If the CAA is anything like the FAA in the USA, only the FAA can govern the airspace. Local governments can govern where you can take off and land, but the FAA rules all of the airspace, period. That ensures uniformity of the laws nationwide. It also prevents rogue councils from creating confusion. I suspect the CAA is similar.
I recall a similar incident involving Dan Gryder with his DC3 and some council heffer trying to shut him down, actually driving her car under his plane as he taxied to take off putting multiple lives at risk just to save face from her own mistakes. I hope he sued her (and the corrupt council) to the moon.

In the case of Tokoroa Airport (NZTO), this location is "owned" by South Waikato District Council. So it's public land but the council provides the approval to fly there or not. A lot of councils provide conditions that must be meet in order to be granted that permission. Typically I believe councils add a few specific requirements, but largely refer to Part 101 rules. For example my local council provides permission if I'm in compliance with Part 101 and a few extra requirements like not flying within 10 meters of any buildings. If I don't meet those requirements I don't officially have permission and therefore would not be flying in compliance with Part 101. Which would be a fineable offence, there is a schedule of fines for infractions in Part 101. I'm not saying that the council requirements are reasonable, just that is the "authority" that they will be claiming to exercise on behalf of the public as "owners" of that property.

I assume that you don’t HAVE to fly every flight you request, so maybe print out a request for a 1 minute flight for the entire day. Then for 2 min flights. Then for 3 min, and shuffle the requests. Submit them all, every day. Should be easy to automate your part and be a major pain on their side. Assuming they must reply to every request.
Bruce, you should be on the council. Lean into it. Replace one of them. In America, we have something called certified mail. This is more serious and produces a legal record that can be used in proceedings. Sending emails is not an indication of as serious a litigation risk. Send the letters in duplicate to their barrister as well. Litigation can be expensive for them. Attorneys charge fees to deal with these issues and the counsel has every right to be informed of potentially pending litigation. Demand specifically for the date the new rules were voted on, when the public was notified and the minutes from the any meeting in which it was discussed. These little Napolean's do not respond to reason, only risk of shame. Framing is important. Thay have restrained access to public services based solely on your disgruntlement or political perspective. Additionally, grave concerns of equal access for people with disabilities or partial disabilities. This is the correct framing that produces the greatest shame the public can understand. Part 101 requires permission of property owner that you fly over. South Waikato District Council are officially the "owners" of Tokoroa Airport (NZTO) and therefore permission is required from them to fly there, and nothing in Part 101 says that permission can't be conditionally on other requirements unfortunately. So they get to add requirements on top of Part 101 regulations. Not saying that their requirements are reasonable, just explaining their perceived authority. Taupo district council for example outright ban flying within kilometres of Lake Taupo, because the whole Lake is considered an aerodome, completely ignoring that CAA would allow shielded operations in that situation. So my choice is to not fly, or ignore the Part 101 requirement for permission, fly anyway and risk an infraction, or wade into the bureaucracy trying to get them to be reasonable.

That said, you were a recipient of an email on the 12th of February 2019 with the new rules attached when they came into effect (as was I, we were both CC'd along with other airfield users). Yes, it's the 2019 rules that allow me to fly under supervision -- that supervision clause was removed in the conditions advised the October 20th letter/email. The fact that this 20th-Oct rule-change has not been promulgated except to *me* kind of says it all, especially when it's not even available on request over the SWDC's counter.

The council claimed that they were acting under the instructions of CAA. Those instructions must have been in writing, so ask the council to produce the relevant documents. If they refuse, ask them to swear an affidavit that they exist and what they say. Remind them that if they provide an affidavit and it can be shown that the documents did not exist or did not state what they claimed, then they may be liable for a charge of perjury or false utterances.
I like that idea. It’ll back them into a corner. A lot like getting a statement from a suspect, then having them sign it then use it against them when they try and change the story.
Are their demands lawfully enforceable? It would seem not, so you could ignore them and go do whatever you like. Part 101 regulations require permission of owner for any property you fly over. Flying without that permission is a fineable infraction, so that's the enforcement angle they would aim for. The implementation of these new rules however seems to be only being applied to Bruce here (unpublished rules) so there is possibly an argument for discrimination. But if they publish the new rules that argument becomes a lot weaker.

It's the same as most licenses. I am a safe legal driver till the day after my drivers license expires, suddenly I'm breaking the law and dangerous to the community. Even though nothing has changed at all with my driving. It's all about money and power just like everything else. The biggest problem I see is people don't think or question anything the majority of people just accept it and obey.

Dear bruce. I am about your age, a very keen model flyer and love your videos. Firstly you are 100 percent right and your adveseries in the councli are 100 percent wrong. I do however feel compelled to give you warning. About 20 years ago i found myself in a situation while working as a prison officer where i discovered the most appaling power abuse and corruption by senior management. I did not whisle blow, but simply made an internal comment. This resulted in a magagment backlash so exteme that i eventally went to my MP. I stayed in post working, but a war then took place berween myself and the managment resulting in an enquiry. The end result was the reallocation of the senior management to other prisons in order to break up their power base, and an apology issued to myself by the minister of state for the prison service. 15 years ago i left the job to work in the private sector. Now to my point. All of the managment team who were critised in that enquiry have now got senior roles in the prison service. Corrupt power structures always protect their own in the long run. They rally to protect their own incompetent fellow workers & there is an internal system in councils to "promote" workers every 6 months .... I.M.H.O councils are full of exceptionally incompetent people that are, after working for a council, destined to forever work for a council as they could not & would not survive in the private sector employment because of their incompetence & sloppiness in their work. The rules have to apply to everyone Bruce, so you need get an enforcement action going so you can demonstrate to a magistrate / crown court etc that it is vindictive enforcement.

