  • When the New FAA REMOTE ID for Drones Rule came out so did BIG changes to Flights over People and Flying at Night rules that will determine what is now legal whether you’re a 107 or recreational pilot. I’ll go through these changes one by one and explain them so we can understand the 107.29 rules and what they really mean to us. It seems that the FAA actually relaxed the regulations a bit which is quite a departure compared to the normal direction, but hopefully this is a new trend.
    -When the New FAA REMOTE ID for Drones Rule came out so did BIG changes to Flights over People and Flying at Night rules that will determine what is now legal whether you’re a 107 or recreational pilot.
    Couple of quick clarifications: I incorrectly stated that the existing 107 Daylight Waivers will expire on March 15th, 2021 and they will actually be good until May 15th.
    Also, I stated 107 pilots can apply for a "waiver" to fly at night in controlled airspace and I meant to say "Authorization".
    The FAA has delayed the flights at night training until April 6th now as the the Biden administration has put a hold on all pending regulations. This will probably slip again.

    Another great informative video.
    On the one hand, I'm excited to do some nighttime drone photography of the Las Vegas Strip. From a distance of course, since McCarran Airport is right there at the south end of the Strip. On the other hand, finding the right spot to launch from and the airspace to fly in is going to be a challenge. The Sectional Chart for Las Vegas takes some serious studying.

      As a Private Pilot Single Engine Land Cert. Holder from 1977 and a resident of Las Vegas for 45 years, I can tell you anywhere on or along the STRIP is OFF LIMITS, due to the CLASS B AIRSPACE extends from the SURFACE to 1000 feet covering Most of Winchester Township and Paradise Township which is where the STRIP is located.

I lived for 30 years in Green Valley about three miles from the end of Rnwy 25 and planes on base would fly so close to my roof, I was editing video on afternoon and I was so sure the plane was going to hit my roof, I jumped in the bathtub. I could hear it coming down from just East of Black Mountain and it kept getting lower and louder. I could visualize through the walls where the plane was and the house shook when it flew over. I was so sure it had to have crashed, I drove over to McCarran to see. Yeah, I don't know where you could launch or fly a drone in the entire Vegas Valley that would be LEGAL. You have McCarran, North Las Vegas, Henderson Sky Harbor and Nellis all in a 45 mile diameter.

      I got my Private Pilot's license in November of 1977 at North Las Vegas airport (Oasis Aviation/Hoot Gibson). The airspace was wide open back then. Get outside of the TCA before it became a Class B and you could PLAY without fear of being busted.

    So to fly at night, a waiver is no longer necessary, must take update training after March 2021, must have anti-collision lights that can be seen for 3 statute miles.
    Also can’t fly in controlled airspace.

    Good explanation of the new night fly rules. Since I will be taking my Part 107 test after March 15, I'm curious to know what types of questions the test might include about night flying. The parts you brought up dealt primarily with lights required for the drone, but I image other questions, like how to best prepare for a night flight, adjusting your eyes, even possibly being able to identify aircraft at night and their direction of travel. Any thoughts?

      Go to Pilot Institute, they help you train for the Part 107 test js... DJI Mini 2 has, a great night vision camera, as does that of the Mini 3 Pro, (Mavic 3), sensors on it as well..

    I have a DJI Phantom 3 Advanced, and the only place to mount the strobe is on the top center of the drone. I though this might affect the GPS reception so I did a test. I mounted the Ulanzi DR-02 strobe with velcro, directly above the GPS antenna of my Phantom and a check of the GPS did not show any significant degradation of the signal. I flew my Phantom for about 30 minutes with the strobe on it, and had no problems.

You may have answered this already, but will I have to retake my exam (Passed on 2/6/21), or will there be separate training available? Thanks

    I treat my drone like a mini semi. It's not a toy and it gets inspected every time I launch it. Props are checked for damage, software updated and to make sure gimbal guard is off. Often I don't fly for over a month so I needed to be sure batteries are charged. At dusk I got a low light level warning and I immediately returned it to home. I still have much to learn about my drone.

