      @Aria I think everyone knows about that "thing called evidence". That doesn't mean there should be a statute of limitations on rape. Biological evidence can degrade or go missing in a murder and there's no limitation set for prosecution. You murder someone when you're 20 and and it can be proven when you're 60, they can still get your ass. Who is against that?

    • @themapoe
      @themapoe 5 років тому +54

       Damien Hollester That makes sense but there are other crimes that do not have a statute of limitations. It makes a lot of sense that lesser crimes like, say, shoplifting "go away" after a while, but sex crimes? No those need to be right up there with murder; especially when there's a child involved. Tbh I think the statute of limitations on sex crimes has more with our "holier than thou" morals and is a way to shame people for being dirty. The speedy trial clause is just a convenient way to justify it; kind of like how people justify discrimination with freedom of religion.

    • @damienhollester1006
      @damienhollester1006 5 років тому +7

      Mapos Sims: Thanks for the comment. The statute of limitations is required by the constitution speedy trial clause however they're some exceptions. For example the time does not run whenever the fugitive is concealing himself. The time does run when a suspect is known and law enforcement fails to make an arrest during that period of time. The only exceptions to this are murder and fraud. In a fraud case the time begins to run once the crime is discovered. Nevada was the last state to eliminate a limitation for murder. In other words, cops must do whatever is possible to progress the investigation and can't just shelve it and do nothing until years later.

      I agree it must have been and still must be so very hard for his father and yet when you have children decisions always have to be made of what they can and cannot do and not all but some fathers are more okay with their children going a little further than mothers because us mothers do tend to err on the side of caution and not think our children are old enough to do this or that.

      I understand emotions and thoughts of revenge, I have them too. I'd just like to point out that we should break the chain of violence. Obviously, first of all, we need to educate our society about violence, abuse, what it is, what it cause, what to do when it happens. I just think it's not the answer. It won't get this little boy's life back.
      Also, we need to spread awareness about pedophilia. In some countries in Europe there are actually ads like "if you as an adult feel sexually attracted to kids, please, seek help" and there's an anonymous line one could call, they have programs, treatments. There is research that shows pedophiles after therapy understand that it's hurting kids, and although they still feel sexual attraction to children, they learnt coping mechanism, and make a concious decision NOT TO ACT on their urge.

    Thank You for sharing Jacob’s story. As a Minnesotan many of our childhoods changed that night. I was 9 & remember it so very well. That night innocence was lost for all Minnesota children. The feeling of safety in small towns all over my state was taken with that sweet little boy. I remember looking for him everywhere. My cousins were neighbors of the wetterling family & I’ve had the blessing to meet Patty. That woman’s strength & resilience is truly inspiring. She waited 27 years for her little boy to come home. She left the front light on EVERY SINGLE NIGHT FOR 27 YEARS. Resonate on that for a moment. 27 YEARS..What a heartbreaking thought. Patty has become a warrior for other missing & exploited children. She’s used her tragedy to help others. She took her brokenness & made it a blessing for so many. Even though she lived a personal hell daily. I truly appreciate you honoring Jacob by sharing his story. His legacy will live on by people like you Kendall. Blessings & Love. 💛

And my whole family went to help in the search. And I remember breaking down and crying as Patty stood in front of the crowd of people there to help and her thanking us all. I can’t imagine having to carry on after she lost her son. And how tough it was to walk by his room or look in the hamper and seeing his dirty clothes or seeing his dirty sneakers or his toys or favorite ball cap. He wasn't charged with the murder because Jacob's family chose to know where his body was buried instead. I don't think people realize how much impact the victims have in the justice system. If the victims/families say no to a plea deal, the prosecutor won't go ahead with it. This isn't the state attorney's decision, it's the family's decision. I'm sure the family just wanted to avoid a trial and reliving their worst nightmare.

      Judges can reject plea agreements, but then the plea would be withdrawn. I'm not really sure what would happen in this case if that were to happen. Defense could easily argue that they can't use the body/plea as evidence in trial since that was all obtained in a plea agreement. Also, he wasn't formally charged with murder so a judge probably would not have even known at the time of sentencing that he confessed, since judges are supposed to be neutral on all cases.

It's either go to trial with minimal evidence and no body and endure all that pain and heartache again, OR have him show where the body is, but not charge him with murder, yet he still goes to prison for 20 years where he will likely die. The family probably just wants to put this to rest after 27 years. They don't want to relive their nightmare. They don't want to risk an acquittal. This way it is a win/win situation. I was 9 living in MN when he went missing. I remember when this happened so vividly. It rocked the whole state. Everyone around including my parents suddenly became overly protective of their kids overnight. The schools went nuts with stranger danger. I had the pleasure of meeting his mother. What a strong loving wonderful woman! I am so happy she, her family and MN finally got closure.

      Basically Olivia I think when a family goes through a tragedy like that, there’s a general understanding that you do NOT blame the father for this. It’s not like he was allowing his children to be in genuine danger when his mother knew best, they were just going to the store.

      I'm sure in the beginning it was hard. They probably did fight when it happened, after a few days of realizing he wasn't just going to easily be found in someone's home down the street. But in these situations, you need all the love and support you can get, so holding that resentment in your heart does nothing but give you even more pain to bear. I'm sure the father lives with the painful thought that maybe if he said no this wouldn't have happened, just like how the boys with jacob that night still wonder why the killer took him and not them. it's natural to do that, we all wish we could go back and change things we regret even on minor scale. i think they've just learned not to let the pain tear them apart, because it's enough losing one precious member of the family and they don't need to lose more because they're arguing about regrets and things that cant be fixed anymore.

    • @ellespoonies
      @ellespoonies 6 років тому +8

      when my godfather passed, very unexpectedly from a heart attack while driving to the airport, a lot of his family almost took sides. our side, his side, his mother and siblings, for a while really weren't pleased with his wife. partly for how she and her family behaved when he passed (ill spare you the details, but to give you the idea she literally told his mother she didnt have the right to grieve him.) and generally because she didn't treat him the best when he was living and we all knew he was so overworked and who knows if he would be here now if she had just let him relax a little. but, ultimately, it's our side of the family who's handling his death best and not losing ourselves to the grief, because we know how to make light of bad situations and not to dwell on the negative that we can't change when theres so much positive. so, my point is, yes they probably did fight and probably do feel bad, but sometimes you gotta push away the "you shouldve" and "i wish" and instead remember the good things you did together and remember the person not how they left the world but how they made a mark on it.