The council has enough spare time to review and approve or deny every single flight of every single RC pilot and every single RC plane in thier county ?
Who gave them the authority to require this and what makes them uniquely qualified to determine weather a particular model is safe or pilot is qualified to fly that model of aircraft. Absolutely redicoulous. Here's the thing folks, There's no power in saying yes only in saying no do petty tyrants feel powerful and important.
Part 101 requires permission of property owner that you fly over. South Waikato District Council are officially the "owners" of Tokoroa Airport (NZTO) and therefore permission is required from them to fly there, and nothing in Part 101 says that permission can't be conditionally on other requirements unfortunately.
So they get to add requirements on top of Part 101 regulations. Not saying that their requirements are reasonable, just explaining their perceived authority.
Taupo district council for example outright ban flying within kilometres of Lake Taupo, because the whole Lake is considered an aerodome, completely ignoring that CAA would allow shielded operations in that situation. So my choice is to not fly, or ignore the Part 101 requirement for permission, fly anyway and risk an infraction, or wade into the bureaucracy trying to get them to be reasonable.
I think it's time to report the council to the CAA and then SUE THEIR ASSES for harassment of a disabled senior citizen.

Hi Bruce. I checked on the website, and you're right, the current rules are no longer linked there (they used to be, which is strange). That said, you were a recipient of an email on the 12th of February 2019 with the new rules attached when they came into effect (as was I, we were both CC'd along with other airfield users). Yes, it's the 2019 rules that allow me to fly under supervision -- that supervision clause was removed in the conditions advised the October 20th letter/email. The fact that this 20th-Oct rule-change has not been promulgated except to *me* kind of says it all, especially when it's not even available on request over the SWDC's counter.

The council claimed that they were acting under the instructions of CAA. Those instructions must have been in writing, so ask the council to produce the relevant documents. If they refuse, ask them to swear an affidavit that they exist and what they say. Remind them that if they provide an affidavit and it can be shown that the documents did not exist or did not state what they claimed, then they may be liable for a charge of perjury or false utterances.
Probably easier and more effective to do a LGOIMA request, the Local Govt version of an OIA request. That compels them to respond in public.

Are their demands lawfully enforceable? It would seem not, so you could ignore them and go do whatever you like. As you said last time, it is just bully tactics thinking they are the boss and your position is to just comply. Great to see you carefully investigate and document everything, keep it up!
Part 101 regulations require permission of owner for any property you fly over. Flying without that permission is a fineable infraction, so that's the enforcement angle they would aim for.
The implementation of these new rules however seems to be only being applied to Bruce here (unpublished rules) so there is possibly an argument for discrimination. But if they publish the new rules that argument becomes a lot weaker.

It's the same as most licenses. I am a safe legal driver till the day after my drivers license expires, suddenly I'm breaking the law and dangerous to the community. Even though nothing has changed at all with my driving. It's all about money and power just like everything else. The biggest problem I see is people don't think or question anything the majority of people just accept it and obey.
in my state of Aus, you get punished more if you had a car license and drove without it than those who never had one in the first place

Dear bruce. I am about your age, a very keen model flyer and love your videos. Firstly you are 100 percent right and your adveseries in the councli are 100 percent wrong. I do however feel compelled to give you warning. About 20 years ago i found myself in a situation while working as a prison officer where i discovered the most appaling power abuse and corruption by senior management. I did not whisle blow, but simply made an internal comment. This resulted in a magagment backlash so exteme that i eventally went to my MP. I stayed in post working, but a war then took place berween myself and the managment resulting in an enquiry. The end result was the reallocation of the senior management to other prisons in order to break up their power base, and an apology issued to myself by the minister of state for the prison service. 15 years ago i left the job to work in the private sector. Now to my point. All of the managment team who were critised in that enquiry have now got senior roles in the prison service. Corrupt power structures always protect their own in the long run. They rally to protect their own incompetent fellow workers & there is an internal system in councils to "promote" workers every 6 months ....
I.M.H.O councils are full of exceptionally incompetent people that are, after working for a council, destined to forever work for a council as they could not & would not survive in the private sector employment because of their incompetence & sloppiness in their work.

There is a group of people here in Switzerland, a local RC club, they also have an ADSB alarm on hand. Don't know since when or how long, I've been there only once, am not a member there.
For what it's worth, you're doing it right; methodical and exact and most importantly not getting irregular. Keep fighting the good fight and know you have financial support should you need it.

P.S. I did volunteer work for part of an Australian local council. If I were to criticize any action of council whatsoever, either while doing volunteer work, or in public (my own time) I would be immediately terminated from my volunteer position. Now the difficulty here was counsil was treating my mother improperly on property matter, and I had elected to liaise for her, but was not allowed to be any part of the council volunteer program because liaising on a dispute would be classed as criticism. Silenced.
