  • This case started out as a normal EB-2 NIW case, because the client didn't think there was any way he qualified for an EB-1A. Initially, we didn't think so either. He seemed like an average accountant; he worked at a big company, and he wanted to move to the US to continue some very important work, but, he seemed like an ordinary accountant.
    As we put together his EB-2 NIW case, we saw a way to convert the EB-2 NIW to an EB-1A, allowing him to get a green card much earlier. He was a founding member or held governing roles of several distinguished associations, played a critical role in a distinguished actuary associations, published several articles, created an original contribution that was widely used in his field, and high salary. For the high salary criteria, we worked closely with the client to prove that his salary was higher compared to his peers. He reviewed the salaries of some of the top accountants and managers in his country and created compelling graphs using numbers and statistics, using his accountant background.
    His case was approved shortly thereafter, and he received his green card soon after that.
    The lesson here is to be flexible because the client may qualify for multiple green card categories!

    Thanks for the video. I am an accountant. Do you think it is better to go through eb1 and not eb2 niw ?

    hello, lately there have been rumors on the forums that there are refusals for talent visas (O, EB1, EB2NIW) at the embassy...that it is sent back to USCIS..then refused, ..people spend so much money and effort and then this surprise. ..do you have such cases? what reasons could there be?

      That’s the problem. If uscis is approving them why are consulates or embassy denying it! That’s wrong!!!
