Tragic cases like this is why the decision to allow filming in UK courts is an important step. The horrific description of the events of his life and the build up is so much more powerful than reading a couple of paragraphs in the paper.
I am against the televised trials concept, on two bases, one it is the slow americanisation of our legal system and secondly, if there is a mistrial or appeal, then the jury may have watched the original trial and as a consequence any retrial jury may be prejudiced, rather open minded when listening to the evidence. I am not against harder sentences, in fact I would bring back hard labour, remove tv's from prisons and issue just a basic, but healthy diet, in general made prisons a proper fearful punishment.
Yea punish this guy more... that's what he needs Not like he was failed by everyone and everything. Harsher punishments mean nothing to broken people. Fix the fucking people not the punishments
The idea that juries aren't biased is completely naive. Everything should be televised from the very start, it keeps judges more accountable, it would give future juries more information, even in the case of a retrial the jury should know the facts of the first trial, artificially withholding information is ignorance.
It may not seem it, but this is genuinely historic for Britain, being the first ever televised glimpse into the UK courts. It gives an insight into how it works.
Can i just say that it is fundamentally untrue that a "lack of empathy" is rooted in Autism Spectrum Disorders. On the contrary those with Autism Spectrum Disorders struggle with "Affective Empathy" not "Cognitive Empathy". This is the opposite of what you might see in a psychopath or someone with Narcissistic Personality Disorder. Can i assure anyone who is friends with someone who has an Autism Spectrum Disorder, that these people do, in large, experience empathy in the most authentic ways. They simply struggle to express it. This is partly why, for example, Autism Spectrum Disorder is a recognised cognitive disability where as Personality Disorder and Psycopathy is developmental. The latter are developmental because they develop in response to Trauma, and the internal cognitive proccesses for coping with said Trauma. When the trauma occurs in a developmental age like childhood for example, then without appropriate therapy these coping mechanisms develop into Personality Disorder. Personality Disorder, for the sake of brevity can be referred to as a spectrum of clinical narcissism. Even Psychopaths are more appropriately categorized as Anti-social Personality Disorder or some more complex combination of Anti-social and Narcissistic Personality Disorders. These are the individuals that can express empathy, but really struggle with processing empathy cognitively. This is not typical of someone with an Autism Spectrum Disorder, but rather more likely a developmental problem arising in response to his own Childhood Trauma. In summary, it is far more likely that Ben Oliver's "lack of empathy" was related to developmental concerns surrounding his childhood trauma, as opposed to his Autism Spectrum Disorder/Learning Disability. It's not as if ASDs and Developmental Trauma cant co-exist. That is a really important distinction to make for anyone who supports Autism Awareness, which the judge here makes a really poor job of advocating for. Her utterances justify that people with Autism are psychopaths, or at least have the potential to be. It's far more reasonable to assume that his childhood experiences contributed to his desensitivity to abuse and violence. Therefore developmental trauma is far more clinically aligned with the actions of Ben Oliver than his Autism is per se. It's absolutely reprihensible that a judge would justify something so unjustly without any consideration to the consequences and backlash this can cause to the Autistic community. I repeat, it is absolutley not true that Autism Spectrum Disorders contribute to a lack of empathy. She should do some more research ...SHAME ON HER!!!
@SassySam There's no justification for making such ill-informed statements about the Autism Community. The irony that such an injustice can come from a judge is deplorable. As a man with an Autism Spectrum Disorder i can empathize with those who lack understanding and awareness. However, it's unforgivable to make such statements in front of such a large audience publicly. Some people will be inclined to trust the word of a Judge as gospel, and to say what she did with such confidence, as though there was no ambiguity in her words. That's defamation of the highest order for everyone with an ASD! Whats more, is the frustration i feel knowing that people do view us this way as if ASD's are synonomous with such behaviour. Ironically, people who hold those views lack empathy for Autistic people, and you genuinely have to lack empathy to believe that Autistic people are this way.
Made up coping mechanisms from yourself. They are dangerous, they are known to be unempathetic the same as a child is, this can be viewed in a functional MRI and just generally in their actions. They should all be put down at diagnosis for the good of society then events such as described wouldn't occur as often.
@@esmeecampbell7396 Who are you talking about? Asperger's individuals do not have any issues with processing empathy cognitively. They struggle to express it. You'd be correct if you were referring to those with Psycopathy, Sociopathy and NPD, but i disagree that they should be put down. CBT can rewire neural pathways that are impairing cognitive empathy. Miracles do happen, even though Narcissism seems to spread like a cancer i do believe that people can be spared from it. I think the platforms of propoganda that exist today work in total opposition to peoples Mental Health and Wellbeing. This is a major contributing variable to the prevalence of widespread narcissism. They don't bring much good to the workforce and to mainstream communities, and i don't doubt that isolating them from authentic people and the public services etc is absolutley neccessary. However, i do think you're bordering on Hitler mentality by implying genocide as a solution.

