    I dated an attorney for 8 years. She only did lemon law for good, existing clients. Over those 8 years she had about 5 cases and they were ALL with Chrysler. I will never buy a Chrysler product - especially since they're part of Fiat which is notorious for crap cars. A few years later I bought a new Volvo S70. Had issues with the ABS system. For six months, every time I'd bring the car in to the dealer, I was told they couldn't duplicate the problem. Next time the dealer told me that "they all do it" - nice flip flop. I took it to Volvo corporate and some young punk told me he had the final say and his answer was essential screw off. I told him that he was wrong - a Superior Court Judge had THE final say. Hired a lemon lawyer and just before they were going to call our case in court Volvo settled. I got what I wanted and they paid my lawyer's fee. Never let a car company or dealer abuse you. Do a little research and hire a good lemon lawyer.

    That happened to me during employment arbitration, the arbitrator went way beyond the issues being arbitrated. Beyond corruption.

    Thank you for the video! I just bought a used vehicle and it broke down driving it! The dealership won’t help me out at all. Because of this video I reread my contract and was able to get out of the Arbitration Clause. Thank you 🙏

    I wish I had seen this a year ago. I couldn't find a lawyer for my case, simple enough. I filed arbitration. I have sat through 10 meetings, wasted so much time only for the arbitrator to yell at me, bark at me continuously. I'm not one to walk away from a good fight, but it's not fair how the corporation is able to get away with so much.

      I had a similar experience recently. I am VERY nervously waiting for the arbitrator’s final decision, although opposing attorney committed several illegalities during the process. The arbitrator was very easy on the corporation and their shady conduct. What happened to your case? Did you get a ruling? Can you share the results?

    I'm glad I saw this. I have been attempting to get arbitration between me and Amazon (the've broken our contract on multiple occasions and deprived me of lots of money). They have been ignoring me when I asked over and over for arbitration. I guess they want to go to court (and, BOY do I have a flood of evidence of their malfeasance). It may have been all for nothing if I'd gotten arbitration!

      @@Uniquebadahh They cancelled my contract due to a "mistake" on their part (admitted to by them in writing) and cost me over $1,000. They continually lease my vehicle for a specific and finite amount of time, but force me into unpaid "over block time" without reimbursing me for the extra time it took to finish the route (no other lease allows you to do that.) They have blatantly lied to me about the issue saying our contract says I should deliver till the time is up and then just give them all sorts of FREE LABOR by spending upwards of 1.5 hours at a time returning the package to the distribution station (even though our contract says that is PART of the total time of the lease (in other words, I am to have undeliverable packages back to the station by the time the lease is over), but they keep verbally and in writing saying that I am to deliver till the end of the lease and THEN return the packages without getting paid for the OVERTIME which THEY caused to happen with their lies.)
      They even lied to me about having a chart which says how much overtime a person is allowed. The chart doesn't exist.
      When they failed to give me arbitration on those four or five occasions (just refusing to return my emails) they gave me permission to take them to court. Sadly, no lawyer will reply to my requests for representation. I think they are all afraid of Amazon, but they will never know how well documented the contract breach is if no one will even reply to me so we can have a consultation. It's sick!

      @@illmatic323 They won't give you arbitration. They just stop replying to you as if you are supposed to somehow initiate arbitration on your own. It is INSANE!

    Our police and fire unions would deliberately refuse to end contract negotiations, strategically working after contract expiration-- and thereby winning sympathy from the public-- knowing that contract negotiations would have to go into arbitration. The arbitrators in Michigan at the time were notoriously biased in favor of police and fire unions and would give them essentially everything they wanted, local government and the taxpaying residents be damned. (I worked for a township at the time and knew the township administrators. Actually they were my bosses.)

    hey steve.Steve.. I bought a 2021 buick encore gx 5/27/21 went thru lemon law process and thru arbitration did a CASH N KEEP settlement $20,000 total $16,500 for me and $3,500 attorney fees spelled out that way. started 6/15/21 process 11/1/21 finished and had check in hand

    Funny thing with arbitration is that the arbitrators know that if they don't rule for the company that hired them consistently, the company will take their arbitration business to someone else who can.

