- Prosecutors in former President Donald Trump's New York criminal trial introduced jurors to a new part of the story on Thursday: A secret recording first made public in 2018, allegedly taken of Trump being briefed on a plan to buy and bury the story of a woman who claimed to have a sexual relationship with the former president. It is illegal to record someone in a conversation you aren't involved in, Cohen was Trump's lawyer at the time and very much a part of the conversation. It is perfectly legal and admissible in court. They played the recording in 2018. Everything on the tape was unintelligible. Prosecutors created a text transcript of the recording to try and convince the jury that that's what the tape is saying.

Actually in new York it is, I'm allowed to record any conversation I have and I don't need anyone's permission and the person I'm talking to has the same right, we both own the conversation as our property
Depends on the state. Where I live I need to y pi u have permission to audio record a conversation. In New York, you can record any conversation without the other persons permission. It’s really easy to find, you use this tool called google and type in New Yorks recording law.

Yes, if you are involved in a conversation (as in being a speaking member of the conversation) you are allowed to record all parties without permission. Michael Cohen was Trump's lawyer, he was absolutely a part of the conversation recorded. It's perfectly legal and admissible in court.

It did matter in 2018. Cohen went to jail and they are now using the tape against trump to put him in jail.
I remember hearing the tape in 2018. If this is the same tape everything on it was unintelligible , because it seemed like Cohen was sitting on the recording device.
Because, according to the legal opinion of the Office of Legal Counsel, sitting Presidents cannot be prosecuted. Thus, Cohen was charged, tried, convicted, jailed and released all while Trump was in the WH, for being the accomplice of 'an unindicted co-conspirator'. The 'co-conspirator', as POTUS, could have pardoned Cohen, but he let him go to jail. Please pay attention.

You could hear voices, but nothing was distiguishable. I remember it because the only thing it really proved was that Cohen was recording his client . If his conviction didn't get him disbarred that secretly recording his client would have. Now you're telling me prosectors invented a text transcript to say what the recording is saying even though you can't actually hear anything from the recording itself? How did the judge even allow that?
