- Dorie Iverson is one of more than 200 tenants living at James River Pointe scheduled to appear in court for eviction proceedings. There are reportedly 500 units at the complex.
It was an eviction moratorium not cancellation. The rent continued to accrue. It's unfortunate that a lot, if not most, tenants didn't understand that. One mistake she made was not sending the check certified mail with signature required upon receipt and return receipt requested.
It is just stupid to not pay your rent. I do not understand why she didn't pay her rent.
She didn't pay the rent because the check she was waiting on included her current and back rent. That's why they told her not to pay it. They stole the money because they were selling the property, that's really what happened.
@@teenahweenah2608 she probably was unable to due to losing her job or significant reduction in work as a result of COVID. Not everyone was working as normal. If she was able to pay her rent she most likely would have done so
@@MaseRhea that’s probably exactly what happened. That check was most likely cashed by the previous owners and not sent to the new company. She can find out if the check was cashed and by whom but that’s another process in and of itself

No pay no stay...PERIOD
NONE of those "rent relief" programs said you didn't have to pay the rent. The Feds specifically stated that all rent would be owed. The ONLY thing that happened was a delay in evictions, and sometimes tax money used for assistance. The moment the eviction moratorium was lifted, every dime of back rent was due. Folks spent the money and then couldn't pay the rent. Yes, there are limited times when properties are transitioning that there can be confusion. If the check was cashed, the agency that issued it can find out where it went. If it has not been deposited, it may not have been received.
Perhaps it was received but isnt being deposting yet for some reason. It was the old company ahe owed it to.

Excuse me. Did you listen. She filled out an application for rental relief. She was found to eligible. Claim #1: Her claim is she handed the check over and it was not RIGHTFULLY credited to her arrears account. Claim #2: The new landlord is being unsympathetic to her first claim and asking for the FULL amount of rent in arrears. Learn to critically respond to what is being shown to you - and stop showing your prejudge. No one cares what you feel people deserve, you obviously have some filter that murky when someone is asking for justice.
@@KayDejaVu Thats a common issue with debt collection, sending the payment just before getting notified that the account has been sent to a collector. The creditor has little reason to hurry to update the collector, and it's far worse if the debt has actually been sold, because paying the original creditor does nothing to reduce the debt since it is no longer theirs. Getting a refund in that case is often an act of futility.

I will share this information to anyone who comes to this comment section. One of the first things the military told me was if you have one copy of a document you have no copies. Always make a copy of any documentation when dealing with the landlord or anyone. always have a copy if they give you a check make a copy they give you an additional notice make a copy if there’s a piece of paper that needs to be signed make a copy and make a copy of the signatures and do not leave until you get copies these companies bank on you never having a paper trail. Keep every email print it do whatever you have to do.

I was working and staying in an extended stay during covid. I wasn't eligible for any rent relief because it did not apply to hotels. It seemed to me that the folks in Apts were getting a helluva deal with the govmt paying their rent. Many were still working. All they had to do was stack their paper.
Not the government, the taxpayers like me who own a home and had pay my bills or they would take my house. These fake renters got my money
Everything you said here is 100% correct. A lot of people came up during Covid. The state of VA heart was in the right place. Although in some cases the payments were not timely to the landlords. I don't understand why the state sent the money to the tenant in this case?
I'm disabled n I didn't get any help from the governments but my priorities to my family is
1...mortgage payments
2...car payments n insurance
3...water n electric bills
4...phones
5...my wife make sure 1-4 are paid every month.
Interesting that she didn't mention why she wasn't able to pay her rent. I don't feel badly for anyone who is being evicted now for not paying their rent when they could have. It seems that there was a pretty small percentage of renters that were in that category. I mean, most people were either still working or collecting juicy beefed up unemployment benefits. No excuse
Sign over the check… oh no.. No ma’am. She should have deposited the check in her account and then made a payment through her account to the apartments, that way she has her bank records and transaction of proof of payment.