    First off, Just want to say, I appreciate the content of this and other various videos that you've put out and I've watched, Thank You.... I will be new to Drone flying soon, just recently purchased a DJI Mini 3 Pro, and expected delivery Jan 13th, 2023...... I also plan on taking a Part107 course and test this month as well, just to be covered in case of..... Just out of curiosity, since I've been researching UAV lighting, Where exactly does the light need to be placed at on the Drone? I've seen another user place his on both sides, rear, and top..... your other video showed top placement.... Where is the official light placement location designated on a Drone?       Thanks for the kind words! There is not an official placement location specified by the FAA, but the reason for the light is to be seen by other aircraft up to 3 statute miles away, so with that as the premise, and assuming other aircraft (manned) will most likely be much above 400' AGL, the _best_ placement for _visibility_ would be the top of the aircraft. I've seen others place them on the bottom because it is easier for the RPIC to see from the ground, but again, that's not the purpose of the 3 statute mile requirement. So I would suggest if RPIC visibility is a priority then place one on the top _and_ bottom, not either/or. Honestly, I've always had them on the top and have not had a problem seeing them as long as I keep it closer, but some drones, especially the mini ones, may have a real estate problem on the top so you'll have to do the best you can with what you have. Keep in mind that orientation lights are required also by 107 so you can identify the orientation of the craft, so those I've usually put on the legs pointing down. These will likely determine how far the craft can be away because those get tough to see and still be able to tell orientation much faster than the white anti-collision lighting. If you are thinking about the 107, may want to check out Pilot Institute for study, they guarantee you pass or money back, and you get a $100 discount by using ALIENDRONES discount code too.     This flying at night was crazy. When I read the rules, it specifically stated to fly at night, the UAV had to have anti-collision lighting, visible up to 3 statute miles. So, I equipped to comply. The rule never specified anything about needing a waiver. Although I don’t believe I broke any rule, as I followed it specifically to how it was written, I’m glad it was eliminated.

For recreational only no special training or waiver needed, but 107, who you could assume would be safer based on the required education, had to jump through hoops and receive a waiver and comply with a ton of detail just to take a few pics at night. At least the FAA recognized something was backwards with this and eliminated this burdensome process in the future. Good Flying! 😎

    Great information. Sounds basically, if hobbiest, don't take pictures or video. If you go flying and take photos/video, can you show to friends interested in drones, without putting on the Internet or charging to see? Not a club, just those flying with you or in your neighborhood thinking of getting a drone?

    I think there is a difference between Recurrent training and updated training. They are not the same. If your 107 certificate is current, you just have to take the updated training for night operations. This will be available on the FAA web site on March 1. When it is time to take the Recurrent training for your 107 certificate, the night operations part will be included. So, bottom line is that 107 pilots can take the night operations training and operate at night. When it's time for your overall 107 training, night operations will be included. Confusing I know but there is a difference.

      Howdy, I just talked with the FAA and according to them there is _not_ a separate training module available for night flying. The night training module is embedded into the initial 107 test or the 107 recurrent training available on March 1st, 2021 but is not available by itself. Sounds like a good idea but alas is not on the radar yet for the FAA. Good Flying!

    Hi Keith, I am a Canadian from Calgary Alberta Canada. I have a DJI Mini 2 drone which is less than 250g, I plan to fly my drone in Orlando and Miami Florida on my vacation next week for recreation purposes, I have registered my drone with FAA and have passed the FAA’s Recreation UAS safety test. I am wondering what else do I need to do to avoid breaking the law? Also, if you have any tips or apps to help me fly safely and legally, please share with me. Thank you

The specifics may be slightly different in the area you're going to but the overall process will work anywhere.       Thanks for the question. So if I understand your question, the key is to follow either the 107 or 44809 rules and always being able to maintain VLOS and be safe _regardless_ if it is daylight or dark. If you can follow all the rules without a VO then it is not required but optional. Remember for the moment VLOS is a requirement for all UAVs so a VO is still required if VLOS cannot be maintained, like in the instance of FPV flights.

    Great explanations, Keith. Maybe I'm seeing things, or in this case not seeing things (I'm half blind in one eye and can't see out of the other), but on your thumbnail it appears your Mini 2 is flying with 3-1/2 props. Front right is missing the bottom half.

      Lol, I think it _banks right_ really well that way! I looked close and I think it is there but reflecting light so it is light gray, one of those visual illusions... I must have looked at it a hundred times and didn't see it though so *good eye* (don't know which one)! If I get a moment maybe I'll pencil it in...

      I think you're right. In looking back at it I can see the light gray you're talking about. The stripe at the tip gives it away. Without that it kinda blends into the arm and leg. Thanks for pointing that out.

    Hi, Keith! You have some good content. I'm new to Drones just ordered a DJI Mini Pro 3 with the fly more kit+. Should have it in my hands Sept 5th. I'm very interested in night flying and was wondering about the placement of the FAA Compliant lights for night flight. I'm thinking a red light on top and white on bottom. I'm currently looking at the Firehouse Drone lights as they are FAA Compliant. Oh and yep I did get my TRUST Certificate and currently studying for the FAA Part 107. So, what do you think about my Idea for placement of the red and white lights?

