Lived in PA for 30 years also a veteran was traveling home on the turnpike got pulled over for doing 60 in a 55. Knowing that my pistol was in my jean jacket next to my wallet I Kept my hands on the steering wheel and informed the officer that I was licensed to concealed carry And my fire arm was located beside my wallet. I was disarmed pulled out of the vehicle and quote "Hand cuffed for safety" at which point they searched my vehicle (no permission was asked) and found a 2nd pistol "UNLOADED" stored under the seat still in the box, as I had just purchased the gun that day. I was placed (still hand cuffed) in the vehicle while they ran the #'s on both my fire arms I was told that only one came back as belonging to me and the pistol I had just purchased was not mine. I told them to look in the box the receipt and paper work where in there. finally they let me go about an hour later but not before giving me a ticket for doing 5 over the speed limit. Never Volunteer any information and know your rights its no wonder the reputation of police has gone so far in the gutter
That sounds like a fabricated story to me, because the police are not permitted to cite for speeding unless you are 6 to 10 mph over the limit. So?

In Pennsylvania your conceal carry info is tied to your driver's license. So if the police run your license they will see that you have a conceal carry permit.

Here in Pennsyltucky it is quite common for cops to take your gun "for their safety" and "run a check." We don't have "registration" here but many cops think we do because the state police maintain an illegal database of sales which the cops treat like a "registry." If your gun doesn't come back as "registered" to you, they'll often confiscate it illegally until you can prove that it is yours.
Why wouldn't a handgun be in the database? Gift from spouse, parent or grandparent. You bought it from a friend before state law required private sales to be processed by a dealer. You bought it when you lived in another state.
Best thing is to keep your mouth shut and volunteer no information.
If they do take it, and you haven't been charged with a crime, you can certainly sue for theft.
They cannot take any property without probable cause - so the only way they can confiscate the gun is if someone reported it stolen, you are being arrested and they are collecting inventory, etc. Merely not being on the State Police registry as the last person to sell it through an FFL means nothing.
It is expressly illegal in PA for the state police or any other entity to maintain a firearms registry. The law requires the state police to destroy records from background checks and transfers within a set amount of time. What the state police "check" is to see if the weapon serial number is on a list of firearms reported stolen, and to verify you are not a felon.
I live in PA and have had interactions with officers from several departments while open carrying, and have never had my firearm taken from my possession. Ever. I've been open carrying for decades.
@@thomabb LOL! It may be expressly forbidden to maintain a registry but the state police do. They refuse to destroy the records and the courts have held the the "database of sales" is not a registry because it is not complete.

@@BNails See, you're using logic. Legally, the presumption is that if you have someing, barring any evidence to the contrary, it is yours. However, the police like to be dicks about this so they take your gun and ask you to prove that you own it. Of course you can hire a lawyer at $400 an hour to help you get your $450 gun back.
They know as soon as they run your Registration. And almost all the time being pleasant and respectful will result in a great interaction and probably no tickets.
While some states do combine the data base info, some still do not. An excellent source of state by state regulations is "The Travelers Guide to the Firearms laws of the Fifty States" published and updated every year.

Life is good in rural western pa... if a cop tries to harass you for carrying just call the sheriff and they run like chickens..

@thomabb I'm a native here I open carry too from time to time. Depending on the clothing I got on. For the most part haven't any problems. Occasionally you'll get a liberaltard call on ya. Cause they don't like firearms but that's about it.
🟥 The cop knows how many days you were late for kindergarten before you come to a complete stop. That also includes your carry permit etc.
I have been carrying concealed since the mid-80s. Every day. I have been stopped a few times during that period and have always done the same. I keep my driver's license in the same place in my wallet with the CC license. When the officer approaches my car I give him BOTH and then follow what he says or asks. I have never had a problem.

You arent required in PA to tell the cop that you are carrying.
At times, it might be a good idea to let them know. Other times, not so much. Different situations, different best decisions.
Why advertise that you have a firearm? This could go bad for you. Why take a chance?

