I live in Texas and my best friend just suffered a miscarriage a few weeks ago (requiring a D and C). Two days ago she was admitted to the ER then direct admitted to the hospital for life saving surgery after they realized part of the placenta didn't pass (or wasn't removed) and she became very ill. She was never denied care.

He was misdiagnosed by the hospital 2 times. 25 year old active, athletic, healthy male. 1st visit, we told them all his symptoms but when he said he felt like he was having a heart attack they laughed and said he was having a panic attack and they disregarded all the other symptoms. “Meditate and drink lots of water” 2nd visit, 4 days later, they said he had strep throat. Told him to rest and drink lots of water. The next day we went and got a copy of the tests they did. Strep throat was negative but other tests results (bloodwork) were alarming. My oldest son had to carry his little brother from the hospital med files office to the ER because of how sick he was. I cried and told them that my son was f’n dying. He had sepsis. He could have died. The sepsis damaged his heart.

This is where you are all misunderstanding the complexity of the law related to women’s healthcare. Without Roe v Wade, all the subsequent bans now in place put constraints on all varieties of women’s health. It’s not just about abortions and it never was. This has impacted all aspects of women’s health and in states where doctors can be prosecuted.. like Texas, there isn’t a clear line drawn on when they can intervene and not end up in jail.

I actually don't know any fellow physicians or even medical students who don't think this law is harming women's health. And a lot of the students plan to leave Texas when they finish training. The ones that want to do OB? A lot of them won't even apply in Texas. The laws are gray, and waiting until every single person and jury would have no doubt in saying "the mother's life is in danger" is what leads to these tragedies. Because sometimes during a miscarriage, not all the fetal tissue is expelled from the body, and it causes an infection (because,sorry to be gross, but that’s what dead human bodies do, they rot, and that’s how the mother gets an infection), and the only treatment for it is to remove the dead tissue, which, in medical terms, is called “abortion”. And since abortion is illegal, the doctors aren’t allowed to treat her by removing the tissue, so the woman dies.

I want to be careful with accusations of bad faith. But this reeks of bad faith. Firstly, the bill makes a clear exception for the health of the mother. But even if you find that language ambiguous. The notion that there are actually doctors out there who are saying "we need to have TWO ultrasounds to confirm a fetus is dead, because we're worried about the PROSECUTOR," that sounds to me like intentional sabotage. I work in criminal defense, as a criminal defense attorney. No prosecutor would take that case. Look at how many cops have never even gotten charged in police-involved shootings. Prosecutors give tremendous latitude to people working within the confines of their profession. If you said this woman has life-threatening and untreated sepsis from the fetus, we need to abort, no prosecutor touches that case. If you say we took one ultrasound, it came back no heartbeat, we need to remove the fetus, no prosecutor touches this case. Most prosecutors I know are actually quite progressive, but even the most conservative prosecutors I know would never think to touch this case. There is no world in which a prosecutor actually touches this case. If hospitals are, in protest to legislation they don't agree with, slow-walking giving women's health care, then they should be sued for all they are worth.

It's really disturbing that so many people seem to not understand that abortion laws affect actual necessary medical care when a woman is miscarrying. Someone on here actually said "she wasn't seeking an abortion, she named her baby." Do any of you actually learn about things before judging or discussing? *LOTS of women--who were excited to have their babies--have miscarried and were blocked from proper medical care of removing the fetus because of the laws.* I was never a proponent of abortion, but after learning about how restrictive the laws are, I would never be against someone getting life-saving treatment when they're already suffering a loss... or period.

While this is correct, doctors will now be hesitant to do anything that may get them in jail and licenses taken away. Ok guys when it comes to a womans life they need to have the procedure. My daughter had a miscarriage in August and after she found out the hospital sent her home. The hospital never warned her what can happen when a miscarriage happens. Im the one who told my daughter what could happen. She went to her OB the next week and she told her it can be very dangerous that she might need a dnc. We live in California

The death is not tied to abortions, her death is tied to not pursuing pre-natal care. The hospital's would have contacted her OBGYN who would have had her case history and could have provided guidance. What happened is a shame, but pregnancy at that age requires pre-natal care. A d & c is considered a medical abortion. Also any delay to care increases risk of death. So doctors going back and forth, avoiding looking at the actual pregnancy as the issue, and not practicing the care they should for fear they could be sued, equals massive delay. I live in Texas and my best friend just suffered a miscarriage a few weeks ago (requiring a D and C). Two days ago she was admitted to the ER then direct admitted to the hospital for life saving surgery after they realized part of the placenta didn't pass (or wasn't removed) and she became very ill. She was never denied care.
She was lucky, some other woman are not so lucky and are denied proper care.

