Thank you for this! I moved from FL to PA and need to update my LLC address. Would I register my LLC as a foreign entity in PA first? or submit this form first? Thanks in advance!
I'm not sure whether one or the other needs to be done first--this appears to be a legal question, which I cannot answer. However, I don't believe that it would hurt to update your address with the IRS if your LLC already has your old (Florida) address in your tax record.
If I am changing my business location and mailing address to the same location which is new, would I check boxes 1 and 3? And if I check those boxes, would I still be able to take my home office expense as normally on my schedule C, even if my business address is not the same as my home? To elaborate, I am thinking I need to update my business address to my new virtual office address (which will also be my new mailing address), but I work out of my home. So I am doing this to keep my home address private, but my concern is that this change would affect my home office deduction. I hope I made this question clear. I will also be updating my name to my new married name. Is this necessary? Thank you!
I'm sorry that I didn't see this earlier. You should be able to check both boxes 1 and 3. If you have legitimate home office expenses, you might be able to claim a home office deduction, but it will be tough. According to the IRS, your home office must be the primary place of business, which you're indicating that it's not. But if you are using a virtual office address (as many businesses do), then you should be able to justify it when audited. At the end of the day, it seems that you have a decent understanding of the impact caused by your filing Form 8822-B. As long as you feel like you can walk an auditor through your process, and if you believe that your auditor would still credit you with your home office use, then I don't see a problem with you doing this. You should update your name to your married name, as this should be irrelevant.
I sold my single member LLC and I believe this form needs to be sent to the IRS with the new owner as the responsible party. Do I sign it or does the new owner sign it. Thanks
Thank you for the video! If I want to send a W9 to my clients with a PO BOX address as I am a service based business and I dont want do disclose my residence address for privacy reasons, what should I do? Should I use PO Box address in 6, but the actual address in 7, and fill out W9 using a PO Box address? Thanks in advance.
According to the form instructions, you're supposed to enter your PO box number instead of your street address only if your post office does not deliver mail to your street address. There are probably low-cost ways to get around this. You could also call the IRS to discuss your situation to see if there's different guidance. Or you could actually try it and see what happens (although I can't actually recommend it). If I were in your situation, I'd probably call the IRS to see if I could use the PO Box address for the W-9 without having to complete IRS Form 8822-B.
You would check the the boxes related to the types of tax return your business files. For most businesses, that would be at least Box 1, but you need to look at whether Box 2 also applies.
I run my own business through my home. Do I have to list my home address as the business location and have the PO Box as my mailing address or can I use the PO Box as business location and mailing address?
IRS Form 8822-B or IRS Form 8822 should update the address for the tax record associated with the taxpayer identification number: www.irs.gov/faqs/irs-procedures/address-changes/address-changes. There is no official 'W-9' address that also needs to be updated. However, it does take about 4-6 weeks (according to the IRS) for the changes to be made. You can also change your address over the phone (see above link for details), if you need this to post sooner.
