If you pay attention to pop culture at all you have probably heard of Scandoval, the cheating scandal that rocked the Bravoverse. Tom Sandoval and Ariana Madix were in a 10-plus-year partnership, co-owned a home (subject of another lawsuit), and shared their relationship on the show Vanderpump Rules. Fellow VPR cast member Rachel Leviss started a 7-month-long affair with Tom Sandoval in the summer of 2022, until Ariana discovered it in March 2023. How Ariana discovered the affair is the subject of a new lawsuit filed by Rachel against Ariana and Tom. The suit lashes out at Bravo, Lisa Vanderpump, fellow cast members, and more. Rachel is being made out to be this young nieve child. Wasn't she 28? She fully participated in the affair. It lasted 7 months and continued after they were found out. She lived in the vanderpump world for several years before this happened. What if anything does the fallout of HER compliant affair have to di with this lawsuit ?
Had Ariana not sent the video to herself then to Rachel essentially saying your caught Tom and Rachel would have denied it! Look at the reunion and how much they were lying. I think Ariana sent the video to herself so she had the proof and I think a lot of people would have done the same in her position.
This is the sad part for Ariana. Sandoval would have made her and everyone else believe Ariana was lying. It would totally have become a he said, she said.

I'm wondering if this is her way of "getting my story out" - it may be that her contract with Bravo prevents her from suing them, so this is her way of being able to talk about her perception of their abuse of her. Would be great if we could see what they actually sign when they join Bravo...
May I add to this. The fact she’s made these things public means that she can talk about it more on her podcast too. We all need to remember who’s backing her, Bethany Frankle. This manoeuvring has her sniff all over it.
@@kerrivandenberg7469 yeah, this has Bethany all over it, and it’s just like Rachel to be bullied by another strong personality, I am sure she didn’t even want to do this lawsuit, but Bethany pushed her right into it, you deserve it, you deserve to get paid, all the things that they described that ruined her life. Have nothing to do with that video, they have to do that the fact that she was sleeping with Tom and that was one of her friends, so, even if she wins, I can’t imagine there would be a large payout, as that wasn’t the crux of the problem
She was given opportunities at the end of last season to tell the truth. She lied at the reunion and then told a different story in her final interivew. At the time we all assumed it was the truth, but she has since gone on to change her story of what happened with the affair at least 2 more times. She also turned down the chance to go back to the show and hash it out with the rest of the cast and potentially redeem herself. The only person from the VPR world she has not blocked and is currently speaking to is Peter, who is the only long term cast member not to return this season (because they didn't have money in the budget for him). She doesn't want to tell the truth-she wants fame, but on her terms.
This reads just as a lawsuit fuled by Bethanny on behalf of Rachel, althought Bethanny admitted she NEVER WATCHED A SINGLE EPISODE!
I think the lesson to be learned here is don’t cheat with your best friends significant other

Rachel could have turned all this around by turning on Tom. She had bad advice & she made all those choices herself. We all watched her do all these things the whole season. Sounds like Bethenny Frankel.
Thing is, she couldn’t do as much without Ariana included. I also think she’s going to attempt to add bravo as a doe after discovery. I’m glad I’m not the only one seeing Bethany frankle all over this.
Regarding the video, Tom and Ariana are in the wrong morally & by the sounds of it legally. Ariana, along with the cast & Bravo took the story to a place it didn’t have to go (& they are still doing it). That reunion was terrible to watch. Having threats, abuse ect hurled at her by Ariana( & those on her side)on top being terrified that porn video could be leaked would have been a lot. I wonder too why Bravo is not named?
@@kerrivandenberg7469 discovery won't show any link with the video. maybe a little about how great will be be for story line. in the end though, she went along with it and didn't walk off, which she should have. she is an adult responsible for her acts. the humiliation came because she stayed and endured it at her choice.
@@kyliem6358 regarding your first point-Tom should absolutely 100% have charges pressed for recording wihtout consent. Not revenge porn. The only evidence against Arianna in all this that allegedly exists, is said to exist by Raquel, the woman who masqueraded as Arianna's good friend while having a 7 month affair with her life partner. This same woman has also changed her version of events at least 2 times just since the post reunion interview she did with production. She also waited until the day before statute of limitations ran out to actually file this lawsuit.
Regarding the reunion-considering everyone had just found out about the affair and deception 2 or 3 weeks prior, the wounds were still very very fresh. Nobody threatened Raquel with anything more than never speaking to her again. If you are concerned about porn videos being leaked, don't make them. Don't do that stuff on camera if you want to avoid all possibilities of someone else seeing it.
I don't think she has the financial resources to take on a tv network and she certainly doesn't have a strong enough case against them for anything to make it to court. She is no victim, she is a predator. What kind of person files frivilous lawsuits against the ir former friend who was also the life partner of the man they'd had a secret relationship with?
It must be the lawyer's choice at this time. They must think they can sue Bravo at a later date if this case is successful.
This is so gross. Suing the person that has worked so hard to get past the heartbreak. There was no revenge involved.. I just can't get over how Ariana got cheated on by the two lamest people ever in the world.