I never keep my firearm in the glove compartment, nor do I keep my registration and insurance there.
My registration and I insurance is in a plastic sleeve clipped to my visor.
By the time the officer gets to my door, my Drivers license, and LTC are also in the plastic sleeve, handgun license on top. Plastic sleeve in left hand , both hands on steering wheel. When officer asked for my information, the first thing he see is my license to carry (LTC, Texas). My firearm is always on my left hip. Cops are so scared these days that your best to take these steps just so they don't get afraid and reckless.

In pa you are legally required to tell an officer if asked that you have a firearm on you. At the same time if the officer doesnt ask, you have zero legal obligation to inform them. Keep it short and sweet with as little information as possible. It will only be used against you.

If I tell an officer my insurance and registration is in the glovebox, but my LEGAL CONCEALED FIREARM is in there as well, does that give them the right to deny me the opportunity to retrieve it and get in themselves? In many states the LAW requires you to inform police if you have a firearm in the vehicle and failure to do so could get you arrested for felony charges or shot ...if you're LEGALLY carrying a firearm why would you have issues with informing officer ?? If they attempt to disarm you is when you should start verbally objective to the violation of constitutional rights
@@grouchyoleguy that's what I meant...you can inform the officer that you have a firearm, but then the guy said to ask the cop what to do. Most of the time cops will tell you to either step out or surrender your firearm. Depending on bow tough the cops think they are. And you should never do that.

In the infrequent times I had interactions with cops, I never informed them. I didnt want some overzealous jumpy cop going nuts.

In Ohio you are required to let the officer know that you are carrying a firearm and you have a ccw permit. I never say the word gun. When the officer approaches the car I say that I have a ccw permit and am carrying, do you have any specific directions for me? I have been pulled over and it was in the glove box and he said don't even worry about the registration and insurance card.
I keep my insurance card and registration on my sun visor. If I get pulled over I turn on all interior lights and await the officers instructions. This way he can clearly see im getting my paperwork from my visor, then I'll inform him my licsense is in my wallet should I retrieve it? Then if I get a ticket, I probably deserved it. Then I thank the officer for his service to the community, and keeping us safe. Then I go about my day and be thankful to live in this great country. Its really that simple.

I have been pulled over twice Carrying. I let the officer know I was armed and had a permit to carey. He asks me where it was and told it was my right side.
He said thank you for letting him know. He for drivers license and insurance and my permit. He give no ticket and said thank you for letting him know I was armed.

Just so you know, according to PA law Title 18 Section 6122(a), depending on what 'lawful demand' is, failure to produce your license to carry when asked can let the officer act as if you don't have one. Most likely, whenever a vehicle is involved, demands for such information are always lawful. Moreover, your license to carry can be revoked if you choose this path. This is similar to what may happen for any activity requiring a license, e.g. transporting explosives, selling liquor, etc.
Sure, if the officer has probable cause that you actually do have a firearm in the car.
If it isn't visible and he asks for your LTCF, you can ignore the request / demand. If there's no PC regarding the firearm, then there is no requirement to show the LTCF.
Up to you if you want to escalate it like that, but that's the law.
True, definitely a personal choice, though I'd argue it's an incredibly bad one. It's been ruled time and again that an officer may do whatever he thinks fits reasonably within the law, so for routine investigations, he will face no consequences. Purely hypothetical, but an escalation may happen as such... He only needs reasonable suspicion to ask you to step out and search your person and probable cause to search your vehicle (a warrant is no longer required in PA). Because the officer is already detaining you by definition, it wouldn't take very much to justify asking you to step out (e.g. by you refusing fairly normal questions), by which point he would've called for another officer. After being searched for his own safety, if a firearm is found, he can just arrest you immediately, and of course search and impound the vehicle. Most likely the Sheriff's Office will revoke your LTCF. At some point later, you may provide proof that you had your LTCF all along, but ironically instead of having taken a few seconds of your time to confirm your status as a law abiding citizen, you spend some portion of your life going through the system treated as a felon. Again, hypothetical, and it could even be worse, but not at all unreasonable when guns and vehicles are involved.
Obviously it could turn out to be a lot harder if you choose not to give up your LTCF if just generally asked and there is no real knowledge by the cop of you having a firearm.
But all a cop has to do is ask every single person he pulls over for the LTCF, even if they have no idea of what that is, and every single person with one gets caught up in his fishing net. That type of questioning generally isn't allowed and should be resisted if possible.
I get your point about how things tend to drift toward the officer (even if I disagree that it should be this way) and that the person would likely face issues later on, but what's the point of being able to remain silent if you are effectively compelled to speak and produce ID just because of a fishing expedition?
Also, if I am carrying a firearm and get pulled over, the officer has no idea whether or not I'm carrying. If asked for it and I just remain silent, I'm not breaking the law. If I am asked to get out of the car and then inform that I'm carrying and that I do indeed have the LTCF, the question of a firearm has just come into play and I've satisfied the law by offering that LTCF.
This is all legal speculation of course, and lawyers would eventually hash that all out. But according to the letter of the law in both state and federal jurisdictions, I don't have to say a word. By PA law, I don't have to provide that document unless the question of an actual firearm comes into play - which it doesn't until it's known that it exists in the car or concealed on my person.
+Michael Williams OR, you could just act like everything's normal (because it is) and simply not tell him you have a concealed weapon. He's never going to know unless it's visible or you're acting like a moron. I think this is the best option because you have a lot of cops out there who are eager to bring the hammer down on everyone, If he never knows, he can't make a big deal about it. Now if he had a warrant, or otherwise found out I had a gun I would definitely present my permit.
And at any time they can violate all your rights and get away with it.

