"It's in the transcript" really cracked me up, Jimmy making sure she knows there's physical evidence for what he's telling her.
But at the same time it *sounds* like a distraught brother despairing about how ridiculous and fluffed up the whole debacle is.
And it was the final nail in the coffin for Chuck’s career. Once it’s on the public record that you’re mentally ill AND making mistakes on client paperwork (untrue but still) you’re done. Howard knew it but Chuck had too much pride to accept defeat.
@@matthewriley7826 Chuck was also getting better from his mental illness but the doctor told him to avoid stress. First thing he did was going at a legal war against his own office.
He also only mentioned his last name right before this clip started. That way she would look up Chuck's information as well. Then, he's already on her mind as Jimmy talks about Chuck's condition.

Vince Gilligan always nails the "workplace drone" character, whether it's white collar (this insurance agent, many of the public defender/courthouse employees Saul regularly interacts with, Madrigal) or blue collar (the warehouse guys Mike dealt with as "security advisor", or the guys working on the superlab; Skyler and the locksmith). The way he makes the mundane into something interesting is my favourite aspect of BB/BCS.

Something interesting here is that the final blow to Chuck was actually not something slipping-jimmy-esque, but something very chuck-esque. Chuck was fine with being manipulative and sabatoging Jimmy and he considered it morally okay as long as he wasn't breaking the law. Jimmy on the other hand typically has strong morals but bends the law to get his way. In this scene he didn't do anything illegal; he simply told someone the truth in a manipulative way in order to do something nasty to chuck. This is similar to the way chuck is perpetually lawfully sabatoging Jimmy.

This series is the definition of “there are no small roles, just small actors.” The insurance lady, despite only being in one scene, gave an absolutely unforgettable performance. I hope that she and all the other supporting actors received all kinds of opportunities after working on this show.

@@telescopicS627 in reality, front line staff in a reputable company are gonna have more sympathy, balancing between customer service and the interests of the insurer, abiding by the company procedures or government regulations. it's usually higher up or further away from front line staff where they only have the insurer's interest to focus on, leaving it to front line to get all torn between the two interests. they also can't "unhear" things, and i love just how naturally jimmy slipped in that red flag for chuck.

I honestly think his tears were real at first but then he turns his frustration outwards towards Chuck. Jimmy is so good at working an angle, he just does it instictively
The best part is I don’t even think Jimmy initially went in there to sabotage Chucks premium, He literally came up with all that on the spot as soon as he heard his premium was going to rise 150% because of Chuck
His arguments to be refounded were pretty weak for a character as smart as Jimmy. The odds of that happening just because of an appeal to empathy were pretty low. Since thé begining of BCS if Jimmy wants something he starts by making up some strong plan before making any move.
However, this part of the dialogue was necessary to build the naïve character he was trying to sell to the insurance lady. "Oh he told me about his brother by mistake, I might have found some juicy information".

Omg, I saw a video about this very issue the other day. A fan actually tweeted Peter Gould about this and he confirms that Jimmy did not plan this.
It was definitely pre-planned. He made sure to only give his last name when the insurance woman asked so she’d see Chuck on the computer first and know he had a brother also practicing law. Pretty much the only way this was able to work

I love this scene purely because it demonstrates how completely legitimate and non-illicit businesses do completely immoral and unethical things to maximize profits while technically being in the confines of the law.

@@jeevacationI think they were referring to Howard covering up the illness with insurance and clients just so they could keep maximizing their profits.
The reason his show of a breakdown is so very believable is because every single word he uttered was true, he was able to keep such steady control of his anger to make his words believable (wouldn’t be effective if he just yelled and was escorted out), and he was able to come up with the plan in two seconds flat. You can see the wheels turning in his head and worked the plan despite extreme anger. Really a stunning performance.
I think he knew the plan long before he walked in there. He knew the insurance could not be refunded, he just wanted to play the agent so that he could let slip about Chuck. If he had been honest about "just needing a break" then he'd still be upset when he left the office, but he was determined in his anger with Chuck when he left that office and he knew he beat Chuck at his own game. This was a long con, not an on the spot thing.
You know they say that the closer you are to the truth, the easier it is to lie ;)
that's what makes it great, use of true events for a con reason; that's what separates the tiny fish lawyers from the shark ones