Rachel is scrappy with the way still intentionally acted, but if Scandavol lied to her and used her and Ariana actually pulled this revenge porn shot, even if it was taking that video unethically, then she is acting just as bad as Rachel, but in that respect only. Rachel may have caused harm to Ariana, but she's also receiving far more crap than Tom, the source of the affair, and I hate that the men get off scott free

I can’t get past Rachael not taking any accountability. Bethenny really trained Rachel in this, imo.
This lawyer has a major problem: Civil Code 1708.85 section c states very clearly that no liability shall be on the person distributing material under any (not all or in part or combination) of the following...(6) The distributed material was previously distributed by another person, unless the plaintiff served on the defendant, by certified mail, a notice to cease distribution of the material, and the defendant failed to cease distribution within 20 days of receiving the notice.
Her previous lawyer SENT cease & desists. It appears a lot of the cast replied to said letters complying with it - including Ariana.
If I'm reading this right, Ariana is going to quash the shit out of this.
I believe this would apply more to the cast - they had 20 days to reply. Ariana would be the person who initially "previously distributed".

The reality is Arianna had the potential belief that this was filmed with the agreement of Tom, then she only sent it to herself and to Rachel after the cease-and-desist Ariana never goes back to the video as far as we know. So I think all of these words it’s a big nothing burger. And is disgusting as I think what Tom did was, if true the reality is this video did not cost her anything as far as her reputation her job, her financial prospects, it was her behavior, and having an affair with this man for seven months, and being very close friends with his current person and choosing to be on a reality show at the same time that you’re committing these reckless acts

the real problem is that it wasn't distributed much, if at all. Tom didn't. Ariana stole it from his phone. Ariana showed it perhaps but did not distribute. so the legal issue is whether showing = distributing
What Racheal did was horrible but the way she was treated by cast, production and Bravo was over the top excesses. The way she was treated at the reunion alone was unjustified, she didn’t kill anyone. The Vanderpump cast won’t be happy until they have blood on their hands.
So true. When you break it down, it's actually just natural human behaviour. I'm not saying it's ok, but it's a fact it happens and monogamy is very unrealistic in many cases, it doesn't make you the bad, horrible person they tried to make her out to be. They're all capable of it and have done very similar things. It's life. She didn't commit a crime for ffs sake. It's actually ridiculous how they've all reacted. These things happen. I’ve never seen the show and know nothing about it outside of this lawsuit, here are my unbiased thoughts: Tom is disgusting and should go to jail if what Rachel is saying about the covert videos is true. Rachel is also disgusting for sleeping with a man that she knows is in a committed relationship with her friend (idc what Tom said about their relationship to her, Rachel knew they weren’t broken up yet and this would be a big deal if it became public), and to then SUE the woman you f***ed over who COULD have been awful and leaked the videos online but chose not to???? Gross. Now she’s making herself the victim because she doesn’t like the consequences of her actions. Not saying it hasn’t been traumatic for her, but she made that bed, whilst she was on REALITY TV SHOW no less!! She knew what she was doing, she just didn’t think it would blow up this way. I don’t feel bad for her one bit in this situation except for the videos being taken without her knowledge if that’s true.

