  • On November 13, 2016 Lt. Brian Filipiak of the Washtenaw County Sheriff's Office was arrested on suspicion of "super drunk" driving in northern Michigan’s Montmorency County. RELATED STORY: s.mlive.com/MAHqYvW
    Highlights:
    00:15 Montmorency County Sheriff Deputy Zachery Morrison passed the pickup truck driven by Brian Filipiak, an off duty Lieutenant of the Washtenaw County Sheriff's Office and turns around in pursuit.
    00:45 The pickup truck is seen swerving over the fog line, into the shoulder, then back left over the center line.
    1:00 Filipiak pulls his truck to the side of the road as he passes a Michigan DNR officer who was also responding to the 9-1-1 calls for a reckless driver.
    1:20 Deputy Morrison approaches the driver
    1:27 BODYCAM FOOTAGE BEGINS - The assisting DNR officer can be seen on the other side of the truck.
    2:54 Deputy Morrison returns to the truck to have Filipiak take a field sobriety test.
    11:50 Deputy Morrison beings to physically remove Filipiak from the truck.
    13:25 Deputy Morrison and the assisting DNR office attempt to pull Filipiak from the truck.
    13:48 Deputy Morrison warns Filipiak he’ll be tasered if he does not exit the truck.

      You should not thank him. If it was you or I, we would have been on the ground with a charge of resisting arrest, much faster then he got his. I have great respect for our protectors, however if that body cam wasn't there someone may have been killed.

      I lived above a crooked criminal state boy who got an award for a certain amount of drunk driving arrests! Unfortunately, the Sheriff's Department in that county is completely corrupt and allowed this crooked POS and his family to get away with ALL of their crimes and that included making meth on the property, among WAY too many other crimes! It's great to see this cop making this crooked scumbag pay for his crimes!!

      Agree totally. I feel badly for Deputy Morrison. He must have just been disgusted because a fellow LEO made him go to such lengths. I wish the honorable Deputy Morrison had a K9 officer with him. Yeah, the vid would have been shorter, but K9s have a way of cutting through crap to get the job done and they don't care if it's another cop or a civilian. And they are so fun to watch. lol

    As someone who was engaged to a cop and with him for over 6 years, I know a lot of them believe they are above the law and that the blue blood runs deep. I am so happy to see this man be held accountable for his actions.

      OUIL arrests are common in Law Enforcement, it's a Misdemeanor... In most cases you will NOT be terminated..

      StarrTile cops, judges, politicians or anyone with any power over the public in any way should all get the maximum that we could get for their crimes especially DUI or resisting arrest. Not sure how long you could sit in jail for DUI in Michigan but in Washington state they could give you 365 days in jail, $5,000 fine and a year of probation even if you blew only 0.08 BAC

    There is absolutely no reason for them to have to tell him 50 times to get out of the car or get in to the car. If that was one of us I am positive they would not allow us to not obey their orders

      Actually I see it fairly regularly in these videos. They are told to deescalate and avoid getting physical. So it might seem a waste of time, but that's better than going nuts beating or killing suspects. Cameras doing what they are meant for.

    This guy was stripped of his title yet remains in a support role at the Washenaw County Sheriffs office as of 2017. This was his third alcoholic incident. He blew a 0.17 this go round and 0.28 and 0.27 previously. Ridiculous how entitled this guy thinks he is. Im disgusted.

      Yes, if the officer does not arrest an intoxicated person and then the intoxicated person kills - this would make them both at fault. The officer is at fault for not doing his duty. The intoxicated one who kills is also at fault. That's how responsibility works.

      Keep in mind he is completely drunk. Unless he drinks on duty I highly doubt he would act like this. People have bad days. He doesn't deserve to be a cop anymore but we shouldn't assume that he'd abuse people. Bridge too far.

    👏👏👏Deputies you two were fantastic and gave the drunk more opportunities than I would have, to comply. I was married to a cop and the one good thing I can say about him, he didn’t think he was above the law. Thankfully there are officers like him and the two of you that recognize that police officers still have to follow the rules of law. It’s the FIRST thing they mention, because that’s what they expect to happen. Police protect police. They do not face consequences like we do. They are quite literally above the law.

      I know, and you are correct, and no special privilege would be right at all. HOWEVER, I will say when they found out he was an L.T., a HIGHLY respected rank in police departments, THAT caused them to pause, listen to his pleas, slow-walk this. But Morrison followed the expectations by the BOOK. Small department, which helps, too. East Coast departments, he would have possibly been CRITICIZED by fellow officers. And abusively, too.

      If I had to guess, I'd say he got the RO charge. The arresting cop was just trying to get the sleezebag LT to comply and make the process easier by telling him that stuff. The video footage would make *not* charging an RO impossible. The evidence is all there. No way that LT didn't get RO.

