      Those are just allegations, not proven facts. Yes the collegium system is opaque, but to tell it blatantly promotes nepotism is just wrong

    First and foremost job of any COURT especially SCI is to interpret the INDIAN constitution and NOT to create law. There is clear demarcation of roles/responsibilities for the 3 branches of Govt-namely the Executive, Legislative and Judiciary. Hope the CJI understands this very clearly. The recent trend seems to show otherwise like in the appointment of EC of India. What is the role of SCI in this process. They should NOT interfere in government functioning. Not sure why Kanwal did not bring it up. Same with the holidays for all the courts. When all the GOVT departments are working 5 days a week thru the entire year, why all sorts of vacations for the Courts. Are they still in the Brit era mindset. Let us see if Mr. Chandrachud take up suo moto action to force all judges from lower bench to SC, declare their income tax, wealth etc as and when they are appointed to any of these positions. Will he bring sunlight to the functioning of COURTS. Doubt that. Finally, why the legal system in India can get rid of the Latin phrases in Indian judiciary?

    • @BeE_AriyaN
      @BeE_AriyaN Рік тому +1

      I think you know that regarding the appointment of EC & CEC, the judiciary has suggested the PM+ LoP+ CJI process until the legislative body comes up with a similar law. So technically speaking, they haven't created a new law, they just introduced an interim process until a proper law comes out. Same goes with NJAC. They termed it unconditional because as per them it somehow goes against the basic structure of the constitution (I don't agree to that), but here also they suggested the legislature to come up with a better law which can be implemented instead of the NJAC & until then collegium will continue. So here also, it's more like an interim process before a more balanced & proper law comes up. That's my opinion so correct if I'm wrong in my assessment.

      @@BeE_AriyaN why should they even ask for legislation? That's the parliament and executive function.

    • @itsmycontact

      @@BeE_AriyaN so what next Bishal.? Where is it written in the Indian Constitution that SC has any right to even recommend /suggest. The SC knowingly(I will NOT use unknowingly ) is giving fodder to Opp parties something to chew on. To me this is unwanted interference. Rather than doing all sorts of over reach activities, let them clean their own garbage first and ensure transparency. The Collegium is one of the lousiest method in any country and the SC is too happy with because it suits them well. But they only recommended/suggested to come up with legislature. Why NOT they recommend to include PM+LoP+ SOME other agencies+ CJI for that. Why not they recommend that prior CJI cannot recommend any of the kith/kin of prior CJIs ?
      The main concern: Judicial activism is the one of ways people like Soros funded globally and controlling the judicial system.

    • @BeE_AriyaN
      @BeE_AriyaN Рік тому

      @@itsmycontact that's really a concern & I really don't know what to say about it. Recently when I studied about why the NJAC was rejected, I found that one of the reasons behind it was that, through NJAC the veto power of the CJI will be compromised. I don't understand, why does the CJI needs veto power in selecting judges where we have 2 senior most judges along with CJI & 2 other prominent person other than law minister in the NJAC itself. You're right to point that suddenly the CJI is becoming someone so important that even the democratically elected PM feels less executive than him.
      I really don't know where this tussle between judiciary & govt. will end. I hope the balance is made somewhere & it's a good thing we common people are taking interest in discussing these aspects.

    Under Indian system, how long will it take a matter to have final justice? What is worth of justice if it takes more than a human life span, running the risk of financial extraction, during life? Let our Judges and lawyers enjoy as much vecation they fancy. Why the practice of wasting time be justified, doing precisely doing nothing to professionalise the procedures? One way of answering every question, is to accuse.., yet smartly manage the ever persisting demands for mor funds ( architecture is archaic and intimidating?) no practical sincerity to be efficiently utilise resources( sticking to relevant aspects, permitting relevant law, dictating judgements the moment facts and) laws are frish etc.) .. lf there's a will there's a way. But if absence of way is the dearly cherished work culture,.. True, we can still claim, majesty, and keep demanding ever finding fault.
    Citizen seeking justice is not happening reading judicial literature, made locally intended essentially to ensure the defining dialatory work culture. Justice has a language of its own. Everyone knows it feels it, sensing the deep pain, when denied perpetually!

Ya to judges ki salary ghatana hoga, ya phir judiciary me spending badhana hoga. & Most importantly this judge appointment issue should be resolved ASAP between govt. & Judiciary. Be it reformed NJAC or transparent collegium or an UPSC like exam to appoint judges. This will help in appointing judges in mass scale, a LBSNAA like institute can be created to train the newly recruited judges by the experienced or retired judges. & All of these steps will require huge budget allocation & the will to get this done.