Either she was given those instructions by her former landlord because she doesn't have a bank account of her own, or she spent her rent relief check (thinking she wouldn't have to pay it) and is lying.
I lived in an apartment complex 20 years they changed management 5-6 times. I went to the office every month handed the office woman my rent check & I left with my receipt.
My next rental was a private landlord who I had to mail my check, he cashed them right away & they were in my bank statements.
I don't understand what went on here?
in California, banks do not take 3rd party sign-over checks
What did people do with the .....stimulus money for children and adults , unemployment benefits, child tax credit money, child support, pay checks, and income tax refunds?....
Not everyone got all of that money..I was in a similar situation due to being in the hospital with kidney failure as a result of COVID. I DID receive stimulus checks and a tax refund but it was not enough to cover the 5 months of back rent and all my other bills that accumulated during that time

Child tax credit only applies to those with kids. Same with child support. So just unemployment or pay checks would be the most accurate statement.
So she supposedly signed over a $4,000 check to the land lords (proof?), but regardless she said she owed $9,000 and wonders why she had eviction filing against her? Even if she DID sign over the check and they DIDN'T lose it.... $9,000 - $4,000 = $5,000 is still owed. I don't see what's hard to understand about that.
They don’t want to understand. They think they are entitled to live rent free. Those kind of people don’t like hard work or honest living. My tenants each ow us $21000. Total is $42000. We bought a small property for our retirement. But now I Khoikhoi we are going to be homeless. I am 65 years old with a lot of health problem. Kidney transplant, bone marrow cancer, diabetes, blood pressure, thyroid and other. My chimo therapy medication cost me every month co-pay is $2500. It’s only one medication. My husband is 78 year old with hear problem. This apartment was our life saver but now we have no income to cover our bills even we both have madicar and secondary insurance. So I don’t fell sorry if those thugs end up on the streets.

Dorie, please call the agency you received the check from and ask if the funds have cleared their account. Their Accounts Payable, Cash Reconciling department can easily find this information.
IF the check cleared find out who endorsed it and get a digital copy of front and back.
Send the digital copy to the new management company’s lawyer and cc the new management company’s Accounting department, Attention Controller.
Ask your onsite manager to see your resident ledger in one week to ensure they made the correction.
This smells of potential f-r-a-u-d or incompetence at the handover.
You shouldn’t have to be fighting this.
I tried doing this when I had to prove my bank cashed my mortgage payments, I submitted the checks with the bank's endorsements on the back of the checks showing they cashed the payments....the court sided with the bank. I lost my house because the court felt it wasn't enough proof. If the other person has it on paperwork showing no payment made courts WILL side with that instead of going through taking it to trial. I lost my home of 18 years because of this.

After they sold the house without us knowing, and after we received the stimulus during lockdown, I was able to afford to hire an attorney that was referred to me by a friend. The case against the bank for wrongful foreclosure they refused to go to trial and settled out of court with us. The main case where they misapplied our mortgage payments we were never able to get them on and it still bothers me very much, I have a hard time moving on without being angry every single day. I've considered still trying to pursue it but don't know how successful I'd be at this point.
A lost mortgage check happened to me too before the bubble madness. Fortunately they cashed it but forgot to credit my account. My bank sent proof to the mortgage company.

So many people stopped paying rent when they were getting lots of PPP loans. Now I feel sorry for people who did have no income.

That was my first thought, she said she signed it over to them, which proves it was made out to the renter. Its go to be awful temping to not cash a 9000 check for people with no money. Now eviction and desperation sets in, and BS stories start.

I get widows benefits.During COVID l still paid my rent.l know people who didn't and now are living in a shelter.Not saying everyone did this but l knew this was going to be a nightmare
It really sucks so many people took advantage of the eviction moratorium and purposely didn’t pay their rent..this made it difficult for people who had legitimate issues to receive help. I suffered from liver and kidney failure along with many other complications as a result of COVID and spent many months in the hospital. When I got out I could not get rental assistance or anyone to help me pay my back rent and was ultimately evicted when the moratorium was lifted. I was able to get another apartment with the tax refund and stimulus check but the previous apartment sent the back rent to collections and now I’m stuck with a $8,000 balance on my credit.
People thought of the moratorium as rent cancellation...no, rent still accrues. They just thought FREE FREE FREE. What was their plan as oneway they are going to have to come up with some rent money? It's almost 2023, was this a free ride for life? I'm 68 years old, I worked all through Covid.
This is why it is absolutely essential to build up an emergency fund, such as cutting out all non essentials and/or working another job, in case this happens.