      Every video I have seen of cops being arrested (and it’s a lot) they are always treated totally differently from your random person. Even when the cop is being a complete ass like this guy and comparatively the random person is actually doing everything right.     I find it rather incredible that he got no jail time, just probation, and that he was removed as being a sworn officer BUT he was rewarded with a job in the Sheriff’s office. Anyone else would have been under the jail. Shame on the Sheriff’s Office.

      The way he expected to drive away right off the bat, then continued to try and convince him to let him go tells me this isn't the first time he's gotten pulled over drunk driving. I get the feeling a few officers without body cams let him go. He's definitely been drunk driving regularly for a long time. I'm glad that we have body cams now and this is exactly why we need them. I saw another video like this and the off duty officer was PLASTERED, in an undercover car, full of guns, then he fled going over 100 mph when they got him to stop he dead ass says "Come on, we're brothers! We protect our own!" The officer asks what would you do if it was flipped?" He says "I would let you go!!". Disturbing af, how many officers he has certainly looked the other way for - for a variety of crimes. Just because they are officers.

(Over 3x's legal limit). 1 year probation and denied certification as a law enforcement officer. Due to 21 years of service and employee file, (and negotiations by union), He is still employed with dept, but only as a deputy on a conditional basis in a support capacity only. I.E. - Manages property, supplies, equipment, etc. Lost his rank and rights to dispense any authority. Pay reduced to entry level deputy. From $79,017.23 - as a Lt., to $41,903.88 - deputy.
    Deputy Morrison, knowing that this incident is now plastered all over the net, I hope you return frequently and update yourself on comments. I sincerely hope your superiors issued you a certificate, or at least commended you in your employee file, on your exemplary handling of this matter. Thank you for your service. Stay safe, sir.

A cop came and tapped on my window and told him my keys were in my trunk. He checked and left me to sleep it off but came by several times over the night and he seen that I was still ok and kept my word on not driving. Why these people don’t understand that they should not drive under the influence, is beyond me. I never put myself in a situation like that again.

Even if he was a high ranking black officer he guaranteed wouldn’t have been thrown out of the car and knee’d in the back. Just because you like to make everything about race doesn’t mean that’s how it actually is. For everyday citizens it comes down to how you act with the cops 99% of the time.

      @@kennethguthrie180 what is comes down to unfortunately is money. Whoever has a lot of money and can pay for lawyers and get lesser sentences or get off all together. Skin color is not the reason someone gets more time in prison than someone else. People can try to flip things and try to make something seem a certain way but they won’t get in to the actual reason someone might get more time than another person.
      For example you could have a white guy and a black guy both arrested for the same charge and the white guy gets 5 years and the black guy gets 10 years. The first thing people like you will say is oh that’s clear racism but you won’t look further into the case. The white guy could be charged with his first ever crime and get 5 years for it while the black guy has been charged with the same crime multiple other times so he gets 10 years because of his criminal history. But people don’t like to mention things like that because it doesn’t fit their narrative.

      You don’t realize how a traffic stop works. It’s already called in. Documented that his patrol car is pulling over car with Certain plate number. If he was to let him go and the drunk cop killed someone the arresting officer would be liable. I hate cops but this officer is RARE

    Shoot. I've been down that road so many times; it's peculiar to see such a popular video from this place. It's true, though. Montmorency County is basically a forest, a beautiful forest, but nothing much goes on there. Hell, nothing much goes on for the next 75 miles in any direction. The police department there is small for a reason; if they tried anything silly, the investigation would be swift.

    I can’t believe your backup unit 17 arrived and never got out of vehicle, don’t ever count on that nit for serious help. What you just went through is one of the worst parts of the job!!! That's why he kept saying his hands were tied, He wanted to let him go but would have lost his job if he did. The police throughout this stop also gave him very special treatment. If it was anybody else they probably would have drawn their weapons and ordered him out of the car right off the bat.

      There’s good ones, but we had a police chief who outfitted a 4x4 pickup with hardware most patrol officers would consider excessive so he could drive it to have affairs with multiple women and he was a youth pastor at the time. Another officer was in a leadership role in the Klan. It’s been some time since both were run out on a rail but those who abuse power tend to do it until stopped. My town has a population around 3500 as a bedroom community to the only major city in central Kansas with a total county population of half a million The new chief sold the pimped out truck to another department because he found it to be impractical and they acquired standard Ford police vehicles and there are no more reports of on-duty adultery or officers belonging to hate groups. I only know most of this because my father was an EMT instructor/coordinator for Region III EMS and volunteer EMS and fire for 40-odd years and being 5th generation in my hometown I hear everything. This Lieutenant had ought to been the example of correct behavior. I’m a civil servant for the federal government (civilian) and my behavior is still dictated by the rules off duty. I’m small potatoes. This dude probably misjudged how impaired he was and how much that badge counts when he f***s up. Speeding ticket? Courtesy. 4000 pound rolling missile that can barely stay between the ditches? Handcuffs.