"It's in the transcript..." LMAO It's really interesting to watch Bob Odenkirk do one of the toughest things actors have to do, which is to play someone who are themselves acting or pretending. And since Bob plays a con man, he has to do this all the time. In this scene, he needs to have a breakdown that's convincing enough that we believe that this woman believes it's legit, while also being a little off from how Bob Odenkirk plays a real breakdown (for example, when he cries in that empty office after Kim turns down his offer to team up with him) so that the audience feels that it's a con. I feel like there's something in his mouth that doesn't quite feel right in terms of how it looks when he's legit miserable. But maybe I just like looking at Bob Odenkirk's mouth!
Acting has some interesting moments like that that are largely overlooked by the audience. End of the day, in theater performance, your best work goes unnoticed - it's too "natural" to the artist to seem impressive.
One of my favorite examples is Mel Blanks voicing Bugs Bunny and Daffy Duck disguising themselves as each other, complete with bad imitation voices. Except Mel voices both characters in real life. If you can make any kind of character voices, trying to make one character voice sound like a poor imitation of the other is a mental minefield, because you actually *can* do both voices. You have to embody the character of one voice while letting *it* try to be another voice that you're otherwise completely capable of doing naturally. And the end result is something no one notices, because it's a quick sight gag that's done so well no one even contemplates the feat they're seeing.

SHE actually got me. A calm, empathetic listening ear . . . until something that could affect the premium came up . . .
It's literally her job. Pricing premiums according to risk is what keeps the premiums down for the rest of the clients who aren't prone to risk.

This is what essentially killed Chuck. The insurance issue lead to Chuck being forced out of HHM and then Chuck ended up spiralling out of control which ultimately ended with his suicide.
This was part of it but what killed Chuck was his pride and stubbornness and ego. Him threatening litigation against their insurance company is what led Howard to lose faith in him and strongly insist he retired, leading to betraying Howard by suing HHM, forcing Howard to buy him out to save the firm.

Chuck cancelled the doctor's appointment that could have saved his life
It wasn't Jimmy who killed Chuck. Or Howard. Or Kim. Or the power company that couldn't see him until Wednesday. It was Chuck. He was provided irrefutable proof that his condition was a mental sickness, and he pushed away everyone who tried to help him so he could tear his house apart looking for power cables. The fact is that he died because he'd rather fetishize his own pain than admit that it wasn't real.
Oh, and not declaring his sickness was technically insurance fraud, so in the eyes of the law Chuck cares so much about, Jimmy is 100% in the right here.
No, don't say that. All Jimmy did was care for Chuck and spent a significant portion of his life caring for Chuck and putting up with his craziness. And all Chuck did was make Jimmy lose his lawyer license for a whole year. I'd say it's about even. No one could have known Chuck would resort to this
Chuck is what killed chuck. He would have had a total mental breakdown eventually; but crossing his sly, very intelligent brother, was what made it happen when it did.
I believe to be true what someone else already said on UA-cam: “Jimmy usually does the wrong thing but for the right reasons. Chuck usually does the right thing but for the wrong reasons.”

I can see why the show wouldn't appeal to some. The drama is from the acting and the script, both of which are flawless. The stuff that "happens" isn't very flashy or violent like Breaking Bad, but myself and many others still find it genius in its own way, and as good if not better than BB.

Great scene! It's filled with irony- we, as the audience, know that Jimmy is doing this out of spite yet everything he says about Chuck is true. Although I'm definitely not a legal expert, it seems that Chuck and Howard WERE being unethical and even possibly committing fraud by hiding the truth about Chuck's debilitating mental illness from the insurance company. If even one of their clients sued HHM in the grounds that Chuck was incompetent as their lawyer, the insurance company could be stuck paying a huge settlement, let alone if multiple clients sued for ineffective assistance of counsel- it would create a huge mess. Another point of irony- Jimmy is actually doing the "ethical" thing in reporting Chuck's deception to the insurance company even though we know he's doing it for revenge. If another random lawyer had inadvertently discovered Chuck's hidden condition, he also might feel obligated to report it.
Everything’s true, except the part about making mistakes on important documents. Sure it’s in the transcripts but Jimmy gaslighted Chuck.

I wouldn't consider it particularly ethical to give in to corporate profits. Insurance companies are some of the slimiest in existence.
@@brycespringfield Maybe not morally, but in a sense of professional ethics and within the eyes of the law, concealing something like that is definitely wrong. The kind of wrong that Chuck professed to be the most against, for what it's worth. Although I do think that's why he wasn't practicing while he was sick, and why he only came back when he truly felt he was better.
It should be said though that Chuck had done everything he could to deny the claim it was a mental illness and had everyone under the belief that it was just a unique illness that had real physical effects even though chuck is just a hypochondriac.

Alot of times, “I understand” is employed to move the conversation along. Lots of customers respond to “no” by restating their incorrect position in slightly different words. Alot of times, the customer service rep can’t get a customer to accept a “no” until its made obvious to the customer that they do indeed understand what the customer wants and why they want it but that the answer is, nonetheless, no.
That "I understand" calls to mind Lotso Huggins from Toy Story 3.

