Unless you can afford to pay more than what the prison system will make you must prove innocence. Actually in this case, definitely, he pulled back multiple times and when poked put his hand over the area in defence, he’s showing all the signs of non-consent. He may not be aware of it but the video demonstrates that he is indeed a victim of rape and this is exactly what this kind of position was supposed to protect against before the misandrist sexists got involved.

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. It was the state of Los Angeles that were prosecuting him for his actions. This video wasn’t even used as evidence in the trial as the judge dismissed it as inconclusive. I’m not sure why he’s lying about it in the video, he just not telling the whole truth about the night.

In this case, though, this would not arrive to sentence because in civilized countries it is the accusation that must prove the case, i.e. one should have to prove that there was no rape. If e.g. there was a video of the entire night in the room, showing no rape, then one would easily arrive to a sentence for calumny, at least in Italy, and I suppose in most of Europe.

I think a LOT of men have been sent to prison under the guise of "rape" when they were completely innocent of it. Not saying ALL men are innocent but there have been a lot of men who were later found to be innocent of having raped a woman, which only makes one wonder how many innocent men never had the benefit of having evidence presented on their behalf later on that exonerated them. How much of their innocence never came to light because no one cared or because it just never happened for them?
Because you can not charge someone for telling the police what they believe is the truth. Ei, it is 100% legal to go to the police, claim you were raped, tell them you got drunk and a bar and then had sex with someone you did not want to. It is the police's job to then inform you that what you described was NOT a crime. It is only when you intentionally lie about a crime that it becomes a crime. It is really the LAPD fault, not the roommate or the women who had sex. It is also the LAPD who are being sued by the man who they falsely charged, as the LAPD found the evidence of the man's innocence then hide it and charged him anyways. What would she have to face charges for? What this interview and video/report fails to mention is that she was actually in ICU when he was arrested. Very shortly after the CCTV footage she had to be intubated with BAC levels so high they were medically deemed life threatening. The prosecution argued that she didn’t have capacity to give/withdraw consent but they failed to prove this beyond all reasonable doubt, as is the case with many crimes. The cctv was not used to clear him, as he stated. It showed she was intoxicated and appeared to be giving consent. It does not show what happened during the alleged assault. She couldn’t have falsely accused him, as she was unconscious at the time of his arrest. The prosecution conducted an investigation based on medical evidence and eye witness reports of them during the evening.

Just read the Title IX office that does the investigation was deemed to have bias and thus their investigation was unfair. The office is ran by some lady that has cost USC many very expensive lawsuit settlements due to bias and improper investigation. During the investigation and hearing they purposely disregarded the video evidence and refused to allow Premjee's lawyer from speaking (when he tried to anyways they kicked him out and claimed he was being 'disruptive')

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. In this case, though, this would not arrive to sentence because in civilized countries it is the accusation that must prove the case, i.e. one should have to prove that there was no rape. If e.g. there was a video of the entire night in the room, showing no rape, then one would easily arrive to a sentence for calumny, at least in Italy, and I suppose in most of Europe.

I think a LOT of men have been sent to prison under the guise of "rape" when they were completely innocent of it. Not saying ALL men are innocent but there have been a lot of men who were later found to be innocent of having raped a woman, which only makes one wonder how many innocent men never had the benefit of having evidence presented on their behalf later on that exonerated them. It is really the LAPD fault, not the roommate or the women who had sex. As someone who has been sexually assaulted before, this makes my blood boil. I think she should face charges tbh, this kind of behaviour shouldn't go unpunished. Its people like her that make it harder for actual victims to come forward. I have a male friend who was falsely accused of rape and it almost completely fucked up his life. Seriously, some sort of action needs to be taken.

What this interview and video/report fails to mention is that she was actually in ICU when he was arrested.
Very shortly after the CCTV footage she had to be intubated with BAC levels so high they were medically deemed life threatening.
The prosecution argued that she didn’t have capacity to give/withdraw consent but they failed to prove this beyond all reasonable doubt, as is the case with many crimes. The cctv was not used to clear him, as he stated. It showed she was intoxicated and appeared to be giving consent. It does not show what happened during the alleged assault.
She couldn’t have falsely accused him, as she was unconscious at the time of his arrest.
The prosecution conducted an investigation based on medical evidence and eye witness reports of them during the evening.
The accuser's name should be made public just like his name was and she should suffer just as he has. Not fair.

They found her unconscious and took her to the hospital, the police asked who she was with the night before, the room mate pointed to him... The police determined a crime was committed, neither of the room mates did.