    Hello, Steve,
    The situation: a contract was provided by the one signing party, hereinafter '1stP', which contains an arbitration clause. It allows litigation in the courts after arbitration, but requires the arbitration first. There are two signatories. 1stP initiates formal court proceedings alleging breach of contract without first calling for arbitration. Should the defendant; a. answer in court with a request for dismissal due to lack of required arbitration, b. Directly respond to 1stP, or their attorney, demanding the agreed to arbitration, c. Both a. & b., d. Other, if other, what?
    If a. If dismissed, is it possible to get a dismissal that prevents 1stP from pursuing the matter further as a penalty for breached contract in re. they arbitration clause?

    Binding arbitration agreements just make me seethe. I went to watch a tv show on the web site of one of the big 3 networks that they've been advertising. At the top there's some ridiculous "terms of service" link. I just knew there'd be arbitration in there. Viola, of course it's there. Agreeing to arbitrate just to watch a g*d*am TV show streaming. There was an opt out option web link. I filled it out just out of principle. Write your congressperson!

    Steve, do you think that arbitration is also a way of companies to avoid class action lawsuits ??? this recently back fired on Patreon when they were sued for violating their own terms and conditions and they demanded arbitration , the funny thing is that a bunch of people jumped on and it cost Patreon a ton of money to arbitrate all of the cases as they had to pay the fees......

    I don't understand how if an arbitrator has a contract to rule on a certain set of issues, and either goes beyond those issues or doesn't rule on all of them, how that can't be a breach of contract. Seems like a real easy way to get an arbitration thrown out and possibly sue for arbitration fees back.

    My lawyer has said I have an very strong case if we went to arbitration, but he's pretty busy (running for office) and I can tell he just doesn't want to deal with it. Would you recommend anyone arbitrate an AAA case on thier own behalf or would that be incredibly stupid?

      I’m about to do it. Get on Westlaw Precision and elect for a Virtual Hearing. Then research the case law to prepare and have your notes ready.

    Forced arbitration should be banned, since people believe that it always favors the businesses and not the customers. In today's society, there should be a law or bill to protect the consumers if they don't want to sign or agree to the MANDATORY Arbitration that the businesses FORCE the customers to sign before providing services or products. Arbitration Agreement should be an option to the customers instead of a forced agreement. If the customers choose to opt out and not agree to the arbitration agreement, the businesses CAN NOT refuse providing the services or products to the customers. Customers believe that Arbitration is an UNFAIR practice to resolve a dispute and should be banned, since arbitration is always in favor to the businesses and not the customers. Arbitration could lead the businesses to cheat and do more harms to the customers, and can get away with it. If arbitration has to be in the contract, make it as an option for the customers to opt out and not a requirement for providing services/products. Business dispute should be resolved under the court of laws and not based on the biased subjective opinions from the arbitration. Thanks.

    I'm confused. My understanding is their is a hierarchy of documents and the law sits at the top. Ie that you cannot sign away your entitlement in law. So if you were entitled to compensation in a court no one could remove your right to pursue that.
    Perhaps it's a national thing and I confess I'm out of my depth, but I also thought those kind of principles were usually common in countries with a shared ancestry of English common law. I am in Aust.

      You are allowed to enter contracts and you are allowed to negotiate with respect to your rights. Courts have allowed arbitration on the theory that you are simply doing those things.

      We are under the Crown. UCC contract law. We are creditors they turn you into debtors after you give the bank your number / signature securitize it in the form of a loan to pay back with interest. All debt is pre paid.
      They add it to their books as an asset or sell it off to another party.

    He said, she said. Verbal agreements are worth squat unless recorded. But most lawyers become dumb-mute when the RECORD button is about to be clicked/pressed.
    And that arbitrator who makes the rules as the hearing goes along. Uhhhhhh......Big business knows it and is the reason they put it in the fine prints. Good advice to be nitpicky removing binding arbitration clause in big item sales contract 🤏 Saves grief. Preventive measure.

    Hi Steve. Thanks for this video. Question. I have an arbitration going Against a Cell Phone Company. The company already cover the AAA fee of $2900. It am claiming $8000, I don't have a
    Lawyer, It the arbitration decide in the company favors do I have to pay the $2900 fees myself?. Thanks

      I think it depends on your contract and the jurisdictional laws, but you shouldn't be asked to pay if you aren't countersued for those fees. I would be proactive and plan to defend why you shouldn't be responsible for those fees but be careful not to open a door the opposition doesn't open first via the countersuit unless you believe that door would help your case, rather than bring in new, potentially immaterial claims.