This is probably the most important scene in the whole show as it set in motion the events of chucks death plus Howard’s path of grief and also being jimmy’s biggest regret and darkest secret
Yeah what's funny is that Jimmy exposing Chuck's EMS as a fake in court was actually improving Chuck's life at this point. He was going to therapy, confronting his bitterness at his brother and even living normally again. What's even more tragic is that Jimmy wanted to reconnect with Chuck after Kim's car accident and it might have actually happened if he never did this and Chuck was forced out of HHM giving him nothing to live for and hate Jimmy forever
Well, by that logic Chuck's sabotaging Jimmy's legal career is what set in motion the events of his death, et al. They're all caught up in their misdeeds.

Love this scene. Such a little spiteful remark by jimmy who doesn't think much of but ends up being one of the main catalysts for chucks death, showing the consequences of actions that may seem small
Also shows he's hurting people out of spite. Chuck had some goal, after the hearing he just wanted to stay away from Jimmy. And out of blue Jimmy strikes back for no other reason than to cause pain

Courtroom rants, "like on Perry Mason" as Chuck called them are a common trope in dramas. Yet, realistically it's a big deal for a lawyer to lose their composure in public, even moreso at a hearing. As someone else said, she could easily lose her job if she didn't immediately follow up on it. There might even be a financial incentive for her to uncover incidents which the company could use to justify far higher rates.

That wasn't an opportunity for exploitation, that was the most reasonable thing she did in the entire scene. She just learned that another customer they were insuring for malpractice was hiding a mental illness, which makes him very high risk and a liar too. Once she found out about the lie, she had legal or moral obligation to pretend she didn't know, help him maintain the lie, and keep insuring a mentally ill lawyer when that literally wasn't what he was paying them to do. He was paying to insure a nonexistent mentally stable Chuck.
The main way the insurance companies exploit their customers is by denying claims that they should approve. It's evil usually because it betrays the customer's trust and/or relies on a loophole intentionally made so that almost no customer could notice it.
But overestimating risk? I don't think that's a big avenue for exploitation, profits are probably maximized when risks are estimated as accurately as possible. There must be a whole team whose only job is to look at the market and set the price per level of risk, and since they are the specialists in it, they will do a better job of maximizing profits than she possibly could by selectively paying attention only to details that increase estimates of risk. From her limited perspective she would make mistakes that they would not make, and drive away customers that they would not drive away.
If you are giving data to the experts, there is no way you can intentionally bias the data that will usually make them make a better decision. What is their expertise for if you're making the decision for them by biasing the data you collect?
So, urgently taking notes about a mental illness is something that any insurance company should do, even a morally mostly good insurance company would do this, if one existed.
And regardless of her morality, if she were doing her job properly, she would take notes just as urgently when she learned that a formerly mentally ill lawyer was cleared of a mental illness.

The absolute brilliance of this scene- a conman using legitimate emotional honesty dishonestly to manipulate an even more dishonest person's work routine to achieve an ultimately petty endeavour.
The scene starts out as an honest tragedy but slowly reminds you that we are already 2 steps behind the grift Jimmy is already making revenge of.
That "Please feel better" at 4:38 gets me every time. She is trying to rationalize her apathy towards clients of her firm while DEMANDING them to feel better without doing ANYTHING to help them.

That best part is that he didn't care about the refund on his premiums. He's was lawyering while suspended and feeling out this insurance service agent to see if she was a stickler for the insurance. Sure enough, she was, "I wish I could help but I can't"... He was picking a mark, an agent that would take what he said and apply it to Chuck's policy and bring in the $$$ and he found her.
Perhaps I’m reading to far into this, but it appears to me that when he first starts crying, you can visibly see tears on his face. But when he decides to use this moment to get at Chuck, his eyes and face look more dry. I could be wrong, but I think it’s quite a neat detail

This scene has got to one of the most unsuspectingly important scenes in the whole show for Jiimmy's character. He knew he was kicking his brother while he was already down, and probably justified it because of all of what Chuck had done to him. But once he finds out that this played a role in Chucks suicide, I think it devastated him so much to the point of denial. He starts scapegoating Howard for his own actions, blaming Howard for "killing" his brother. During his last conversation with Chuck, Chuck says that he'll never change and continue hurting people. Ever since Jimmy has been almost fulfilling that prophecy, and justifying that he's already sunk as low as he possibly could (killing his brother).
Not like Chuck wanted Jimmy license, you don't play with things like that, Jimmy was changing but he saw that people step over him

Because I listened to the DVD commentary, I can no longer see those mountains in the background without hearing Vince Gilligan excitedly talk for five minutes about how this scene was filmed in the AMC offices. That happens at least once per episode.
It's a little bit cut. First he says just "McGill", so she could search all attorneys and find Chuck first (because he is much more professional and respectable than Jimmy). In this simple move he seamlessly introduces Chuck into conversation without explicitly mentioning him.
