for judges can be taken on 3 years contract . There is need for advisiors for judges for all courts .

    Collegium system of appointment of judges in India is very inefficient ,very few families are appointing judges within there families,Judges are inefficient who take 5to 10 years to give verdict in a document less cases ,there should be upgradation of India s judiciary which doesn't have any accountability

    The word consultation with CJI/SC judges in article 124 was read as concurrence by SC to invent the collegium system. Hard to find any dictionary that defines consultation as concurrence.

    Just like a senior singer can be the best judge of a junior singer, a senior judge only can know best as to who can be a good judge. No one else should be allowed to interfere with the selection of judges to higher judiciary. And this is more so important because unlike a singer, the role of a judge is much more important. And government should in no way have a role in selecting judges. Because government is the biggest litigant of the court. The courts are there to provide a check on the actions of the government. If the government starts deciding who will be judges they will put their people on the chair and the last resort of check on the government will be gone.

      Sorry Palki Mam but I disagree with you this time. Being a homosexual, it has been the court that allowed me to survive with basic dignity. Over and over again the government shut down private bills in the parliament, resisted decriminalization and allowed police brutality and torture. What has govt done? Well only mocked my biology.

One problem with collegium system is the fact that a Justice who studied in other countries can get influenced or be used like a puppet by external forces. That's a Threat to India's National Security. Another one is Nepotism. A Father can’t appoint his Son as the Supreme Court Justice.

      @@AnkitSingh-fs2sl Best example of Nepotism. Justice Dhananjaya Yeshwant (DY) Chandrachud on Wednesday created a record as he took oath as the 50th Chief Justice of India (CJI). He is the son of former CJI Y.V. Chandrachud. This has become the first time in the history of the judiciary, Father and son have become CJI.
      Son was appointed by his father who was also a Chief Justice.
