Something you didn't point out, but Ludwig did a vid on this as well and used Wayback Machine and pointed out that their product page for selling the stolen cases was not only more expensive, but they just flat out photoshopped the images from D Brands site and pasted them to their own site. There are images with extra lenses that match up to the original D Bran photos but make no sense on being in the edited photo. So just one more thing they did terribly.
I work at Best Buy as a Verizon Rep, and seen this case, took it to my GeekSquad repair agent who likes dbrand, and said "Hey this case looks like the dbrand teardown skin, I kinda want one of those, but this looks pretty much like it, however the print quality is dogshit" It's funny because I said this maybe 3-4 weeks ago, and decided I was going to just order a dbrand vinyl instead

Honestly, majority of people here in Japan never heard about dbrand until some other people outside the country or some big UA-camrs mentions it. Casetify is huge here in Japan, They even have their own store here. If Casefity gets destroyed then I honestly hope dbrand would atleast enhance their promotions better in other countries.

This actually happened with a friend of mine back in 2015 he was dropshipping iPhone cases and there was a company that had “licensing” for the certain iPhone case designs so they essentially hit him with a cease and desist over something that they most likely didn’t own the licensing for but he wouldn’t have had the funds or time to go through any legal proceedings at the time so complied. Btw it was like the generic iPhone cases you’d see on Amazon at the time

My assumption is that Casetify will remove the jokes from the design they took and this lawsuit will either get settled or go absolutely nowhere. I just doubt either company wants to drag this out.
They'll probably just drop the designs alltogether. Since they couldn't be bothered with actually taking photos/scans of phones themselves in the first place, so I doubt they'd bother after getting burned by this situation.
Consid that JerryRigEverything already owns physical cases because of this episode.., it's material evidence in patent infringement.. a *federal* patent infringement lawsuit.. Casetify is solidly screwed by their own product... If dbrand wants to take it the whole course instead of just settling.. It’s been a while since we had a good phone case controversy. I was starting to lose hope for another one after it’s been so long since the UnboxTherapy vs Pitaka situation.
Dang, and I was thinking about buying one of Casetify’s Evangelion cases, until just now. 😭 I’ve heard the quality is solid. This could be blatant ignorance but I am not inclined to give any larger company that doubt tbh. Regardless, due diligence should have been followed so there’s not much of an excuse.

unless those images are really low res their print quality seems shocking in comparison to Dbrand considering the price they are asking.
@@WayStedYou to be fair, i recently bought a casetify case for my phone. The print quality was terrible for the price of £52. On the pictures it also looked like it was meant to have a holographic effect, but of course it didn't. They are just extremely overpriced for what they are

There are so many cute in jokes and goods that I guarantee they never intended to be used as watermarks. I can just picture someone slapping these assets together and thinking, “oh this is funny.” And then seeing the jokes they made on a competitor’s case, “Oh, this is hilarious!”

the iriny is that making this so easily bustable actually provides the offending company with marketing exposure.
all they have to do now is modify the design by removing the non-internals portions, and still sell the general idea as a much lower price.
The IRONY of your comment is that Casetify has no conception selling anything at “a much lower price.” Further, they can’t undo what they did, no matter the course correction.
@@KahlessTheUnforgettable this isn't a death penalty. they'll pay the fine for whatever revenue they made - if any. they'll continue to do business, which they now have had a much greater exposure over. it may not have been intentional on their part, but they'll be better off after this.

This also isn't the first infringement suit brought against them, there's one from around 2014 that was closed and even one from earlier this year.. This one's just *very* public.. Ludwig's covered it, Muta's covered it, LTT will probably cover it on wan show.. Casetify won't escape the mark on their reputation.. which wasn't that great to begin with.

and yet they have survived it to continue with their infringements for another decade. I own a bunch of dbrand products, but as a consumer, I have never heard of casetify until now. many more people will know about it now. as far as being a significant blow to their north American market - they are a hong kong company. as long as consumers want their products (especially now that more of them know about the company) i doubt they'll have problem selling and shipping to n.a. i think it is underestimated just how many consumers care little about accessories brand loyalty and/or infringements.
@@borisattva Casetify are only in recent years really expanding their marketing in north america, here in japan though, they have full on physical stores and most people know about them.. That's why I specified that it would hurt their north american market.. Most people here in japan don't know about dbrand, because dbrand doesn't really market here..

My assumption is that Casetify will remove the jokes from the design they took and this lawsuit will either get settled or go absolutely nowhere.
I just doubt either company wants to drag this out.
They'll probably just drop the designs alltogether. Since they couldn't be bothered with actually taking photos/scans of phones themselves in the first place, so I doubt they'd bother after getting burned by this situation.
Consid that JerryRigEverything already owns physical cases because of this episode.., it's material evidence in patent infringement.. a *federal* patent infringement lawsuit.. Casetify is solidly screwed by their own product... If dbrand wants to take it the whole course instead of just settling.. Casetify is properly screwed in court.. they took down all their products relating to dbrand at the moment.. but I doubt dbrand will let them settle.
