Why not print out the case law that shows panhandling is not a crime and give it to the cops when they show up? Tell them to show this to their City Attorney and if they arrest you, they will be sued and their qualified immunity is gone! Good work as always!

It's fine to "get a call". So you either ask a few questions of the caller, like "are they on a sidewalk or public area?" or "Are they causing a disturbance?" or you roll by and look at what's going on. If you don't see them breaking the law, move on and LET THEM BE. I'm close to a city police officer and they state they get calls all the time about people open carrying. They usually do a drive by and see if there is anything going on, but rarely stop and get out on the person open carrying since it's LEGAL.

Absolutely. How hard would it be to ask the caller, "What, exactly, did you see? Did you see/hear him ask for money? Did you see him accept money? Did he enter your property?" etc. If the answers don't cut it, you patiently explain to the caller that it is not against the law for someone merely to exist in your general vicinity, no matter how much you might dislike him.

I'm surprised by the officers gross ignorance since years ago Vero Beach found out that panhandling was not illegal in Florida, and then put signs up around town asking people to not give money to those soliciting it.
It amazes me that so many cities still have panhandling ordinances. That was settled more than 6 years ago. Our town changed ours right after. Now aggressive panhandling is illegal but simply asking for money is legal.

You would think the police would be informed about panhandling being legal in Florida since the law was ruled unconstitutional, this is why qualified immunity needs to go away, they have no incentive to become educated and follow the law. Someone did some research years ago which revealed that most cops learned about Constitutional protections from watching cop shows on television, and that it took about twenty years for decisions to reach the street officer.
The police always say "they said you were on their property" but at no time have I ever watched a police officer ask the complainers for proof of that happening. They always throw the onus on the law abiders stating they are doing an investigation but never investigate the crybabies to show proof that a violation occurred.

If you get a Corporal acting as a Supervisor, beware! When she said "They said you were on their property" this is complete hearsay, not admissible in a court. The cops witnessed nothing. This is the norm for many departments. Hopefully Jeff will soon give the silent treatment to cops. He'll probably get arrested, but it's an easy lawsuit for his lawyer. It's a treat to see Jeff occasionally challenge them on the panhandling ordinance. It seems Florida cities have an abundance of this unlawful ordinance. It's actually a more difficult time if he gets arrested. The criminal case has to be resolved before a civil suit can be filed. Also, case law says that remaining silent isn't an invocation of your 5th amendment right to remain silent, so you have to declare that you're invoking that right. Once they threaten arrest to make you comply the rights violation has already occurred.

No problem responding to anonymous calls it's how the police respond is the problem. Once they figure out the activity is lawful the cops should move on. But most cps escalate it especially of said person called on won't ID or answer questions.
First of all, Jeff I love how politely you deal with these people in your videos. It really should be about educating the police. They are not lawyers, and mainly go off training, and what the attorney's tell them. The goal should always be education. "We got a call". Why would they believe a caller over a person standing in front of them? Answer- it's the only way they can make an arrest or get that good good blue crack otherwise known as ID.
The person that called, was not identified, and therefore has no credibility. The fact that the cop doesn't realize that and still threatens to arrest you shows that they're stupid. Hearsay is not probable cause to effect an arrest. Or else any person can go up to a cop and lie on another person to get them arrested.
I love that another auditor always asks the name of the complainant. Then the cops says their name is private, and then he says so is mine. It's a quick lesson in the 4th amendment.
It's not necessarily that they're stupid...it's that they're taught wrong. They aren't properly trained on civil rights issues and the supervisors don't know any better thus don't correct the behavior of their subordinates. So they end up just emulating what they've seen other cops with more experience doing, which is also wrong for the same reasons. It sounds right to them and they've seen officers with seniority handle situations the wrong way and have probably effected several arrests based in these incorrect assumptions and never caught any blowback from them because most people the arrest don't know their rights either. So it's been a long standing cycle of ignorance that they adhere to because that's all they know. It's a failure of leadership within these agencies that will only be corrected when the people demand of their elected officials that officers be properly trained on the subject matter. Things like this and the fact that officers push so hard to get everyone's ID on every encounter. It's not that way because the individual officers are just tyrants demanding something they know they aren't entitled to. It's normally a matter of policy...they're required to get ID from everyone they encounter and if they don't they have some explaining to do to their bosses. Naturally, officers assume it must be lawful for them to demand ID if their policy requires it. To them it makes no sense that anyone would not want to be identified and they're taught to assume that if someone doesn't want to ID they most likely have warrants. And traditionally, this was most often the case, prior to the current trends of widespread anti-police sentiment and of the popularity of "auditor" videos and more Americans becoming more aware of their rights. For many years the police were never questioned or given any pushback on demands for ID and various other things they have for so long been used to requiring without legal authority to do so. The only way the policies that require officers to do things that they have no legal authority to do will change is for the people to demand these policies be changed by their elected officials who are in charge of these agencies, whether it be the mayor or sheriff...
its sad to watch our law enforcement officers not know changes to ordinances etc. As an engineer, if don't keep up on current codes and changes in my field, i could lose a project, client, job, or worse a member of the public could lose their life. Why can't we reach accountability in all facets. Ignorance even on the law enforcer's part should not be permitted.