I think you should specify that in some states it’s not required that you tell the police officer that you’re carrying a weapon. In the state of Ohio it is mandatory that you tell the police officer that you have a gun

Under Pennsylvania law, firearm dealers must provide a record of the sale of handguns and certain other firearms to the Firearms Division of the Pennsylvania State Police (“PSP”), which maintains a permanent database of handgun sales.1 However, this database does not constitute a registry of gun ownership, and PSP maintains no record of long gun sales.2 Pennsylvania law specifically prevents any provision of its law from allowing any government or law enforcement agency to create a registry of firearm ownership.3 State law also requires PSP to destroy any application or record of sale of a long gun within 72 hours of the background check.4
In Allegheny County Sportsmen’s League v. Rendell, 860 A.2d 10 (Pa. 2004), the Supreme Court of Pennsylvania interpreted these provisions to permit PSP to maintain a database of the purchasers of handguns, but not of long guns.5
In addition, Pennsylvania’s law regarding domestic violence contains a similar provision, stating that it does not allow any person or entity to create a registry of firearm ownership, although information may be retained to ensure compliance with these statutes and to document the return of firearms to persons no longer subject to protective orders.6 Such information is not subject to public disclosure.

Can I carry my firearm loaded, but concealed in my vehicle in Philadelphia, PA?
I would advise against that. I believe Philadelphia you would need LTCF or CCW. Pa law states you need license to carry loaded in PA. Philly probably more hoops then needed. Long guns can not be loaded in vehicle period with/without license.
I recently bought and 9mm Taurus yesterday with my driver license from Pennsylvania before I purchased the gun at the same store I had to fill out on there computer for my background check and thanks god i don't have anything pending or felony then they call me and told me i pass so i purchased the gun and they gave me the state police application for the gun i purchased with my background check and the firearm information so my question is can i carry it or have it in my vehicle my gun without a gun license or i need to get a license to carry it and to be honest I don't like firearms because I have a big family with kids and I had to buy it about the situation of coronavirus and maybe some day someone can brake in my house steel my food or someone trespassing or my family o my safety?
I just purchased one recently as well, I recommend taking a gun safety course, you can get a gun safety certification for it, and also if you want to carry or conceal, I believe you need to get the respectable licences for that. Dont just buy a gun and holster for it and start walking around with it. I believe without a licence you just keep it at home

In PA, without a license, you may open carry firearms publicly, and do as you wish privately. You may also transport your firearms to and from dealers and target practice or competition without a license. The PA LTCF is for public concealment and general transport. In other words, it's a license to carry as you please :)
Don't forget that you need a Pennsylvania LTCF to carry in Philadelphia, regardless of openly or concealed. And you need it to travel in a car with a firearm (with a few exceptions that you mentioned).
And lastly, yasdx2, while I would certainly agree with you, I really don't want to end up in prison because of this. It's why I have my PA LTCF.