Priority one should be to pay rent and housing costs. Why do they think they don't have to pay rent? The landlord is operating a business and is not a parent to bail them out.
@@Lucienne-zz1sw I worked in the ER for decades. Patients came in with avoidable illnesses and once sick THEN wonder what to do. A medical repair is never as good as had it never happened. A scar is never as strong as the original healthy skin, an illness knocked the whole body back a few steps. Some just don't realize that there are consequences for their actions, good or bad. Every decision I make I first think of the outcome. It's the way I was trained. So many get themselves with their backs against the wall THEN wonder what to do.

Anyone who gets rent relief should have the stipulation the funds would come out of their tax returns until fully paid off. I bet this would have stopped lots of these ‘I don’t have to pay rent attitudes’.

this is the same tactic that the banks did to home owners after the crash. they pulled this same BS. They'd never cash checks & then claim they never received the check & take the homeowner's to court. It happened to me, same exact thing that this woman was saying is what my bank did. What you have to do is send any & all checks "certified", they must be sent certified or else you're SOL because all the other person has to do is say they never received it even if they did. Some places were holding onto the checks then cashing them late & claiming a late pymnt. It's all a game, I literally had my house stolen because of games like this. Paid my mortgage every single month never missed a pymnt never late, bank refused the next payment & then claimed they never received a paymnt from a few months earlier & took me to court. It was literally fraud and the court did nothing about it.
Why not just make online payments, and I'm sure the bank called you each and every day of the month when you were late. I know my bank calls me everyday after the 1st. You would've had to have blatantly ignored the letters emails and phone calls to lose the home. Wtf

The LAST thing landlords and managers want to do is to evict tenants. Evictions cost money and create an empty rental that needs cleaning, renovation and make ready. It is so easy. If you don't want to be evicted pay your rent on time and treat the property and neighbors with decency. No landlord or manager is ever going to evict a decent tenant that pays rent.
Part of living in a rented apartment, requires paying the landlord rent. You do not pay rent, you get evicted. What part do not understand?

She’s worried she faces eviction? Why? She didn’t pay? She waited 2 months? Did she keep calling? Did she try getting another check? Find out if it’s been cashed? These are easy questions to answer. But she sits there indignant? Why hasn’t she found any of this out to insure she doesn’t get evicted? So what she’s saying is none of those people asks any of those questions? There was NO reason for people to not pay rent during the pandemic. People on SSI and SSD had no change to their income, and people who lost their jobs were making more on unemployment than they made while they were working!

Yes, I know someone that had a similar situation with another local complex. The complex suddenly changed management companies after the moratorium was lifted. The new management raised rents and started evictions. Luckily, my person had documentation to support their claim.
I just said the same thing. I've seen apts do super wicked stuff to people.

Don't any of these tenants try to get jobs instead of relying on government assistance which is other taxpayers being responsible to pay their rents! This ends up hurting honest people who work and paid their rent because it has resulted in their rents being increased. Why doesn't someone do a story about those tenants? It's really annoying to see this constant whining from people who expect others to support them!

Did she find out if the check had been cashed? 🤔 The check issue should be fairly easy to resolve. If it can be verified that the check was cashed then she can present that information in front of the court. If the check has not been cashed then she should be able to contact someone from the rent relief program and request that another check be cut and upon them verifying that the previous check had not in fact been cashed they should not have an issue will giving her another check. It is not like they would be giving her new money, the amount of the check was funds that were already specifically allocated for her. I really hope that she did not cash the check and use the money and now wants to say that it just magically got lost because it would be extremely easy for that to be figured out.
Didn't these people know this wasn't going to last and that they would have to pay..I wouldn't have signed the check over I would saved it until I went to court...if you could have paid something every month maybe things would have been different landlords have rights too.

At the beginning of the pandemic I thought that laws preventing people from being evicted was guaranteeing evictions down the road because the accumulated unpaid rents - sometimes totally 5-10 thousand dollars - would be more than could ever be paid. If the government wanted to help they should have paid rents themselves.

I don’t think some of these people understood how the Rent Relief work it paid for the months that wasn’t paid. Therefore current rent was still piling up so if the tenants wasn’t paying current rent that’s due they’re still getting behind so the eviction come into play for the current months. I think some of these people felt like they didn’t want to pay because during Covid landlords couldn’t evict at that time but what they didn’t understand is all those months of not paying add up now Landlords can evict them it’s thousands of dollars due anywhere from 10 to 15 thousand dollars how can they pay that they can’t. They thought it was a free ran not knowing this will end and they will owe thousands of dollars.