      Thanks for the kind words! I would out the white light on the top so other crafts can see it from above as from what I've seen the colored lights are visible for a much shorter distance . The colored lights are more to help you identify orientation in the sky so wherever helps you do that would be fine. Good flying!

      I run vifly strobe on rear battery at top. At night I use aerial-pixel mounts to mount vifly's to the front legs with a green strobe & red flasher.

    A question for the FAA dude ... I am a Part 107 certified UAS pilot. I have added a new Skydio 2 to my small fleet. The Skydio 2 has a number of "autonomous" flight capabilities owing to its obstacle avoidance tech. Some of these include flying behind the RPIC ("follow me" or "orbit") even while the RPIC may be engaged in some sort of activity (walking, running, bicycling, etc.). Do momentary lapses in direct sight between the eyes of the RPIC and the UAS aircraft in such a circumstance (and with this autonomous technology involved) comply with the intent of the VLOS regulations?

      @@AlienDrones Lawyers answer - "it depends." In "orbit mode," momentarily. But, "follow me" mode could be set up so the UAS aircraft is following behind the RPIC. This could be more than momentary. But the "autonomous flight" tech provides a measure of predictability of performance and, therefore, control. I suspect VLOS is a "legacy concept," accepted by an FAA bureaucracy cemented into 20th century think and which seems to be losing the race to stay up with tech development. Nevertheless, we who operate w/i the FAA's milieu need to know how the FAA bureaucrats care to interpret/enforce the regulations. This is also important to Skydio owners as the Skydio "no crash" warrantee is obviated if there is a concomitant violation of FAA regs. I have sent two inquiries to Skydio on this issue and the response, so far, is silence.

    Keith, I have a question. If I understand correctly, I can fly at night recreationaly if I have anti-colision lights and follow title 49 USC 44809 rules and safety guidelines for recreational operations. When I enter a flight plan for a night mission into an app like Air map, or open sky, it says pre-flight check list failed no flying at night. Are these apps just not up to date, or am I missing something 🤔? Just want to do things right. Can you help clarify. Thank you.

      Thanks for the question! You can fly at night as a recreational pilot as you mention (you must also have your TRUST certificate in the US) but only in uncontrolled airspace. Since you mention Airmap it sounds like you are asking for authorization in controlled airspace at night which is not allowed as a recreational pilot.

    Regarding the 107 night training, what if someone doesn't need to take the recurrent test for a while, but wants to get the night training now, what are their options?

      The training will exist on March 1st so you can take it then, even if your recurrent isn't due yet. Until the training is taken though 107 pilots still need the daylight waiver until it expires on March 15th, 2021, then no commercial flying until the recurrent training or updated initial test is taken. Since it's free, you can take the recurrent early if you want, no penalty or costs so there's no loss if you take it early... Recreational pilots are good yet without any training... Good Flying! 😎

      It shouldn't. The main purpose of the light is to let other aircraft, including manned aircraft, locate the UAV to avoid a collision, and they are above 400' so they can see the light better from the top of the UAV. If you want to use it for UAV pilot visibility, my advice would be to install two, one on the top and one on the bottom.

      Thanks for the question! My thought would be that the mission is not simply for recreation so it would be considered "advanced" in nature, which would require an advanced certificate.       We didn't post or document any of our experience which likely kept us out of any trouble. The family kept our involvement as quiet as possible outside of the CHP and recovery teams.

    So since you seem to be pretty up on all the FAA rules what are the rules for Law Enforcement flying at night in a controlled airspace my department is starting a drone program so we have a lot to learn and we have a major airport in our jurisdiction and you are good at putting FAA rules in terms that can be understood

      Thank you for the kind words! Currently the LAANC process is incompatible with night operations and a waiver is required. Law enforcement/first responders operating under Part 107 have an option of using the _Special Governmental Interest process_ which may be eligible for expedited approval through the Special Governmental Interest (SGI) process. Keep in mind to apply for a waiver through the SGI process you must be an existing Part 107 Remote Pilot with a current certificate OR you must have an existing Certificate of Waiver or Authorization (COA). The forms are here: www.faa.gov/uas/advanced_operations/emergency_situations/ ...I have limited personal experience with these but should point you in the right direction… Hope this helps, Good Flying! 😎

      @@AlienDrones thank you so much you always have a wealth of great information, I will look into this, most of the time we need the drone at night it’s at a moments notice, we got somebody that’s committed a felony and has run an hid normally in wooded areas around the airport so we will be sending the drone up with the FLIR on it to try to locate it and since we don’t have any real hi structures in those areas we won’t be needing to fly at a very high altitude, we are just getting started so we have a lot to learn so thank you for your help

