Certain agencies or portions of agencies which had nothing to do with the NICS system and were deemed “nonessential” were closed for some period of time. The most important of the provided reasons, IMO, is that you can carry in reciprosity states. In Arkansas if you present your carry license when buying a gun, all you have to do is fill out the 4473, skip the background check, and walk out with your shiny new hole puncher. Requiring a permission slip as Emily mentioned is unconstitutional in itself, much less having to PAY for one. Both instances violate the 2nd Amendment by imposing a restriction on a right.
The ltc instructors got with legislators to make these rules for non licensed constitutional carriers so that people would want ltc for the extra perks so that ltc instructors would still have a job. Think about it if we have true constitutional carry with no restrictions they would be out of work.
Just moved back to Texas after 40 years. Texas has always had sketchy gun laws. It seems not much has changed. You actually have less Rights under "Constitutional" carry.
Do you lose some rights by getting an LTC as well? For example, does an LTC have to hand their LTC to an LEO when they get pulled over whereas a non-LTC would not? I think this would be a more interesting topic that few have covered.
Thanks for plugging local instructors to get an LTC. However, many of us are older, and tend to have real websites instead of Facebook, particularly with the Facebook policies concerning firearms.
It is unfortunate that business owners and politicians are willing to differentiate between an armed citizen and a "Licensed" citizen. The "Right to keep and bear arms shall not be infringed" is all that should matter. America!!!
Yep, agreed. The 51% sign does make sense though - many ordinary, reasonable people tend to get a lot less reasonable and intelligent when they're drinking.
Great informative video guys!!! I live in Florida and have a Florida CCW. Even if we had constitutional carry I would never carry without my CCW and U.S. LawShield coverage
Also the good thing about a Florida CCW is that it also applies to other non-gun weapons. So for example if you have a knife with a blade 4 inches or longer you can carry that knife concealed. With out a CCW you'd be arrested for a concealed knife with a blade that long.
For what it's worth, my state of Ohio also allows FTC (called CHL here) holders to bypass the background check--BUT--the FFL holder may choose to do one anyway. So this is something every state resident must check carefully in their state.
Strange that my anti-gun state of Washington has less restrictive concealed carry in some respects. To get a CPL (concealed pistol license) you fill out an application, get fingerprinted, pay your $50 fee, and wait for it to come in the mail. Open carry is legal without a permit. Stores and the like can post no pew signs, but there's no law against carrying in those places even if they have a sign. The most they can do is ask you to leave and report you for trespassing if you don't. If you're concealed carrying they're not going to know anyway. In any case, apart from government buildings and the like (the usual suspects), I never see such signs where I live (maybe in Puget Sound you see them).. Otoh, we have the mag ban (which applies to all guns, including pistols including standard double stack glock mags and the like), safe storage law, red flag law, safety course to purchase or transfer, can't carry near protests, etc.
I currently carry through constitutional carry and have not had any issues, I have only been carrying for a couple weeks so I have been checking entrances to any business I intend to enter and have yet to come across any no firearm signs, only been to walmart, kroger, tractor supply and home depot but so far no signs, I think when constitutional carry became a thing these businesses just decided to let everyone carry if they want, though I will probably look in to LTC soon just for the added protection.
@@idontwaitfor420 yea within a few weeks after posting my local Walmart put up signs but concealed = they don’t know and what they don’t know well we all know the saying and I’d rather have and not need.
Why did we fight so hard to get constitutional carry if we still don't have full 2nd Amendment rights. All of these restrictions completely makes constitutional carry pointless.
Hello, Richard and Emily. This is NMR. I just joined U.S. LawShield because of YOU and because of Jack Wilson. I signed up with a different email, so that's why my profile pic is NR. In my opinion, the 30.05 signs need to be as regulated as the 30.06 and 07 signs. They also need to REQUIRE the signs to have a full background, NOT letters on glass in order to be valid
As soon as you mentioned the Hotel/Brewery I knew exactly who you were talking about (not going to out them as they are a client of mine). I wasn't aware of this and have carried in there in the past. Will be more careful about this in the future. Thank you.
So, can you swap out the cylinder and bypass the 30.06/30.07/30.05 signage? Take the .357 mag cylinder out and replace it with a .38 cap and ball cylinder. My understanding cap and ball or any black powder gun is not a legally defined firearm under both Texas and US law.