Let’s be clear: the treatment required for her medical condition was an abortion procedure. But because of current laws, she wasn't permitted to receive it. 1st visit, we told them all his symptoms but when he said he felt like he was having a heart attack they laughed and said he was having a panic attack and they disregarded all the other symptoms. “Meditate and drink lots of water”
2nd visit, 4 days later, they said he had strep throat. Told him to rest and drink lots of water.
The next day we went and got a copy of the tests they did. Strep throat was negative but other tests results (bloodwork) were alarming. My oldest son had to carry his little brother from the hospital med files office to the ER because of how sick he was. I cried and told them that my son was f’n dying.
He had sepsis. He could have died. The sepsis damaged his heart.

This is where you are all misunderstanding the complexity of the law related to women’s healthcare. Without Roe v Wade, all the subsequent bans now in place put constraints on all varieties of women’s health. It’s not just about abortions and it never was. This has impacted all aspects of women’s health and in states where doctors can be prosecuted.. like Texas, there isn’t a clear line drawn on when they can intervene and not end up in jail.

I actually don't know any fellow physicians or even medical students who don't think this law is harming women's health. And a lot of the students plan to leave Texas when they finish training. The ones that want to do OB? A lot of them won't even apply in Texas. The laws are gray, and waiting until every single person and jury would have no doubt in saying "the mother's life is in danger" is what leads to these tragedies. It's a fine balance, though: Malpractice vs breaking the law. Easier to leave the state and leave Texas women with no physicians.

Exactly. I work in Texas in labor and delivery if there was a pregnant woman in distress or clearly having a miscarriage or had signs of sepsis the doctor would do a D and C immediately. The notion that there are actually doctors out there who are saying "we need to have TWO ultrasounds to confirm a fetus is dead, because we're worried about the PROSECUTOR," that sounds to me like intentional sabotage.
I work in criminal defense, as a criminal defense attorney. No prosecutor would take that case. Look at how many cops have never even gotten charged in police-involved shootings. Prosecutors give tremendous latitude to people working within the confines of their profession. If you said this woman has life-threatening and untreated sepsis from the fetus, we need to abort, no prosecutor touches that case. If you say we took one ultrasound, it came back no heartbeat, we need to remove the fetus, no prosecutor touches this case. Most prosecutors I know are actually quite progressive, but even the most conservative prosecutors I know would never think to touch this case.
There is no world in which a prosecutor actually touches this case. If hospitals are, in protest to legislation they don't agree with, slow-walking giving women's health care, then they should be sued for all they are worth.

All through the comments section people are saying that this has nothing to do with abortion and it is malpractice. While this is correct, doctors will now be hesitant to do anything that may get them in jail and licenses taken away. These mistakes are going to continue to happen because doctors will want to be absolutely sure before they do interventions on a pregnant person. But like in this case by the time they are absolutely sure it might be too late. I am grateful I’m not capable of bearing children and I am grateful I didn’t pursue a career in ob/gyn like I wanted to in middle school before I took a career aptitude test. I would encourage anyone family planning to leave the state (or possibly country) and go elsewhere in case complications arise. Yes that would be expensive but wouldn’t it be worth it for you and possibly your child may survive. Or that you can at least still be here with your loved ones.

Ok guys when it comes to a womans life they need to have the procedure. My daughter had a miscarriage in August and after she found out the hospital sent her home. The hospital never warned her what can happen when a miscarriage happens. Im the one who told my daughter what could happen. She went to her OB the next week and she told her it can be very dangerous that she might need a dnc. We live in California

He met me there, I was admitted and had a Great Team of Drs and Nurses all did all they could to save my baby and me

The death is not tied to abortions, her death is tied to not pursuing pre-natal care. The hospital's would have contacted her OBGYN who would have had her case history and could have provided guidance. What happened is a shame, but pregnancy at that age requires pre-natal care. Someone dropped the ball, and it wasn't abortion.

Because abortion is illegal in Texas, no doctor would remove it because technically, even removing a dead baby is called an abortion, and the penalty here is 10 years in prison and stripping of the medical license. If she is never admitted as a patient, she can't even sue for malpractice because there is no doctor/patient relationship there. There is no way that in 2024 this many people are this ignorant about women's healthcare.