Rachel publicly said she received mental health treatment because of her actions and choices in men. If she is saying this publicly then can she now say it was because of emotional distress? Rachel was still talking to Tom when she checked in for treatment which clearly shows it wasn’t because of Tom
Yes. Also wasn't she planning to enter treatment when the season ended before Scandoval broke? So much has happened this past year but I feel like she said that in the reunion.
@@leluseven I just rewatched the reunion this weekend-she 100% said in the reunion she was already getting help. She has since said she left her treatment center to attend the reunion, she has also since said she sought treatment only after the reunion due to its toxicity.....she doesn't seem to know how to tell a story and stick to it!!!
I would say the fact she stopped talking to him during treatment would actually support the claim that it was due to her bad mental health, and Tom was causing it. Hence the therapist convincing her to stop talking to him.
@@tracim3080 Tom Sandoval is a menace and she definitely made a good decision cutting off contact with him. I'm just pointing out that she can be inconsistent when explaining timelines and her motivations. Rachel isn't a strong communicator and her speech pattern is a little stilted. So this could just be her own difficulty telling her story. But she's about to go up against people who are paid to talk and tell stories. Also her last podcast episode was wild. She just doesn't seem to be healing from this and seems like she has a lot of scores to settle. Fair, but if that's the case and she wants to get back into the fray, go back to VPR. It's hard because she seems to both want to move on, but also want to get the last word with the cast and unfortunately she can't have both.

I understand the two things can both be true. Ariana can have trauma and Rachel can also experience trauma. The exposure of her affair with Tom and the fallout can be traumatizing for Rachel. However, I struggle with feeling sympathy about all of these negative outcomes that Rachel is suffering.
The type of betrayal that Ariana experienced has shown to result in legit PTSD that will affect them for the rest of their life.
If I’m going to put my energy towards feeling sorry for someone suffering lifelong effects from Scandoval then I’m more inclined to do so for Ariana.
I should be able to feel sorry for both of them, and maybe I’ll get there. But I’m not there yet. Ariana had no agency in the affair. She had her parts in her imperfect relationship, but Tom and Rachel choosing to cheat and lie for months is all on them. Rachel played a stupid game and she won stupid prizes.
On the other hand, Ariana and Tom spent months lying to Kristen when the two of them started having an affair so I have trouble feeling sympathy for Ariana...

This filing seems like Rachel taking her opportunity to get “her side of the story” out. There was no need to include information about everybody when they weren’t being sued. And also, her opportunity to make up the money Bravo wasn’t willing to pay her to come back.

I do have one question.
Could Ariana’s lawyers argue that it was infact not the act of revenge porn that affected her mental state/suffering/career interference, but the act of her having the affair in the first place? That the fact that the video was barely mentioned, more likened to how people found out, is what besmirched her reputation, not the actual act she performed in the video?
Because she did not create backlash because she had a video depicting sexual acts disseminated, it was the fact that video was evidence of who she was commiting those acts with.
Summarised, the outrage wasn’t because of the physical act in the video, but the implications of who the video was in the hands of.
If this lawsuit goes nowhere, Racheal got her story out. Should have written a book to tell her side. She would have at least received some money.
If she was so injured and humiliatde why did she negotiate for a lot of $$ to return, and fial to return only because she couldn't get the amount she wanted? Odd to battle to return to the scene of the crime, sint it?
Question: Why, since we put so many details about so many people other than Sandoval and Madix, aren't we also using Bravo, Evolution, Cohen, producers, production, and every cast member mentioned? If we aren't using them, then why put so much about so many in the lawsuit? This doesn't pass the sniff test to me... Help, Emily?!
Litigation privilege - you can’t be sued for statements made in a lawsuit even if they later prove to be demonstrably false. The idea is that people shouldn’t feel hampered to state their point-of-view and premise for the suit. Bethany’s*, er Rachel’s 😉 , truly shady lawyers are using this privilege to air all of Rachel’s grievances with production and the cast even though they are essentially irrelevant to the complaint.
*Bethany Frankel pitched a couple of reality shows to Bravo in 2022 or 23 and was rejected. She then started this “reality reckoning” about how Bravo does everyone dirty. Some points seem valid, others not so much. Bethany herself is no champion of the underdog, no matter how she tries to spin it. These lawyers are first and foremost hers and the points made in this lawsuit are definitely part of that agenda.

There is a lot of lawsuits pending in the bravo universe at the moment, and Bethenny Frankel seems to be leading the charge. I think they all might be a bit of a fishing expedition and Bravo is the big fish they want to go after in the end.

This is all a hot mess. I get it. She slept with a man in a relationship. I thought that’s how Arianna got Tom as well. He was with someone else. Why is the female in this getting ALL the flack? I think this lawsuit is so her lawyer could lay the groundwork for his other lawsuit. I really hope they aren’t taking advantage of her. I hope she gets the help she needs and comes out the other side a stronger, healthier person.