That explains a lot! The whole time I was listening to this I was thinking, "This does not sound very constitutional. Why are they calling this 'constitutional carry,' with all of these restrictions?" It makes me glad I live in Idaho, which has real US constitutional carry.
The actual bill does not mention the word Constitution. It is called PERMITLESS CARRY under the Firearm Carry Act. I do NOT ever use the term "Constitutional Carry" when discussing this law.
@@WallaceDunn Correct, which is why I wanted to clarify that the use of the word "constitutional" in this video was referring to Article I, Sec. 23 of the Texas constitution and not to the Second Amendment of the federal constitution.
I get pulled over. I put my hands out the window. Left has license and insurance. Right has receipt for what I'm carrying. Usually, i get this reaction. They say thanks and get outta here. Or. You carry a 22. Boy, you need help. 😅😅 Be safe out there guys.
I totally get what she is saying, totally. But adding a government license to reinforce the inalienable right to carry for people who think guns leave grapefruit sized holes in targets is so abhorrent.
So happy to find this video! And it’s true, I bought a couple firearms during the pandemic time. I went literally to the same FFL shop I bought my first firearm from in 2016. (no problem) But during the pandemic it took me over 30 days to get the firearms I bought. I went even over and above got my finger prints taken for the NICs system. Still delayed after that. I was pretty much calling the shop every Friday asking if I could come pick up my firearms. And I kept getting a no. It was very frustrating. After a month I was finally called up to come get my firearms.
When I moved from TX to NC, I had my TX LTC converted to a non resident. The non resident wasn’t printed like a TX DL, but that was the only difference - of course I have my NC CHL too.
Wish you had given a little better answer to "How do I get my LTC?". My local gun store gave a name and number (the only one they had) but the business was closed down and no longer providing LTC classes. Otherwise, very informative. Thanks.
Texas is jacked up! Georgia essentially just changed the statutes to replace the wording for the exemptions for permit holders to apply to every eligible person 21 or older.
@@rickaustin5065 its 100% true 30.06 and 30.07 say "By Licesed carrier". The signs and law were made prior to permitless carry and have never been updated. Trespass by License Holder with a Concealed Handgun No LTC, legally it dosent apply, only 30.05 applies to permitless carriers.
I am eligible for protection under LEOSA for all fifty states. Will you represent me if anything happens in all those states if I am a police officer member??
It used to scare the heck out of me if I went to walk my dog, or something of the like, and left my wallet and license at home. If that happens now, do I become a constitutional carrier until rejoined with my permit?
Makes no difference what type of license you call it. They all infringe upon your 2nd Amendment rights and a another method of taxation and discrimination against the poor.
One aspect that was not mentioned and I believe it still applies is federal GFSZA. Federal law prohibits gun possession in school zones (not just schools themselves, but also areas outside) unless one is licensed to carry in that jurisdiction (state). While the state such as Texas is not likely to push that issue in a good defensive shooting in such area for somebody who is not licensed, Feds can still choose to prosecute.
3005 they have to trespass you so then you leave. Its a trespass warning. They would have to see you have a firearm and ask you to leave. Doesent change the right to constitutional carry.
Thank you for this video! Question, if a person was convicted of a felony in Texas 20 years ago BUT, they completed 5 years probation, the offense was not put on their record (background checks always comes up clear). The person has obtained a passport and also legally purchased a gun at a gun show. Can this person carry in Texas? Thank you!!
Honestly. No, why carry? The state makes it a minefield of serious offenses if you make a mistake. Boom, now you missed a sign and you’re being charged and are losing gun rights. Now a lawyer (like you guys) get to gut me financially to defend myself, for exercising a right that the plain text of the constitution already says that I have.
Nice informative video. I realize it is now approaching 3 years old but I was not able to use the link you provided to get the Texas Constitutional Carry Guide. Is that still available? Has it been updated since first published?
