A few additional thoughts. The officers could not even identify the authority that issued the trespass. Don't you find that ma bigger issue? Did they identify the complaint any, get a signed complaint and document the authority the individual was claiming over the property. It is after all our property and he is but a custodian. I don't think we gave him authority to trespass anyone of us from our property. We make laws to deter and prohibit criminal acts but we make no law that makes a person's presence a crime because of who they are, how they look, talk or think. If the act is unlawful then it is the act that is trespassing not the person's presence. There is no such thing as being trespassed from public by anyone but a court and that only happens after a hearing and a court order. In fact the really trespass from public is called incarceration, that's when your personal presence is unlawful in places where others presence is lawful. What would have happened if Jeff had said he would put the sign away but he wasn't leaving and he was still going to exercise his free speech? I think that would be an excellent test to prove the point. But using the camera, free press, thee sign invoking God, freedom of religion, expression and speech all on a traditional public forum that is in no way restricted, limited or secured forces the officers to violate so many protected and clearly established rights. I would think Jeff would be doing well on just the settlement payments he should be collecting from the people. Especially those who would still argue whether this is loitering or not. Let's just say he is loitering, so what? Why is that a crime? Simple really, it's an excuse to criminalize undersirables in our communities. Just another community standard/welfare law that places the feelings and fears of the collective above the rights and freedoms of every individual. They shouldn't have the option, it shouldn't be a violation. And of course the whole trespass issue. Most people are unaware of this but some might recall " The Lord's Prayer" and the use of trespass. Trespass is not a person's unlawful presence upon the real property of another, that's only one legal definition. A trespass is actually any offense or violation against another from battery or unwanted touching to intellectual property theft or copyright infringement. Obviously few officers actually know the law, the constitution or even the English language. You'll constantly hear them say they have the right or the lawful right under law. Fact is, they have authority under law not rights. People have rights, titles, offices and positions have privilege and authority, duty, obligation and compensation. Laws never give rights they can only limit, restrict or prohibit the exercise of a right that must already exist. There's just so much wrong with this interaction from every aspect, I just don't think quoting a definition from an unconstitutional statute is really what needs to be addressed. Just my thoughts and you get what you pay for so take them for what value they have.

The sad part about this is that the officers will be told that what they did was incorrect, but that if it happens again they should handle it the same way because it worked to resolve the situation. There is a practice of letting the courts deal with it so that they can feel useful. But it should be more important for them to do the right thing rather than just feel useful. They don't care about right and wrong. All they care about is generating revenue and getting through the day so they can go home. They don't take their responsibility to uphold our laws seriously.

There's absolutely no proof of that. Jeff sued maybe 2 or 3 times over the past 10 years, which he talked about / posted about here on the channel, basically only after he actually got arrested. @@marw1920 Different levels of Government paying out settlements influences policies and training programs. Police training is not static, it changes with the laws in place, court rulings and expectations of society. Court rulings and law suit settlements do make change.

I need closure. With these audits I'd love to see the full circle. I'd love to see these cops and the librarian getting educated by their own city attorney on how they violated your rights. I always love that Jeff does not push it so far to get arrested but far enough to make his point. I really hope Jeff follows up promptly with a lawsuit in federal court first proving these cops violated his first amendment rights on a public sidewalk and that will take away their qualified immunity then I hope he follows it up with a federal suit against both of those tyrants to take away each of their pensions. I have asked many times and he never says if he goes to court and collect money. I would also really like to know. Not in judgment but just so we can understand that if we get violated we can get paid. He should at least tell us that.

Some cities do indeed have a charter document that is called the "City Constitution." However, St. Petersburg, Florida is not such a city. They have a City Charter, not a City Constitution.

You haven’t committed any crime to be trespassed from public property. It’s going to take a lawsuit to have your rights protected, unfortunately you might have to be arrested in order to prove your rights have been violated. That’s easier said than done on my part, probably yours too, but if you want change that’s what must take place. The only problem with that as well is finding an attorney that will take such a small violation case for a small amount expected from a lawsuit. Until then, i guess we just keep getting violated until someone is willing to step up and take the arrest.
I hope Jeff starts carrying copies of case law, decisions courts have made and even the constitution to hand out to tyrant officials who try to squelch our rights. There are even Post Office and DHS memos and directives confirming our rights to film from public as wall as standing and "talking" to people with a sign.

