What makes a Judge angry during the summary judgment phase?

    Adding to summary judgement questions, I have been one of 90 some servers that have been waiting for a trail against the owner since Aug. 2022. It's a civil case led by the DOL "United States Department of Labor v. Mr. Cao's LLC et al",.
    It basically was that the owner was pocketing 25% of the tips that the servers were giving to Habachi chefs, an not paying enough for overtime. It started off with a normal routine, by Feb. '23 a settlement was being discussed...then it was put on a stay for 90 days...then another stay for 30-45 days, then the owner decided to fire all of his lawyers and represent himself(which I was told he could not do that regarding the lawyers representing his businesses, but he did anyway).
    After that, the owner just stopped communicating or cooperating, and finally the DOL filed a motion for a summary judgement. I was told he has 21 days to respond..it has been 11. My question is if a summary judgement is ruled, how quickly can the federal government aquire the amount owed vs a regular person trying to get settlement money?

    Why would an employers attorney keep canceling the PMK deposition in a sexual harassment case? It seems like they don’t want it to happen.

    Hi Vincent, please respond if you could. What if the defendent attorney confirms that she is not going to file a motion for summary judgment? What would be the consequences of a plaintiff filing a summary judgment. It should be noted that the case is a retaliation case and is very strong. However the defendent attorney is a new attorney and stated that she has no time to file a motion of summary judgment.

    What if Judge finds out that defense counsel retracted employee placement into cyber which ment they could have more easily accommodated plaintiff to work from home due to medical condition? This caused first civil suit eeoc claim uc claim now second civil suit. Will he be angry?

    there is court rules and procdures and the better you follow those rules and procedures the judges will be less upset. that is my general understanding.
    people who bad at lawyers don't follow many rules. and it's just too much, it will bother a judge who the knowledge levels of the legal stuff is worlds apart. now a lawyer clients go with the flow of legal stuff have same lingo same everything on page with judge and it is smooth i would imagine the judge would be less upset.

    i have a question. i know a room mate who was a lawyer, and he wanted to be my lawyer he also uses the room relationship as a form of coersion or undue influence to get more clients from his own roommates.
    with that said though he told me he files tons of 'fictitious' lawsuits with fake clients to abuse businesses who may not want to hire attorney's. he said he also swamps the courts with these fake lawsuits aswell. and he told me it works for him.
    should i be concerned about him? should i report him to the bar association? doesn't this count as fraud? he won't say it on text only in person. but he terrifies me, because if i go along with the things he asks me to do i feel like i could get into trouble, one time he asked me to lie about my address, and i don't think there is ever a time someone needs to lie about address, etc.

      Go to law school and in 2-6 years, maybe you can sue your roommate if he wrongs you after you become a lawyer too 😮

      @@ProSePlaintiff there is a complaint page on the bar association website. i am not going to go to law school im a trucker but i might fork over 7k dollars for a 1 year subscription to CEBonLAW website which is one of the subscriptions the law libraries use. but it will teach you to practition in nice ways.
      but i studied other areas, but i know mere basics of lawyer conduct what is violations and what isn't.
      to me from the surface asking someone partake in fake lawsuits is a crime violates a penal code and fraud codes in the civil codes section, etc.
      but there is like rules for lawyers im not well versed in that area yet.

      That’s crazy. lol He should have a hard time producing necessary evidence because you still have to show some evidence to get a favorable ruling in a summary judgment.

    What if the Judge only reads your MSJ and the Defendants response. Not your Reply- and rules only on those the two motions. Why wouldn't they read your reply? What can you do?