Any law contrary to the Constitution is NOT valid.. All these Federal laws being passed (gun control) are NOT valid.. But with corrupt /ignorant cops and judges today that puts themselves above the law.. That leaves only one direction for the citizens to go.. First of all they DO have to tell you the reason for the stop. Tf.
Or you can volunteer that you carry and get to stay on the side of the road as the officer steals your firearm as you comply but do not consent and he forces you out of the vehicle and he attempts to remove your weapon, flag his foot, your car and assorted other things while trying to figure out how to remove your magazine, then about 10-20 minutes later he will come back hand you a magazine and point your firearm at you telling you not to load it until he leaves and at the same time he never took the round out of the chamber that you carry in condition one and flags your wife sitting next to you whom he has ignored and is also carrying. You then ask has he cleared your weapon and he stares at you with his mouth open and repeats the same warning about not loading your weapon as he hands you a loaded weapon pointing at your head. Not all officers are familiar with the many EDC out there. I will not be offering information anymore, it was safer in my shoulder holster.

I understand everything in these law videos about concealed carry, but as a law abinding African American, who went to college, going to med school, doing everything right, but I'm afraid that I still might end up on the wrong side of the law by telling a police office that I am carrying, I don't carry often and mostly because I forget too, and thankfully when I'm pulled over, I never have it, in my situation and the way the political climate and race tensions are everywhere, am I better to announce that I have a conceal carry? in the video you say its up to me, but to be honest is it better to announce it

Just don't say anything if you are in New Jersey, just run as fast as you can. Do not tell them anything about a gun, real or not and by all means smile and say thank you for the ticket, have a nice day, then get the Fuck out of there. They will arrest you if you carry Legal or Not.

I carry my registration and insurance card on my visor. I pull out my wallet, put it on the dash, then put my hands on the wheel. Simple.
Don't keep a gun in anything other than a holster or a locked case. Don't volunteer any information, except your driver's ID and paperwork

Omg the further I get into this video the more I realize this man is set on a certain state. Some states require you announce the presence of a firearm immediately.
Also, in PA while Open carry does not require a permit, the moment a firearm is in a vehicle whether hidden or in plain view it is considered to be concealed which requires a permit. Some of the few exceptions to being allowed to have a firearm in a vehicle without a conceal carry permit include, to/from hunting, purchase, target shooting, or a gun smith. It essentially makes it very inconvenient to open carry. (I disagree with all of these laws. It does not prevent crime.) Again this is for PA.
My main question is how PA gets away with requiring these licenses/permits for liberties when PA's court rulled along with Alabama for this to be unconstitutional.

@@williamtpenningtonart Thank you. I have been thinking about that part for a while. What problem would arise if I am unloading a firearm while in car before moving? I will probably ask at local police station or trooper outpost.
@MrTdvw02 @MrTdvw02 This isn't legal advice. You're better off asking a lawyer who specializes in firearms. In PA if you were unlucky enough to be caught with a loaded firearm inside the vehicle without a LTCF i'd expect that an officer would not be too kind about it. You may be charged with a crime. I eject my magazine before entering my vehicle. And store it in either my trunk or a separate ammo container.
This however doesn't mean you qualify for any of the reasons above that I mentioned for transportation of a firearm in general. I'm trying to hold out for Constitutional Carry.
@@MrTdvw02 I believe it’s up to the cop in PA as to whether you’re in violation or not, if you DON’T have a LTCF. The way I heard it put is like this (regarding NO LTCF): If you were just at the range shooting your gun, and the cop was there watching you for some reason. He observes you get in the car and you drive home, but you stop for gas on the way, and then you go straight home, it’s up to the cop to decide if that’s a violation or not (The law says you must go straight home). Similarly, if you unload the gun and store the ammo in a separate container, it’s up to the cop do decide whether the container is separate enough.
I got my LTCF precisely because the law seemed too vague on this point. It cost $20 and 30 minutes of my time. More than worth it to be able to stop at a Wawa on the way to/from the range, not to mention to be able to carry concealed.

I never felt anti gun stuff in PA. Most laws seem like they tried to find a decent line between safety and freedoms. I will say no open carry in a vehicle is weird since PA is open carry. Philly and Pitt not sure tho.