I've started carrying my Daisy B52 slingshot everywhere. I am retired and no longer fly... but even if I did fly, a slingshot is not a prohibited weapon (as far as I know). The 2nd amendment "shall not be infringed" so every state law restricting pistol or rifle carry should be struck down as unconstitutional. Just practice with the slingshot until you hit what you aim at every single time. David killed Goliath with a sling (the predecessor to the slingshot. A well placed projectile from a slingshot will definitely incapacitate long enough to disarm and restrain a bad guy and if struck in a sensitive area (temple or eye) can absolutely be deadly. Many, many people in the past durung the depression and even now in places where firearms are outlawed (like Australia) use a slingshot (or sling) to feed their family by taking squirrels, rabbits and other small game daily. A slingshot in the hands of someone who knows how to use it proficiently is a deadly weapon. It just takes skill to be deadly with it... unlike a firearm. I do not condone violence so any kind of violence (even from a slingshot) should be the absolute last choice available with all other means of deescalation exhausted before taking another's life from them. Even so, come Lord Jesus Rev 22:20 KJV
I went through TSA with a single round in my backpack. The cop inspected my LTC and allowed me to make my flight. Otherwise I might have had a free weekend in Club Fed.
Seems to me that any knife should fall under the category of "arms" in the 2nd Amendment. Somehow government has run roughshod over our right to carry folding pocket knives of a "certain" size. I have a 3 1/2" folding Buck knife with a pocket clip. In San Bernardino, CA I was told pocket knives up to 3 1/2" were legal even if fully concealed. Meanwhile in neighboring Riverside, CA the limit was 3 1/4" if concealed in a pocket. I have not looked up the laws to verify what I was told, but I don't live in CA anymore anyway. But still... when the Bowie knife was king of the Southwestern United States just less than 200 years ago I don't see a reason to think a 3 1/2" blade is weapon that the Founding Father's could not have imagined and therefore in "need" of extra regulation. Are we ever going to address knife regulations in this country? They vary too much from one city and state to the next. Gravity knives, switchblades. OTF (out the front) knives, spring-assist knives... The restrictions on knives are also unconstitutional. They should be abolished.
My LTC was revoked for some mental health stuff when I was a preteen that I didn’t list because it wasn’t like court ordered or anything. Not even sure how the State of Texas new about that, but this all happened around the time HB1927 was gaining traction, so a family friend who’s an attorney advised me not to appeal, that it would be easier to wait on Constitutional Carry. I’ve thought about it, I’m in a much better place now than I was 10 years ago and I’m not a prohibited possessor, so I’m going to try to get it back, but at this point I’m told I can’t do that until June 2023. How bad is it going to be for me if I have to use my firearm and that revocation comes up in court?

She’s stunning.
My LTC came in the mail for free. I was about to renew in the late winter of 2024 because mine would expire in March 2024.
Requiring a permission slip as Emily mentioned is unconstitutional in itself, much less having to PAY for one. Both instances violate the 2nd Amendment by imposing a restriction on a right.
Eh, either be an adult and pay for what you want or continue being a child your entire life.
The ltc instructors got with legislators to make these rules for non licensed constitutional carriers so that people would want ltc for the extra perks so that ltc instructors would still have a job. Think about it if we have true constitutional carry with no restrictions they would be out of work.
“Qualify for Texas Constitutional Carry”, so we’re not qualified until we give somebody money to give us permission to carry?
Just moved back to Texas after 40 years. Texas has always had sketchy gun laws. It seems not much has changed. You actually have less Rights under "Constitutional" carry.
This was so informative! Thanks👍
Steve, thanks for watching!
movin through the states with the euro step now that i have U.S. LawShield coverage.
Responsible gun owners watch and learn from these generous knowledge-sharing attorneys. Thank you.

I renewed my Georgia Weapons Carry License. It is good to have for reciprocity going to other states
It is unfortunate that business owners and politicians are willing to differentiate between an armed citizen and a "Licensed" citizen. The "Right to keep and bear arms shall not be infringed" is all that should matter. America!!!
I intend to maintain my LTC because if I'm ever involved in an 'event,' it would seem to be better to have it-- than NOT have it.
I'm moving to Texas is a few months and will still be applying for my LTC after my 6 months of residence.
Now if we only could get all the criminals to read all the signs......😑🙄
Be careful I have seen signs on wal mart doors saying thst unless your licensed under an LTC you can't carry. Not everyone but I have seen it.
