Technically it is illegal to make any false charges. Lying in court is purgery. It's already a crime. While I don't like that people do this kind of thing, I don't know if more specific laws surrounding false rape claims would be a good idea. The courts get things wrong sometimes. It happens. I would be concerned that rape victims might be even less likely to come forward (we already have a problem with victims not wanting to come forward, for various reasons) if they might be charged for a false claim simply for losing the case. I'm not saying false rape charges aren't a big deal. I'm saying there are already laws against it (even if they aren't properly enforced). The system is already fucked. Adding more rules to it won't necessarily make it better.

Just read the Title IX office that does the investigation was deemed to have bias and thus their investigation was unfair. The office is ran by some lady that has cost USC many very expensive lawsuit settlements due to bias and improper investigation. Unless you can afford to pay more than what the prison system will make you must prove innocence. I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. Thank Obama for changes to Title IX. Just doing his part to address the rape culture in our universities. To be fair, Title IX didn't affect his criminal case - he was cleared of all charges - but he was expelled from USC following their mandated investigation under Title IX which should be subtitled "believe all victims." It's interesting that The Daily Trojan had no problems reporting Armaan Premjee's name, but referred to the "victim" as Jane Doe because she requested anonymity.
For those wondering, he was still expelled from USC in January despite these recordings. He was reinstated in December after filing a lawsuit against USC.

In this case, though, this would not arrive to sentence because in civilized countries it is the accusation that must prove the case, i.e. one should have to prove that there was no rape. Technically it is illegal to make any false charges. Lying in court is purgery. It's already a crime. While I don't like that people do this kind of thing, I don't know if more specific laws surrounding false rape claims would be a good idea. The courts get things wrong sometimes. It happens. I would be concerned that rape victims might be even less likely to come forward (we already have a problem with victims not wanting to come forward, for various reasons) if they might be charged for a false claim simply for losing the case. I'm not saying false rape charges aren't a big deal. I'm saying there are already laws against it (even if they aren't properly enforced). The system is already fucked. Adding more rules to it won't necessarily make it better.

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction.
