    1. Abolish qualified immunity ASAP,
    2. Abolish civil asset forfeiture ASAP,
    3. Make it illegal for a cop to mute or turn off a cop body camera,
    4. Make it cheap, easy and fast for a citizen to obtain any and all records - not redacted when possible.
    5. Make all internal investigations subject to independent civilian oversight.
    6. Fast track civil rights lawsuits into months instead of years.
    7. Do not let a cop simply “retire” only to move to a different department.

      If they can run someone's ID and find that they got a warrant or something, it makes their job a heck of a lot easier and they can just drop all investigation and arrest the guy there, then throw whatever charges they want in, hoping that just because the person was wanted that will automatically convict them of any other charges. Then they can go back to watching netflix on their phones at a gas station.

      (Assuming the cops are *actually* investigating and aren't just warrant fishing)
      Contact information is used to confirm things like Alibis and to prove innocence (or guilt). If the police find out that a credit card with your name for example was at a gas station during the time that the crime happened elsewhere, then giving your information to the police proves you innocent.
      Conversely, if they were investigating a crime that happened at the gas station, then your ID just made things worse. If you actually committed the crime and you believe that your name would be incriminating, I suppose you could tell the police to arrest you and plead the 5th. They can find out who you are anyways in this scenario by doing things like facial recognition at the jail.

Also, the witness who identified him from a distance through a window while he was handcuffed in the back seat of a cop car, said he was wearing pants. The guy in the back of the cop car was wearing shorts. And then they went and solicited a trespass. Sue the crap out of them!

    There is that video of a law student in a dorm who refuses to show ID until the officers demand Id under threat of arrest. At that point he would show ID and would have a legal basis to sue them. I think thats a good thing for every American to learn, push to the point of threat of arrest and the surrender Id, later sue. Instead of repeating your rights but ending up in jail.

      I was pulled over a few mornings ago on my way home from work, and the cop started asking me where I was heading, where I was coming from, etc. When I told him that I don't answer questions, you'd have thought I just slapped him by the look on his face. 😂 He asked me why not, and I said that I'm not obligated to. He looked so confused. 😂 He walked back to his car, came back less than 2 minutes later, and let me go without even a warning. 🤣 Sometimes, standing on our rights works, even if it's only because the police don't know how to handle it. 🤣

    I work for a company that almost exclusively operates abroad; we have people all over the world, staying in hotels, months at a time. We spend millions on hotels every year. I've personally worked in 18 countries. Good to know how Hilton treats their guests.

      Soooo this is funny because I saw this same scenario actually happen from my second story window: two cars w/e they might have cars parked to each other or something.. third car alright this is bad as mine was the 10th car away. Called and watched the fuzz pull up by the 8th car which was surprisingly fast and boy did drama escalate beyond anything thought possible. Turns out he was an off duty something or other and was drunk as skunk and admitted to trying to get into cars to find clothing (it was in the low 20's F with snow on the ground and he was in shorts and flipflops) then a woman drives in and taps a squad car claiming she was looking for him. Both booked and stuffed. Then the officers come knocking on every door of second floor probably looking for us who called it in. It was 1am when first called!

    Loitering, Obstructing, Criminal Trespass. He was there as an invited guest, so he wasn't loitering. He wasn't told to leave, or given the opportunity to leave, so he wasn't criminally trespassing. He matched the description of the suspect, was in the vicinity, and was pointed out by someone as the person. There is ample court precedent that would give them reasonable suspicion to detain him. During that detention, refusing to identify is a crime in some places.
      If you want to assert your rights, you need to learn the law.

      well yes, when you are stopped for fitting the description of a suspect, if you are polite and reasonable and are able to dispel a cops suspicion they will generally let you go. but trying to hide your identity when you are legally required to ID and acting generally combative kinda increases the cops suspicion actually.

      Saw an old video today from a few years ago. Cop was grilling a man (who was helping his friend move) about his prior arrests. They try to show that you're a convicted felon in order to strengthen their probable cause in court. Judges lap that stuff up.

      It's based on legal standing. C- is the lowest you can get without violating rights and breaking laws. The officers did have reasonable suspicion, they even had an eye witness claim that was the right guy, so they had every right to get his ID. However they were hostile, rude, and even once realized it was the wrong guy continued to make the situation worse.