@@idontwaitfor420 yea within a few weeks after posting my local Walmart put up signs but concealed = they don’t know and what they don’t know well we all know the saying and I’d rather have and not need.
@@dustinbrown2122 I'm with you there, just hate to see someone get wrangled up in some legal trouble and not be allowed to carry at all.
Why did we fight so hard to get constitutional carry if we still don't have full 2nd Amendment rights. All of these restrictions completely makes constitutional carry pointless.
Thank you for sharing your insights on Constitutional Carry and LTC.
Thanks for watching!
Hello, Richard and Emily. This is NMR. I just joined U.S. LawShield because of YOU and because of Jack Wilson. I signed up with a different email, so that's why my profile pic is NR. I got the Multi-State coverage, so I'm going to feel better moving home and driving across country from Georgia to Texas now.
In my opinion, the 30.05 signs need to be as regulated as the 30.06 and 07 signs. They also need to REQUIRE the signs to have a full background, NOT letters on glass in order to be valid
What if the 30.05 , 30.06 , 30.07 is not posted at the threshold of the business , but inside and visible only after one enters ?
Yep, plan to keep it. Be alert, be smart, stay safe.
Thank you Emily and Richard! I have learned a ton from the both of you. You guys rock! Thanks so much!
To be clear, when you hear "constitutional carry" in this video, it is talking about the TEXAS CONSTITUTION, not the U.S. CONSTITUTION.
“Beautiful and Brilliant”well said
I get pulled over.
Where is the guide on where you can carry vs where you can’t with a LTC
So happy to find this video! And it’s true, I bought a couple firearms during the pandemic time. I went literally to the same FFL shop I bought my first firearm from in 2016.
(no problem)
But during the pandemic it took me over 30 days to get the firearms I bought.
Thanks.
When I’m out in public I see a lot of 30.06 and 30.07 signs that are not legal
I don't want to be on the government's recall list.
We are anyway. If you buy a weapon you are on it. Period
Texas is jacked up! Georgia essentially just changed the statutes to replace the wording for the exemptions for permit holders to apply to every eligible person 21 or older.
Thanks Emily, Thanks Richard! I really enjoy and learn a lot from these videos.
Thanks for watching!
One major problem. 30.06 and 30.07 signs only apply to LTC holders. So Technically someone without a LTC can carry in more places than a LTC holder.
That's not true.
@@rickaustin5065 its 100% true
30.06 and 30.07 say "By Licesed carrier". The signs and law were made prior to permitless carry and have never been updated.
Trespass by License Holder with a Concealed Handgun
No LTC, legally it dosent apply, only 30.05 applies to permitless carriers.
how does local state federal policy override the constitution "shall not be infringed?"
Okay this all makes sense but do all permitless carry states actually issue licenses to facilitate reciprocity?
I am eligible for protection under LEOSA for all fifty states. Will you represent me if anything happens in all those states if I am a police officer member??
It used to scare the heck out of me if I went to walk my dog, or something of the like, and left my wallet and license at home. If that happens now, do I become a constitutional carrier until rejoined with my permit?
Makes no difference what type of license you call it. They all infringe upon your 2nd Amendment rights and a another method of taxation and discrimination against the poor.
Good to know that being a licensed carrier carries a lot of weight with the jury. Frustrating that’s how it is, though.
Thank you!!
Very nice to hear these topics. I am so happy LTC still be good sign
Gas Stations are the worst for 51% signage
My driver's license or other id should be all i need to carry in all places allowed under ltc license.
I recently went with US Law shield. I feel pretty good about my decision even if I’m in California
Even so, come Lord Jesus
Rev 22:20 KJV
I went through TSA with a single round in my backpack. The cop inspected my LTC and allowed me to make my flight. Otherwise I might have had a free weekend in Club Fed.
What about the 30.05 sign in black print with a clear background, and posted on a glass wall? It's hard to see.
Beautiful and Brilliant
Great info, thank y’all very much😁
Thanks for watching!
For the record. These people have an ulterior motive. The laws are available to everyone who wants to take a few minutes to read them.
I am a LONGTIME Texas LTC and as a veteran it only cost me $20 to renew it every few years. I am among those who provide security for my Church.
Is the Concealed Handgun License the same as a License To Carry?
Great Information. Thank you two for sharing.
Follow the money!