Arianna should be left out of it and go after Tom IF it was without her knowledge. As much of a douche canoe Tom is, I need the proof on that. Regarding article 39. Rachel had three chances to clear her story. The reunion itself, the private sit down with Andy and the sit down with production. Each time she made it clear she was still protecting Sandoval and refused to tell the entire story.
I think rachel definitely has a case here. She suffered irreparable damages. Dunno if she should sue ariana and tom rather she should be suing the show as a whole

I agree. But two things can be true, Rachael can be violated and have done some truely horrible things. Just because an illegal act was committed against her, does absolve her from the consequences of her previous actions. She made choices that, separate from the illegal act (Sandoval recording), the viewership want her held accountable for, that’s the part she dislikes.
I wonder from a legal standpoint if Ariana’s lawyer could argue that her pain and suffering/interference with income, actually came directly from the cheating not the act of release of revenge porn.
Perhaps Bravo’s contract with Rachel requires that all disputes be resolved via binding arbitration, and that’s why Bravo is not a named defendant.
She has continued to fuck up the situation as bad as you could every step along the way. There were so many better ways to go about redeeming yourself, I can’t imagine that suing the person you screwed over, is going to go well to redeem her reputation.

Also, your comment is really insensitive to people who stay in abusive relationships. Just because you stay, doesn’t mean you deserve what happens to you. It was other people who made that decision, to record her illegally and illegally distribute the content. and with the public backlash at the time, and the over month stay at the hospital, as well as the time that’s passed, I can see why she’s pursuing a lawsuit now. Why? Bc what happened to her was still a crime. She can pursue criminal charges if she wants, so they’re getting off easy in my opinion. I know it’s hard for some people to understand that their emotions don’t dictate existing laws, but it doesn’t. Does she have a case that will succeed? Who knows. If she hadn’t given consent for the video, why was she so affectionate and even embracing Tom in a late episode and why not have been mad about it at the Reunion!!! If Arianna sent her the video that night at WWHL she would have known right away that Tom had done it without her consent.
I think this might be a clarification on how Bravo is not taking any responsibility for their part on encouraging cast members to physically and mentally abuse another cast member. It is not acceptable.

Under the law, Ariana didn’t have to know that Rachel didn’t consent to the recording, she just had to have known or should have known that Rachel expected it to be private. So, even if Rachel had agreed to being recorded it still could be considered revenge porn if, having found it on Tom’s phone, Arian should have known that Rachel didn’t intend for anyone besides Tom to see it.
I hope she takes everything away from Ariana if you look at the seasons Ariana has changed she’s spiteful so I believe she did send it to be revengeful and to mock what Rachel did to her and you know what Ariana is no Saint
I don’t think I’ve ever seen this level of scurrilous and baseless allegations in a complaint against so many non parties to the lawsuit! It sort of dilutes any potential legitimate claims.

There are some cases and actions that are considered public/damaging enough even if they don't involve numerous people. Sometimes it's enough for just one other person to have heard or seen something for it to be considered public or damaging.
Emily has mentioned certain types of defamation count as this because the things said can be so damaging that it's then considered still defamation even if only one person hears it. I believe this would fall under this category but of course, we'll find out what the court rules.

In my opinion, NBC Universal, Bravo, the Production company and Sandoval should be the focus of this lawsuit. Things need to change in the way people are treated in the reality TV space. Personally, I believe they were held up to public scrutiny for two different reasons. Tom, because he's always the good guy, always there in a person's time of need because he loves being seen as the savior.

Can Rachel have an expectation of privacy from Tom's phone? In her argument that Ariana knew about the affair, why would Rachel expect that Ariana didn't have access to Tom's phone?

I started watching Vanderpump when my pop culture friend couldn’t stop talking about the legal drama.
What gets me is that all of these people have cheated including Ariana when Tom dated Kristen and NONE of them got this kind of heat this is just sickening to me all of them need help with their mental health not rewarded for their behavior.

Jax hooked up with kristen and a bunch of others while in several relationships. Tom schwartz also had other woman when with Katie. Then james hooked up with kristen in Tom's apartment. Scheana hookeded up with a married man. They are all guilty. Except Katie