      Facts!!
      1. Accuser said that the guy removed his hoodie
      2. Guy removed his hoodie WAY afterwards while talking to tyrants
      3. 2nd witness confirms it WASN’T the guy as he was walking back from gas station
      4. The hotel woman claimed the guy wasn’t a guest there and didn’t belong there
      5. His boss confirmed he WAS a guest there and did belong there
      6. Witness claims guy was wearing pants
      7. Guy was actually wearing…. SHORTS
      accuser is far from being a credible witness, video should’ve been obtained even though there isn’t a requirement, simple common sense should’ve prevailed (I know that’s asking a lot of these tyrants) fact of the matter is that this was NOT the guy they were looking for, Hilton should be sued for unfair treatment of a guest as well as unfair trespass accusation, the city and the PD should be sued for wrongful arrest.
      The female officer should be fired
      The young black cop just needs a little retraining especially around John and Jane Doe 😂😂
      The other male cop needs to be shown the door with the female officer I would also suggest maybe getting his eyes tested.
      The female hotel employee should be at least disciplined and at most fired, because rather than let the cops investigate she pushed the narrative that he WAS with absolute certainty the guy they were looking for despite admitting that she only had the accusers vague description at the time.

    Everyone involved in this stop should be named in the lawsuit: the officers, the hotel clerk, and the old man who incorrectly identified him. No due diligence was taken to investigate. This could have been solved with CCTV within 5 minutes.

      He travels with work... probably a Hilton honors member. The clerk will be fired.. The manager is in trouble if it's a corporate hotel, and the owner, if it's a franchise.
      I'm not in the hotel business directly, but I've spent years staying in hotels over 300 days a year and, due to extended stays, know multiple managers as well as owners. I know corporate takes bs like this seriously.

    So let me get this straight
    - The guy proved AND his boss confirmed he was staying at the hotel so had a legit reason for being there
    - The guy said AND his boss confirmed that he had just gotten out of his boss's van in the car park, giving him a legit reason for being in the car park
    Investigation done - he's given them enough information to dispel suspicion.
    Plus they had no eyewitness of him actually pulling on door handles. You had hearsay information from a 3rd party.
    I really hope he sues both the police and the Hilton (because their employee aggravated the situation by saying he was the person pulling on door handles despite never actually seeing it)

    A person who was staying at a hotel was trespassed from the very hotel they just gave money to.
    And said person was also arrested for failing to ID when he wasn't legally required to identify himself.
    All because someone saw him "walking between cars" and mentioned it to a hotel worker who escalated it to the cops and, somehow it ended up like a game of 'Telephone' and came out the other end as him "walking through the cars flipping handles".
    This is completely F'd up, right? I'm not THAT high, am I?

      Am I the only one that listened to the parts where he said multiple times that based on the laws of the area he WAS required to identify himself? A lot of states have laws that require you to identify yourself if you have been believed to be involved in a crime, if that wasn't a thing actual criminals when asked if they did something wrong would just be like "Nah that wasn't me, trust me bro" 😂
      Now does that mean he should have been arrested? I don't know, I don't think so? but my opinion doesn't really matter unless I am the judge or on the jury.

      Those are from the same person except that "walking between cars" got changed to the very altered, very different "walking around trying to get into other people's cars".

      He mentions MULTIPLE times how the laws of the area REQUIRE possible suspects to identify themselves if they are believed to be involved in a crime, so yes, they do in fact have a reason or purpose of IDing him, they have the legal right to order him to identify himself and have the right to arrest him if he refuses, as mentioned multiple times in the video.
      And at no point in the video did they violate his 4th amendment right, the 4th amendment protects you against "unreasonable" searches and seizures, and because he fitted the description, in the place, and at the time of a reported crime it definitely would be reasonable to believe that he could be involved in it and could be temporarily detained, and as per law that he is required to identify himself if detained in relation to a crime, when he refused to identify himself, he broke said law.
      Did they need to actually arrest him for it? No, to me it seemed these officers (especially the lady) were upset about something or just pain power hungry that day and felt the need to be super pedantic about the law on that night when they could have just let him off with a warning or a scolding, but on the other foot all he had to do was identify himself when legally required to do so, both parties in this situation were wrong and both were acting like children when doing so.

Any legal eagle who ran an eye over this would see there is no probably cause in the first place. As for ID though a plate of reflecting glass at a distance pppprrrh not for a jury . Hay check with DA ask if all charges got dropped. May be that's why you can't find it out come.😊
