      The interesting thing is that it's really hard to actually win a defamation suit since you have to prove a bunch of things, like actual malice, etc. Her doubling down is really what torpedoed her chances and proves some of the things normally very hard to prove. This is why they send the Cease and Desist letter. That's usually enough, and if they don't stop, it helps prove actual malice.

      There's still evidence in a civil case, that's what discovery means. What she actually means is that she intended to try to use the discovery process to force Scofield to turn over a bunch of personal and possibly sensitive information for Gillard to dig through for something she can use to "prove" her involvement - where here "proof" means what it does whenever Trump says he has proof of the election being stolen.

      Technically her argument was just venue which means she thought that the case should have been brought where she is rather than in Idaho. It's still wrong and something a legitimate lawyer would have been able to tell her but it is an important distinction.

    THIS is a lady that actually deserves to be sued for defamation. This is the type of situation where you’d actually sue someone for defamation. Not if you’re butthurt that someone exposed you, but if they do something like this. So many people think you can just sue someone for defamation over negative things that they say about you, but it’s truly reserved for extreme situations like this.

      Defamation doesn’t have to be “extreme.” It’e one of the oldest lawsuits in history of American civilization. Most people migrated to America with nothing worth more than their good name. All they had was their good name and thus livelihood. When it’s defamed with no base the lawsuits were filed to save their livelihood.

      ​@@WoodlandTthere are rare instances of a person's speech landing them in jail. For example: yelling "fire" in a crowded theater when there is no fire CAN get you arrested. Same goes for making threats against a public figure (such as the president). Even if you don't mean it, you can still get into legal hot water for it.
      Not sure if there is a case for her being criminally liable for what she said, but given the hell she put her victim through in all this, I would certainly hope so.

    The worst part about this is that Ashley could have easily backed down and said something like “I made a miscalculation - it seems I was wrong and the real suspect has been apprehended. I apologise to Miss Schofield” and people would have just clowned on her and moved on. Instead, she doubled and tripled down on her BS claims for even more clout - turning Rebecca Schofield’s life upside down and for a year by doing so. Absolutely repulsive and reprehensible.       @@HulaHula667 It could take a long time but I think in most instances the the damages are automatically taken from the earnings of someone, and if they attempt to claim they can't pay it they can have their car and home etc seized.
      Giuliani and Alex Jones are finding that out the hard way right now. Doesn't matter if they try to claim bankruptcy, all their property and income for the foreseeable future can be either seized or garnished.

      @@ct5625 Giuliani and Jones had/have assets that can be seized/sold liquidated etc. wages and income of a considerable amount to garnish.
      Unfortunately, and I might be wrong on this because it was from early on in this whole mess that it was mentioned, it doesn’t appear that that the TT Psychic Fraud (I refuse to use her name and give her any exposure) spent any and all earnings from TT as quickly as possible, and no longer has a platform there to generate income which *is* a good thing, and didn’t have a job to garnish the wages of - or if she did it would be one that would mean she’d never be free of the debt.
      She represented herself and therefore had bare minimum costs of filing in court, which was why she was able to drag the proceedings out so long. One of the Legal Commentators discussed the chances of The Prof actually receiving her money on at least one occasion, but as I’ve followed this case from the beginning over multiple channels - @Madcatster, @EmilyDBaker & @RunkleoftheBailey being the main three and my personal favourites (along with @LegalEagle but he hasn’t discussed the case)- I couldn’t tell you when or who mentioned it. Sorry!

      I really like that show, but one of the episodes the protagonist is most unlikable is an early one where she is so angry and offended when her boss asks her to lie on the stand about how she got her tip since psychic visions aren't actually evidence so he had lied on the warrant request. She seemed so ridiculously delusional. Now it seems much more realistic.

      @@trinitybernhardt9944 I know! I HATED that episode! I really couldn't stand Alison after that. I like the show, especially the middle girl, she's so funny! But I could honestly do without Alison Dubois. Even as a teen watching the show, I couldn't stand her. And her visions. If you have visions and can talk to the dead, why are they always so wrong or she acts like they are so vague. It annoys me with "psychics" that they will say that they don't get clear visions and yet turn around and say that their deceased loved one says that they love you! Acting like they are talking directly to the dead. If you can talk directly to the dead, then why are their messages blurry or whatever? But yet you know EXACTLY what they say word for word? I'm horrible at explaining things so I hope you understand what I'm trying to say. That's also why I didn't like her character. I liked every character on the show BUT Alison Dubois. She even gets on my nerves how she would treat her husband. Oh, this is a PERFECT example! Alison is getting angry at Joe because in her dreams, she THINKS they are having an affair. Turns out, he wasn't. Don't remember what happened but I am pretty sure it was something innocent about work. It just looked bad in her visions. Either way, she accused Joe of sleeping around and getting upset about it when he never cheated on her.       @@Steve-YT383 Ghost Whisperer was so much better than Medium. At least until a certain point because then it's just too...cheesy. Which, I know it's a cheesy show to begin with but the first few seasons, it didn't seem so thick. One of the later episodes, a man gets dumped by his rich, doesn't know she's rich though, girlfriend, or he dumped her. The rich girlfriend has a "rich" fiancé, really he's broke and is only marrying her for her secret money that he found out about. Anyway, at the end when the two are about to leave for a trip overseas, when Melinda makes it on time to reveal that he's just using her for her money, she dumps her fiance. Then, her ex pops up out of nowhere, dirty, punches her now ex-fiance, says something cheesy to her. She asks how he got there and he admitted to selling his car for some extra money, forgot why he did that, and had to run across town over night in order to make it to her house right at that exact moment, traveling through the woods. It was just HIGHLY unbelievable and made me roll my eyes at how that just didn't make sense and just..too much!

    Reason the judge was so lenient throughout the case is because when someone represents themselves its very easy to appeal if it is thrown out for procedural reasons. The judge had every incentive to see the case completely through and not reprimand the psychic to make it look as fair as possible on record for when she does try and appeal the decision.