Yeah right and then they arrest him, book him in, and he spends a day in jail. Then has to fight it in court while they get paid overtime to show up to court. It's fine to "get a call". So you either ask a few questions of the caller, like "are they on a sidewalk or public area?" or "Are they causing a disturbance?" or you roll by and look at what's going on. If you don't see them breaking the law, move on and LET THEM BE. I'm close to a city police officer and they state they get calls all the time about people open carrying. They usually do a drive by and see if there is anything going on, but rarely stop and get out on the person open carrying since it's LEGAL.

This should be easy - cop arrives, sees no laws being broken, and cop leaves. And the old "panhandling" routine. Panhandling is asking for money - freedom of speech.

Absolutely. How hard would it be to ask the caller, "What, exactly, did you see? Did you see/hear him ask for money? Did you see him accept money? Did he enter your property?" etc. If the answers don't cut it, you patiently explain to the caller that it is not against the law for someone merely to exist in your general vicinity, no matter how much you might dislike him.

However, judges have historically turned a blind eye to police running hobos out of town or into a cell. I'm surprised by the officers gross ignorance since years ago Vero Beach found out that panhandling was not illegal in Florida, and then put signs up around town asking people to not give money to those soliciting it.
It amazes me that so many cities still have panhandling ordinances. That was settled more than 6 years ago. Our town changed ours right after.

So sad that they choose to treat the most vulnerable that way. You would think the police would be informed about panhandling being legal in Florida since the law was ruled unconstitutional, this is why qualified immunity needs to go away, they have no incentive to become educated and follow the law.

Qualified immunity only applies if there isn't clear case law and an officer should have reasonably known it, when you tell them they know.

Someone did some research years ago which revealed that most cops learned about Constitutional protections from watching cop shows on television, and that it took about twenty years for decisions to reach the street officer.

If you get a Corporal acting as a Supervisor, beware! When she said "They said you were on their property" this is complete hearsay, not admissible in a court. The cops witnessed nothing. This is the norm for many departments. Hopefully Jeff will soon give the silent treatment to cops. He'll probably get arrested, but it's an easy lawsuit for his lawyer. It's a treat to see Jeff occasionally challenge them on the panhandling ordinance. It seems Florida cities have an abundance of this unlawful ordinance. This is what happens when clueless citizens become parts of city councils and vote on ordinances that are unconstitutional. The ignorance is unlimited.
It's actually a more difficult time if he gets arrested. The criminal case has to be resolved before a civil suit can be filed. Also, case law says that remaining silent isn't an invocation of your 5th amendment right to remain silent, so you have to declare that you're invoking that right. Once they threaten arrest to make you comply the rights violation has already occurred.
Most legislators and executive branches don’t care if it’s an unconstitutional law, their attitude is “let them fight it in court”.
You know there's like 27 different exceptions to the hearsay rule, and it actually IS admissible in court about 40% of the time.

No problem responding to anonymous calls it's how the police respond is the problem. Once they figure out the activity is lawful the cops should move on. But most cps escalate it especially of said person called on won't ID or answer questions.

First of all, Jeff I love how politely you deal with these people in your videos. It really should be about educating the police. They are not lawyers, and mainly go off training, and what the attorney's tell them. The goal should always be education. In the end it worked out like it should have, the young cop got the supervisor, and she did not demand id, or try to make him leave. Good job Jeff.

The person that called, was not identified, and therefore has no credibility. The fact that the cop doesn't realize that and still threatens to arrest you shows that they're stupid. Hearsay is not probable cause to effect an arrest. Or else any person can go up to a cop and lie on another person to get them arrested.
I love that another auditor always asks the name of the complainant. Then the cops says their name is private, and then he says so is mine. It's a quick lesson in the 4th amendment.

It's not necessarily that they're stupid...it's that they're taught wrong. They aren't properly trained on civil rights issues and the supervisors don't know any better thus don't correct the behavior of their subordinates. So they end up just emulating what they've seen other cops with more experience doing, which is also wrong for the same reasons. It sounds right to them and they've seen officers with seniority handle situations the wrong way and have probably effected several arrests based in these incorrect assumptions and never caught any blowback from them because most people the arrest don't know their rights either. So it's been a long standing cycle of ignorance that they adhere to because that's all they know. It's a failure of leadership within these agencies that will only be corrected when the people demand of their elected officials that officers be properly trained on the subject matter. Things like this and the fact that officers push so hard to get everyone's ID on every encounter. It's not that way because the individual officers are just tyrants demanding something they know they aren't entitled to. It's normally a matter of policy...they're required to get ID from everyone they encounter and if they don't they have some explaining to do to their bosses. Naturally, officers assume it must be lawful for them to demand ID if their policy requires it. To them it makes no sense that anyone would not want to be identified and they're taught to assume that if someone doesn't want to ID they most likely have warrants. And traditionally, this was most often the case, prior to the current trends of widespread anti-police sentiment and of the popularity of "auditor" videos and more Americans becoming more aware of their rights. For many years the police were never questioned or given any pushback on demands for ID and various other things they have for so long been used to requiring without legal authority to do so. The only way the policies that require officers to do things that they have no legal authority to do will change is for the people to demand these policies be changed by their elected officials who are in charge of these agencies, whether it be the mayor or sheriff...

its sad to watch our law enforcement officers not know changes to ordinances etc. As an engineer, if don't keep up on current codes and changes in my field, i could lose a project, client, job, or worse a member of the public could lose their life. Young officer took an oath he didn't understand to do a job he doesn't understand. Not sure he joined law enforcement for the right reasons...AND how come a 'caller' can remain anonymous but the 'suspect' that isn't committing a crime must give their ID?
They take an oath in court which they among themselves call testilying.