      @@AlienDrones yes that the other thing my department does we have the only marked search&rescue Airboat in the state so we do a lot of flood rescue we have one heck of a nice boat built by Diamondback airboats in FL it is 650 hp supercharged fuel injected and inter cooled and we have FLIR and side scan radar on it and to date we have 898 rescues but now having the drone will be a big asset in looking for flood victims

    Great info. I currently have my 107. I obtained my certificate in May of last year. If i take the recurrent test in March does that start my 2 years until recert or will my original test date stand as it is now? I purchased the Lumcube and fly regularly with it turned on even during the daylight. really surprised about the position lights. I am still looking for a light for the bottom of my mini 2 basically for line of sight. do you have any suggestions? The way i understand it, is I can,t fly at night without a daytime waiver until March or am I wrong. I'm really excited about getting to fly at night.

      Thanks for the questions! Yes, if you take the recurrent test in March then it restarts the 24 months. Good thing is doesn't really matter that much since it's free and just training, no big studying marathon. I'm going to take mine early as well since my daylight waiver will be expired on March 16th. The way I understood it is that you can't fly legally at night for _commercial_ purposes unless you have a waiver or the _new_ night training done. But you could fly _recreationally_ until then... I just heard there may be a separate night training only that could be taken and then followed up with the full recurrent training later, but I'm unsure of the details. I'll ask the FAA to be sure and drop an update with what I find... Good Flying! 👽🛸

      Just a follow-up, I just talked with the FAA and according to them there is not a separate training module available for night flying. Like I originally understood, the night training module is embedded into the initial 107 test or the 107 recurrent training available on March 1st, 2021 but is not available by itself. Good Flying!

    What exactly do I need to have with me when I have registered my drone I have the numbers on it . I have the trust certificate. Saved what do I need with me to comply with the cbo requirements. Do I need to print something out. I know the 9 safety guidelines but what should I have and what should I say if asked about the cbo

      The CBO guidelines are part of rule #2. As part of this, the following is what the rule states: "2.2.2.1 Recreational flyers should be able to explain to an FAA inspector or law enforcement officer which CBO’s safety guidelines they are operating under
      during any given flight. However, an operator does not need to be a member of a CBO to fly under its safety guidelines." So where this will come in is in a situation where a officer walks up and thinks you are not flying safely. He can ask you the above information to ascertain if you are following the safety guidelines of the CBO you have chosen, and of course they already know what they think was wrong. So if you can recite the rules and guidelines of the CBO, you don't need to carry anything. I always recommend taking a copy of the CBO rules you chose to follow though, because in that situation I would be nervous and probably have a hard time remembering my name much less the regulations... Again, it is not required, but that's just my recommendation based on trying to be prepared. Hope this helps!

    OK, OK....I'll try not to get a DWI.......Droning While Intoxicated. I assume that would fit the bill of "a physical or mental condition that would interfere". If that is the case you may need to bump that number of 3 up a little bit.... Like two orders of magnitude at least hahahha
    I was wondering about the brightness test of the strobe. I saw another review where a strobe was claimed as meeting the rule but the reviewer though it was far far from it. Either way, it would probably be best to get a quality lightweight strobe.

      Thanks for the comments! Indeed, all strobes are not made the same. The LumeCube one _is_ very bright and is a real "strobe", not just a "flashing" light. I'm sure there are others out there but as long as the manufacturer puts it in writing that it does the 3 SM, has 360 visibility and the RPIC keeps it within line of site hopefully should be good to go!       The fact you don't need a VO to fly at night does not remove the obligation to have a VO if you are flying FPV. If you are flying FPV, you always have to have a VO.

    i did my 107 in Late December 2020. Got the license card early Feb 2021. Do i have to redo the test for night flight or is there another test specific to night flight?

      Thanks for the question! Unfortunately there is not a "stand alone" night flight training. The only way at the moment is to take the 107 recurrent training that includes the night training. It's more than you need (me too) but at least its free. Good flying!

    Did you find something specific that's referring to LAANC? From what I understand changes to LAANC to allow night flight are on the way. Maybe you can ask on your next call to the FAA? See ua-cam.com/video/IYcdC6GgnOo/v-deo.html

      Indeed I did ask about this just a couple of days ago and the LAANC is not available for night flights so the information is current as of today. I will be sure to put it on the list for the FAA and see if there is something concrete in the works and post an update as soon as I find something out...

      The FPV falls under the SAME rules as any other UAV, including, quads, copters, RC planes, etc. They are all the _same_ according to the FAA. Good Flying!.

      The rules for flying FPV at night are the same as during the day. The main FPV rule is you must always have a visual observer, since by definition, you are not flying within Visual LOS when flying FPV.
