Bartender Arrested for DWI After Leaving The Cornerstone

- On December 10, 2022 around 1:59 AM, Officer Scott Gaston with the Montvale Police Department observed a 2016 Mercedes-Benz swerving across the double yellow line while driving northbound on N Kinderkamack Road. As a result of these driving patterns, he activated his emergency lights to initiate a traffic stop in front of 133 N Kinderkamack Road, just before the New York state line. He made contact with the driver, who was identified as Erika, and he asked her where she was coming from.
Erika told Officer Gaston that she was headed her home in New York and that she was coming from The Cornerstone, a popular bar in Hillsdale, New Jersey. Erika told the officer that she consumed 1 beer earlier that evening before operating a motor vehicle, but she would later admit to probably consuming 2 beers. She also stated that she worked as a bartender at a different restaurant in Westwood, New Jersey before heading over to The Cornerstone. Based on his suspicion of impairment, Officer Gaston waited for Officer DiLauri to arrive on scene before asking her to exit the vehicle and perform field sobriety exercises.
To initially assess her level of impairment, he asked Erika to recite the alphabet from “G” to “S,” but she failed to follow his instructions and continued past the letter “S.” Erika was then asked to count backwards from 89 to 69, but Erika continued counting past 69 until Officer Gaston stopped her at 63.
Officer DiLauri then administered the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test, which was administered by Officer Gaston. During the Walk and Turn test, Erika did not touch heel-to-toe on each step and turned improperly. The final exercise was the One Leg Stand test, and Erika failed to raise her foot in the proper fashion while not counting as instructed.
Based on her erratic driving, the odor of alcohol, her admission to drinking, and her inability to adequately perform the field sobriety exercises, Erika was placed under arrest for driving while intoxicated. Her vehicle was searched incident to arrest and she was transported to the Montvale Police Department for further processing. Officer Maleszewski arrived on scene and stayed with the vehicle until it was towed for a mandatory 12-hour impound as required by John’s Law.
At the Montvale Police Department, Erika was searched in more detail by Officer Pane with the River Vale Police Department. Officer Gaston read her the Standard Statement for Motor Vehicle Operators, and she agreed to submit breath samples. Officer DiLauri operated the machine, and her Alcotest results indicated a BAC of 0.13%, which was more than the limit of 0.08%.
After she was processed, Erika was released to a sober adult pending her court appearance in the Pascack Joing Municipal Court after she signed the Potential Liability Warning form on her behalf. Officer Gaston issued her the following summonses: Operating under the influence, careless driving, traffic on marked lanes, and failure to possess driver insurance card
Court records indicate that on April 19, 2023, Erika pleaded guilty to operating under the influence and she was fined a total of $640. She was also required to use an ignition interlock device for 3 months and spend 12 hours at an intoxicated driver resource center. The other 3 citations were dismissed as part of the plea agreement.

I cannot stand people who drink and drive, but I will say she's a lot more tolerable than most drunks in these body cam videos. She wasn't rude or belligerent, didnt act like a fool, and was respectful towards them... So I'll give her that, but other than that, dont be a dumb ass and drive drunk.

One of my pet peeves is when someone says "I'll be completely honest with you".
I noticed I say "honestly, blah blah blah." I use it as a figure of speech, rather than a qualifying statement. But, yes, most of the time when people say that, you won't be getting the truth.
I hate that too. In these scenarios it means they're lying. I used to say that too all the time, usually when I had to tell someone something that I didn't want to have to tell them, for example at work when I get a question that I don't have the answer to, "honestly, Im not sure what the answer is to that". I'm a SME at my job, and my job is to know the answer to everything, so it's not good if I don't have an answer. But honestly, after watching these videos, I can't say "honestly" anymore.

Good for you. Alcohol doesn't really do any good for anyone. It might feel good for a few hours but that's it and the side effects aren't worth it. There are other things that make you feel just as good with no side effects, like a cup of coffee, or whatever your comfort food is.
And we have the famous revealing "I can't do this sober" line.

I just turned 40. My mother was a baby bummer and was probably the least understanding person I've ever known. I got arrested a few times and sat in jail overnight because I knew better than to even bother calling my mom.

It baffles me why women like to get them so long and fake looking. I could understand if they just wanted to give a slight extension and fill their eyelashes out where it still looks mostly natural, but these tarantula leg looking ones are horrible 😂 Sometimes I feel a little irritated with myself for not learning to do much with makeup when I'm wanting to dress up nicely, but most of the time I feel just fine with doing what I was taught in the 90's: just enough to highlight your features that are already there.

But those heavy lashes, to me were always for showgirls and actresses. I was always satisfied with just mascara but I tried the natural lashes once recently and they were pretty nice.

I think they call it an "inventory" for towing purposes. They're not really searching for more cause to file charges.

Find me a single incident where a woman gets anything more than a *MINOR* fine for driving drunk in NJ. A single one. It doesn't even have to be her first DUI. Hell, it doesn't even have to be her first DUI that WEEK. Seriously, I've seen videos on this channel of women getting multiple DUIs in the same week, and still not seeing any real punishment.

Cops need to STOP brushing this off. It wasn’t a mistake, it is a CHOICE. Until the consequences are stiffer, people are going to assume the risk.
In NJ it's just a traffic violation. Most states don't take it seriously but until the laws change, that's the way it is.

The field sobriety test is RIDICULOUS...Just do a breath test..I can't walk the line or stand on 1 ft sober.
I asked a lawyer about that exact thing. The roadside breath tests are not admissible in court, only the station breath test can be used as evidence. They need to establish a reason to take her in for the actual admissible breath test and the field sobriety tests can capture that on film .
So now a guilty plea of driving under the influence doesn’t come with a loss of license? Goes straight to an interlock device…

I get that the officers are both green as grass...also it's not cool to drink and drive.. HOWEVER, The main officer instructing her during the tests SUCKS at explaining the tests and just talking in general. "When I say to, you're going to choose a leg of your , of your choosing...um..umm". He was sluring his words more than her😂. "face the car real quick, you'll be under arrest for dwi, alright?". Then he keeps breathing all heavy randomly. He's more nervous than her! 😂😂. Just greener than green itself. I don't think his did a good job at all. He wasn't thorough and had no clue what he was doing. Luckily she was pretty cooperative for the most part.

If people would do this exercise the exact way that the officer demonstrates, it can be done by anyone. However, if you don't do it exactly like the officer demonstrates, it is very difficult. Buttttt, people just can't seem to follow directions!! STUPID!!

It's incredible how many professional bartenders end up in this situation. They have to know when to stop pouring for others - the business insurance liquor liability policy demands it. How can they be so idiotic about their own consumption? Serious ask because I'm not a fan of bars and don't hang out in them - don't know the culture: Can someone explain to me how a bartender, who is working and being paid to be a professional, gets drunk at work? Do they drink with patrons? What's the customary behavior?

I need to see her driving because she seems sober at first when he approaches her, but asl "I only had x drinks" is usually a lie. Because I don't drink and drive but sometimes I'm irresponsible. If my baby is crying the back I try and calm him down. Or I'll look at my phone but I think I do better than that with reaching back to the baby.

Why do these people always keep saying "I'm sorry" to the cop whenever they get pulled over. The cop don't give a single f**k about apologies. Just be quiet and the follow the commands and accept that you are about to get a DUI. That's it. The family of the other driver you potentially will kill from driving under the influence certainly ain't gonna care about your apologies either.