Wow this is powerful stuff, this was a young man let down by a broken system of social, medical and mental health care. With the right interventions at the right time I could have been different. After hearing the story of this young man’s life he simply didn’t stand a chance.
This man has gone through hell in life by the sound of it, on top of that he has also had to put up with coping with all of this through his autistic situation aswell. However a crime such as this, is a blatant act of inhumanity of which the crime deserved the time. In my opinion, i must lay a lot of the blame on the system, those in a profession of being able to do more to help this man, but failed in their duties. Hearing what was told by the judge, it is very sad that someone has to go through a life of cruel torment as this man has. I hope he can now get the help required in his incarcerated time and be able to be rid of his torment later in his life.
The boy didn't stand a chance from a young age... Very sad . Just goes to show what impact others have on you at a young age ... Distressing to hear this. Awful on both parts. But I agree he's a destroyed soul and what could he do next!!! 😢 His dear nan was probably the only love he had.
A “life sentence” of ten years; routinely only half of prison terms ever get served in England, getting paroled out at the half-way mark is basically automatic.
I think if a child has this sort of upbringing and in adulthood they seek vengeance against their abuser . This should go unpunished. Most abusers seem to forget that children grow in into adults normally bigger and stronger than themselves.
Bruce, I was just thinking that. Copying America as per usual. I just read the book: America The Farewell Tour. Great read and all predictions coming true since it was written in 2018. Same thing happening here.
This should not be streamed or recorded. And the outcome from the judge can hardly been seen as justice. This just shows a failed justice system. The system destroyed a person and then when tragedy occurs in accordance with the programming the system has given him they throw them away. This tragedy was manufactured. Britain should feel shocked on so many levels and question the system that made him, the outcome, and system that punishes in such an inhumane way based on broad guidelines that will never be able to address the complexities of this case. A sad day all round. Get him the help he needs in a place that can bring him peace - and the family can heal. Is the system so blind to increase his torment, it referred to the damage jail did in the summary given - the system is ensuring he will likely never come out and that continued torment is ok!?! I hope people question what justice is wrong in this case. The public needs to be safe - but so does this man.
A failed justice system indeed, he should have been locked up for good long ago. Plenty of people have been through what he did, not all of them go on to pedophiles and murderers, so he has no excuse.
Sentencing like this comes after hours upon hours of arguments and complex analysis of very complicated facts. There are a huge range of factors, scales, and variables to take into account and balance against guidelines indicating length and intensity of the sentence, and complicated by mitigating/aggravating factors and statutes like the new sentencing act which forces her to give a life sentence where it isn't really appropriate. Balancing all of that is complicated, so she sets out and delivers clearly the entire range of facts and considerations, so that there can be no doubt or confusion about why that specific sentence has been delivered and how it was calculated as the fairest and most just decision
Shocking. Just shows how the system has failed another child. The mother and uncle should face charges, they basically planted the seed knowing full well what would happen. What a traumatic life. You can't help, but empathise.
I wander how many generations back this abuse is going. Looks like she herself was abused. Is terrifying case. I feel like he should be put to mental health facility rather than in prison. He would abused again and if he ever come out he will be totally broken human.
It could be a good thing, at least more people will be aware of the ridiculous light sentences they give criminals, and how they favour the criminal rather than the victim,,
This man is technically a criminal but he's been failed miserably by all who crossed his path . This tormented soul needs help and guidance surely , not prison
Horrific tragedy. I hope that Ben Oliver finds peace and the love and support, beyond that provided by his nan, that he always deserved in his life. He has been let down at every single stage of his life. This sentencing feels so morally wrong.
this is an indictment of the system, of which that 'judge' is a part of. at no point did she mention what accountability those involved will face. granted it doesn't absolve this ben from what he did, but symmetry and consistency isn't something the courts are known for. this ben was failed at birth, and rubbished by the gvt and his grandparents. the fact the judge doesn't even take that into account sickens me more. this is a disaster, and that judge should be canned from employment and banned from any future employment in the judiciary system. the swamp really needs draining.
Umm, she did take his upbringing into account at 15:00. She said his upbringing meant it balanced out the aggravating factors in the case. 16:15 ‘In my view, the mitigating factors balance out the aggravating factors, so that I do not add to the notional term of 24 years’.