This is going on all over this country with big apartment owners even the ones getting HUD with income based properties that should only charge 30% are and have been charging tenants 50 to 60% illegally and local HUD offices go along and HUD OIG ignore this going on Georgia, Texas and Maryland! These places also got millions in PPP loans forgiveness!

This is why people need to be self sufficient and work and pay your own way. The government is not your friend. Eventually all the free living will come to an end. When there are more people living off of social prograns than those who work and pay for those programs through their taxes, the entire welfare sustem is going to implode.
Why are so many people on generational and lifetime social programs? Why are people so entitled to feel that others must support them?
So many landlords got screwed during the moratorium. So now they have to make up for those thousands and thousands of lost dollars. Many will never take vouchers again. Rents will continue skyrocketing. Many landlords lost their properties since they could not afford to house people for free for years. So that leaves fewer rentals available. Which increases rent. Those who have evictions are having no luck because no one wants to take a risk of a bad tenant. Many people continued to work but bought cars and boats instead of paying rent

The landlord's are always get their money 💵. It's a contract and Judicially enforced. All of this, is going to force people to make better decisions about their fiscal situations.
I advise all tenets to seek legal services across America 🇺🇸 before the property management or landlord pursue eviction. There are free legal services and consultations online,phone and in law firms.
Nothing is for free. People need to be responsible for their rent.
But the homeowner you’re supposed to pay has to pay for a lawyer.
Cancel the check or have a trace put on who cashed the check.

If I were the new owners or property management group, I would wipe all of the slates clean and allow my residents to sign new leases and move forward. It’s not the new company’s debt and this can prevent their solid residents from being homeless. Besides, the new owners will be able to get sizeable tax credits that will give them a great start in solid relationships with the residents and keep people from being homeless. The pandemic is not over. There are new variants being discovered right along with other viruses. Have those residents sign new leases and addendums and move forward. I pray the state and federal governments don’t allow those evictions to proceed. However, tenants must be in compliance and be responsible in paying their obligations moving forward.

I’m saying, they could give the residents a chance to make it right with reasonable timeframe. It doesn’t have to pertain to all residents either. Select the residents that are deserving of this privilege not those that make trouble and commit violations of their lease. Landlords have a right to not renew leases of bad tenants who violate their lease terms. There are ways that the owners, landlords and tenants can all win with the right compromises.

This woman clearly said in the video, that she thought being in the program excluded her from the obligation to pay her rent. Well, far too many had that same attitude. Many were still working, Receiving stimulus money, PPP, and EID loans, and just choosing not to pay while trying to get free money. Now, it's time to pay or leave.
Landlords, and property management companies are in business to make money, not prevent homelessness. That's what shelters are for, and many in shelters thought exactly as many of the moratorium violators. Right is right, and wrong is wrong.
Far too many mom-and-pop landlords lost their properties, had to sell them, and/or suffered financial hardships because of the moratorium issues. And it wasn't right.
Whatever you sow, you'll reap. And now rents are rising at unprecedented levels because so many landlords and management companies lost enormous amounts of money.
Even the Bible says, If you owe a man, you pay him. And far too many chose to spend their income frivolously thinking they were getting over. Well, it always comes back.

If you don't have money to pay your rent owed, then you will be out of luck. You can blame the government for its inability to pay the landlords in a timely manner.

Read the small print ppl..the handwriting on the wall landlords are livid now and of course they're mass evictions taking place. It's happening with section 8 as well as alot of landlords no longer accept it. It's pressure on the gov from the landlords to get an incentive for accepting section 8.

There not really trying to help these people, the new owners want them OUT so they can renovate and charge $1800 a month like other cities. Bringing all your documents won’t change anything. Take your rent relief check and find a new place to stay.

The government confused millions of tenants, making them think they all could live rent-free for 3 years. Many are currently homeless with a credit score in shambles and an eviction notice. Tragic!
It's so sad that the misinformation (or was it really misreading/misunderstanding of information???) These stories were all over the news that rent would be expected thru the pandemic and that if one was unable to pay during the pandemic, the conclusion was that it was a courtesy payment delay, and when pandemic was over, you would then pay backrent as well as current rent. That is not a complicated concept. There was no mention of penalties..... There was no mention of rent-FREE, it was rent-DELAYED, interest-FREE.