If the act is unlawful then it is the act that is trespassing not the person's presence. There is no such thing as being trespassed from public by anyone but a court and that only happens after a hearing and a court order. In fact the really trespass from public is called incarceration, that's when your personal presence is unlawful in places where others presence is lawful. What would have happened if Jeff had said he would put the sign away but he wasn't leaving and he was still going to exercise his free speech? I think that would be an excellent test to prove the point. But using the camera, free press, thee sign invoking God, freedom of religion, expression and speech all on a traditional public forum that is in no way restricted, limited or secured forces the officers to violate so many protected and clearly established rights. I would think Jeff would be doing well on just the settlement payments he should be collecting from the people. Especially those who would still argue whether this is loitering or not. Let's just say he is loitering, so what? Why is that a crime? Simple really, it's an excuse to criminalize undersirables in our communities. Just another community standard/welfare law that places the feelings and fears of the collective above the rights and freedoms of every individual. Got to have a suit and tie to get a seat, no you can't watch you can't eat you ain't supposed to be here. And the funniest part, had Jeff been ringing a bell asking for donations to help the children in Ukraine, the idiot library dork probably would have donated.

Anyway, think about your argument and ask yourself if the basis of your argument is really rooted in your foundational beliefs. If it is, great I think your beliefs are flawed. If it's not though, consider that and really ask yourself is this the real issue?
To me the fact that a loitering law exist is more of an issue than how the cops interpret what loitering is. They shouldn't have the option, it shouldn't be a violation. And of course the whole trespass issue. Most people are unaware of this but some might recall " The Lord's Prayer" and the use of trespass. Trespass is not a person's unlawful presence upon the real property of another, that's only one legal definition. A trespass is actually any offense or violation against another from battery or unwanted touching to intellectual property theft or copyright infringement. Obviously few officers actually know the law, the constitution or even the English language. You'll constantly hear them say they have the right or the lawful right under law. Fact is, they have authority under law not rights. People have rights, titles, offices and positions have privilege and authority, duty, obligation and compensation. Laws never give rights they can only limit, restrict or prohibit the exercise of a right that must already exist.
There's just so much wrong with this interaction from every aspect, I just don't think quoting a definition from an unconstitutional statute is really what needs to be addressed.
Just my thoughts and you get what you pay for so take them for what value they have.

The sad part about this is that the officers will be told that what they did was incorrect, but that if it happens again they should handle it the same way because it worked to resolve the situation. There is a practice of letting the courts deal with it so that they can feel useful. But it should be more important for them to do the right thing rather than just feel useful. They don't care about right and wrong. All they care about is generating revenue and getting through the day so they can go home. They don't take their responsibility to uphold our laws seriously.

I never considered the irony til you pointed it out. The library is full of free speech. Books can give a variety of opinions and facts. Some will offend, some will make you think, some might give you a bit of happiness. Either way in text or verbally, the library should be the first to protect speech even if some might not like it.

Near the end, Jeff repeats the civil rights of the US Constitution and the cop then states, "You still have to obey the rules of the city". This must be pure B.S. from the cop. Nobody could be that stupid.

Did he really call the city ordinances "city constitution"? Does he even understand what "constitution" means?
Some cities do indeed have a charter document that is called the "City Constitution."
However, St. Petersburg, Florida is not such a city. They have a City Charter, not a City Constitution.
Complaints FOR ALL involved in this blatant Deprivation of Civil Rights, Jeff! I get why you left so quickly, but would’ve loved to see you give a bit more legal pushback. The argument that a City of St. Pete ordinance or statute could supersede a FL State statute (or even the 1st Amendment to the U.S. Constitution) is almost laughable on its face, but knowing you had a great opportunity to retrain and correct that woefully IGNORANT TYRANT seems like a missed opportunity.
You also had them on the Trespass statute. The Manager had absolutely no lawful reason to deny you your ability for free expression on publicly accessible municipally owned property! He clearly LIED to report you as an aggressive panhandler to get them to come out. I’d love to hear that 911 call and make this an even bigger deal for HIM than it was for you…
Would you push it and say ok take me in. Handcuffs tightly applied behind your back and then an uncomfy ride to the station where you will be stripped of every thing you have on you then thrown into a cage while they write reports and take their time getting you anywhere near a phone for help from the outside. Booked and fingerprinted and stripped for a new wardrobe.
Jeff could have pushed it to an arrest but he did enough for a court case against those cops and lying 911 callers.

You haven’t committed any crime to be trespassed from public property. It’s going to take a lawsuit to have your rights protected, unfortunately you might have to be arrested in order to prove your rights have been violated. That’s easier said than done on my part, probably yours too, but if you want change that’s what must take place. The only problem with that as well is finding an attorney that will take such a small violation case for a small amount expected from a lawsuit. Until then, i guess we just keep getting violated until someone is willing to step up and take the arrest.
Threat of arrest as good as arrest. Better actually. No case to fight. Straight to lawsuit.

I don't believe that an arrest is necessary to prove your Rights have been violated. Not trying to debate it. Just stating my opinion.

I hope Jeff starts carrying copies of case law, decisions courts have made and even the constitution to hand out to tyrant officials who try to squelch our rights. There are even Post Office and DHS memos and directives confirming our rights to film from public as wall as standing and "talking" to people with a sign.
I absolutely love this guy. Great stuff. I hope you do follow ups and file complaints on tyrant's otherwise they continue to do it to others.