This is what happens when you "roll back the state". This person should have been taken away from his parents at birth. You should have to pass an exam to be a parent, fail the examination, state takes your child away. More state intervention to stop this kind of upbringing.
The number of children in care homes who are subject to abuse is horrific. They are often prostituted, their carers note they go missing for days, appear to be addicted and in some cases with obvious signs of abuse, both sexual and physical but little if anything is ever done about it. Until the care system is fit for purpose it is not always in the best interests of the child to place them there, there are many who are scarred for life when they leave. The entire system failed this family, not just Ben. Aware of his mental health issues he was doubtless just added to the extended waiting list.

They are giving him a prison sentence because his crime is not directly linked to his mental illness. An example of a crime being linked to someone's mental illness is someone who is psychotic, thinks their neighbours are trying to kill them by poisoning their water, no one believes them so they take matters in their own hands and assault the neighbour. There is no denying however that Ben suffers from mental illness and if he deteriorates in prison, he will be admitted to the hospital wing. If there are not able to give him the support he requires, he will be assessed by a forensic psychiatric hospital and may be transferred there for care and treatment for however long he needs.

The idea of cameras in courts is alarming. Given the current state of British justice, are judges, barristers, and others grandstanding in the American style really desirable?
I don’t see an issue with broadcasting sentencing hearings personally. I would not want to see anything pre-sentencing however. I think it’s good for the public to see and listen to why judges have passed the sentences they have and it will hold judges to account more I believe. There is nothing stopping the public watching the whole trial in a public gallery (unless there is an order from the judge), so I don’t see what the issue is here.

You obviously do not understand their lifetime of ankle bracelet fitting and monitorimg.
Even after release on parole, should he qualify, he will remain on licence for the rest of his life and can be returned to prison if he commits any offence for the rest of his life. Hence life sentence.
I guess he will serve 5 years and 4 months, with the 50% rule. However, when he is released, will he be offered the help he needs? I wonder?
@@Mike-tb5gj There's no 50% reduction on a minimum tariff for life. 10yrs 8months is the absolute minimum he'll be inside for, and there's no guarantee he'll ever be released.
Tragic cases like this is why the decision to allow filming in UK courts is an important step. The horrific description of the events of his life and the build up is so much more powerful than reading a couple of paragraphs in the paper.
Completely agree. Not to take away the crime Ben Oliver committed but he was well and truly failed by the system. Very sad indeed.
Yea exactly they leave people not knowing the details and it infuriates me
I am against the televised trials concept, on two bases, one it is the slow americanisation of our legal system and secondly, if there is a mistrial or appeal, then the jury may have watched the original trial and as a consequence any retrial jury may be prejudiced, rather open minded when listening to the evidence. I am not against harder sentences, in fact I would bring back hard labour, remove tv's from prisons and issue just a basic, but healthy diet, in general made prisons a proper fearful punishment.
Only the sentence is being televised. The rest of the trial is not.
@@simondobbs4480 Let's hope it isn't a slippery slope.
Yea punish this guy more... that's what he needs
Not like he was failed by everyone and everything. Harsher punishments mean nothing to broken people. Fix the fucking people not the punishments
They should definitely have TVs, otherwise they will just spend all their time being violent towards the guards.
We've been watching movies and TV shows for years
They should show more like in the US
Can i just say that it is fundamentally untrue that a "lack of empathy" is rooted in Autism Spectrum Disorders.
@@aaronmckenna1103 Thank you for your articulate response; I wish you well.
So with all the tragedy in this persons life. This Judge spins a tale of the horrors in his life, then to add insult to injury sentences him to life in prison. Where do these lawyers and judges go to ethics school The University of the Motion Picture Chicago?!
Truly sad and I imagine this is just 1 of many like this.
However seeing how this was shown on TV may wake people up to how broken the system is, and what NOT paying attention to what's going on in government, law and society has on us all and future generations
But the Tories don’t want to pay for public services because they would rather keep their elite donors happy by not charging them adequate taxes. Our public services used to be the envy of the world but the Tories have put paid to that.
And i thought i had a bad start in life , strewth this bloke needs help in prison to help him try and make something of what bit of life he'll have when he comes out
Wow this is powerful stuff, this was a young man let down by a broken system of social, medical and mental health care. With the right interventions at the right time I could have been different. After hearing the story of this young man’s life he simply didn’t stand a chance.
Harrowing and tragic.
The comprehensive longform delivery is much more informative than sensationalized headlines.
another adoption nightmare with consequences down the generations
This man has gone through hell in life by the sound of it, on top of that he has also had to put up with coping with all of this through his autistic situation aswell. However a crime such as this, is a blatant act of inhumanity of which the crime deserved the time.
In my opinion, i must lay a lot of the blame on the system, those in a profession of being able to do more to help this man, but failed in their duties.
Hearing what was told by the judge, it is very sad that someone has to go through a life of cruel torment as this man has. I hope he can now get the help required in his incarcerated time and be able to be rid of his torment later in his life.
Poor human, he just needed somebody to keep him safe and they all let him down. His poor nan is the only 1 who tried
Honestly
Tragic. Very sad.
If his mother filmed him being abused, why didn’t she go to prison? (See explanations below.)
Ever heard of the pussy pass?
I thought that was to get the police involved.
It was she recorded the abused and he got arrested she trapped the abuser
The mother protected him the grandad and step dad abused him

Good Lord, he needs a well deserved rest in a secure medical environment like Broadmoor, not a death sentence that prison will bring.
He will very quickly be made subject of a transfer direction order and be detained in a secure psychiatric hospital.
The boy didn't stand a chance from a young age... Very sad . Just goes to show what impact others have on you at a young age ... Distressing to hear this. Awful on both parts. But I agree he's a destroyed soul and what could he do next!!! 😢 His dear nan was probably the only love he had.
When does the mother stand trial?
Dear God...I have nothing but compassion for this man!
This lad should not be going to prison, those in power have let him down all his life & continue to do so.
Judges: Now we're on TV we better hand out tougher sentences
So true.
A “life sentence” of ten years; routinely only half of prison terms ever get served in England, getting paroled out at the half-way mark is basically automatic.
Tough sentence?? 9 years for murder is a joke
Lets see if they start handing proper sentences to grooming gangs
@@johnhankinson1929 We don't have enough cells to hold them :(
What of the ill treatment and deaths in old peoples homes.
I think if a child has this sort of upbringing and in adulthood they seek vengeance against their abuser . This should go unpunished. Most abusers seem to forget that children grow in into adults normally bigger and stronger than themselves.
Apart from the obvious comments about the case which is tragic. The court room needs better lighting
Don't hold with this at all. The slippery slope towards the dreadful circus that is American practice.
Bruce, I was just thinking that. Copying America as per usual. I just read the book: America The Farewell Tour. Great read and all predictions coming true since it was written in 2018. Chris Hedges did a wonderful job revealing a society in deep decay - the opiod crisis, gambling, sexual sadism, suicide, which are plaguing larger and larger segments of the country.
That's exactly WHY it should be recorded. Let everyone see the corruption and failure that it may finally end
🤦🏻♂
A failed justice system indeed, he should have been locked up for good long ago.
Plenty of people have been through what he did, not all of them go on to pedophiles and murderers, so he has no excuse.
Poor sod ,sounds like he never had a chance from the start m should be in a hospital rather than prison
I dont understand why she is telling him his own life story?
To put the verdict in context.
they most probably used it as his defence so she has to then sum that before sentence
The early signs were there to be seen with this guy. The system is the failure.
Life is not ten years
eligible for parole after 10 but its unlikely he will be granted it.
I feel bad for this kid, but I wouldn’t want him living next door to me
No, you’d want him living in a mental institution where he’ll be given the help he needs, rather than left to rot in prison.
This is unbelievably tragic. We all get one shot at life. It's unfathomable that something like this is that one shot someone gets :-(

Shocking. Just shows how the system has failed another child. The mother and uncle should face charges, they basically planted the seed knowing full well what would happen. What a traumatic life. You can't help, but empathise.

Justice, such as it is, is not entertainment.
Why was it necessary to go over his life story?
It sounded like she was making excuses leading up to a lenient sentence then gave him life
She was justifying her attempt at justice.
I really hope this concept doesn’t take off. This isn’t the circus of America.
Maybe having live court hearings will give society some sort of compassion to the background of the crimes rather than the media grabbing headlines trying to deem people as monsters.
Firstly Court proceedings should not be televised - leave that for the crazy yanks.
The criminal prosecution system is not for entertainment.
Having said that and listening to this young lads life story, it seems to me that this monstet was created by the adults around him and now he is the one being punished
Personally I think it should be the boys mother and her waste of space partner that should be up there.
Such awful experiences inflicted on children should not go unpunished.
Obviously after that speech the Judge has done her homework.
Why don’t they show more trials from the old Bailey? I’m so eager to know about the Shakira Spencer trial which is ongoing now but no reporting on it feels highly unfair

Looks like the system let him down to let alone his parents
@@susanm8669 Then the state needs to get on top of that. A big strong state can eliminate that. Those carers need jailing for life, no chance of release.
@@unusedsub3003 Its not just the carers, you must be out of the loop if you are not aware that the son called elites are involved at all levels. The carers were bot protecting the children by not ensuring they came home and not reporting them missing. They knew the children would be back, eventually. Nearly every council in the larger cities has failed these children and as usual, when they do have an enquiry its lessons have been learned, nobody found responsible and that's the end of that. excuse my ignorance here but does this sentence come with mental/medical help or are they just locking him away.
Get used to being reminded as to how you should be aware of the fact that there is a stratum of society which reserves the power to take away your freedom and is above questioning....
Why, all of a sudden....are courtroom proceedings being televised?
The task of securing the future of your decendants freedoms has fallen as your lot.....

At this point he has been found guilty, generally this stuff is not discussed unless it was relevant to the mitigating/aggravating circumstances of the case
I personally experienced porn, being given alcohol to the point of passing out, heard my younger sister being abused, saw my mom beat and heard her being raped by my dad, watched as my grandad pushed my Nan down the stairs, bullied by my dad all by the time I was 8 years of age!
