REAL STUFF: I am a client of Pyross & Serres my lawyer was Mr. Serres. After a couple of years of getting disability checks I asked for my case to be settled. As soon as the insurance carrier would agree to a settlement they would move my case to another insurance company. It took years and a lot of frustration for me and Mr. Serres but he was persistent and never gave up on my case. End result I was awarded a settlement. Great person and lawyer! I highly recommend them.
You only spoke on the income side of it. What about the medical side of section 32. For example i have medical for life but they are trying to settle it. My attorney doesn’t care he says it’s whatever I want to do. I feel so stuck!
My case was settled received a lump sum with open medical treatment. (Section 32). 4 years have passed now i need another lumbar surgery. It was deny and they dont even want to pay for an MRI bill. What should i do?
My attorney said that what we would do would be a finding and not a settlement but he told me that if I took the lump sum that it could be left open for medical treatment. Is that possible? He told me that if I do the partial disability that then I wouldn’t have access to ongoing medical treatment
In a nys workers comp case the lawyer does not have access to client funds. The money the client is due is paid directly to the client from the insurance company.
There may be liens asserted against your settlement proceeds such a child support. These liens are typically addressed by the Workers' Compensation Board when it considers approval of the Section 32 settlement.

Great video but my question is after that 10 day waiting period does it take an additional 30 days to get your settlement check?
In my scenario the board takes its sweet time from the initial gearing date to send out the notice of approval.
Because that's what you want for after the 10 days. Then after the notice of approval you wait 10 days after that.
Nope it take a year after you see the judge and only your attorney can set that up for you.

Barbara Bolton there is no set amount if you closed your case prior to 2007. The only way to see what the Carrie twill settle for is to reach out to them. Cases after 2007 have a cap for example...a case may have a cap of 100k meaning you can’t not settle that case for a lump sum exceeding 100k.
If you have been classified as having a permanent partial disability, and you were injured before March 13, 2007, you are eligible to receive WC lost income benefits for the rest of your life. If you were injured on or after March 13, 2007, you are eligible to receive WC lost income benefits for a maximum period set forth in the law.

They make u watch the dum video that says 10 calendar days. But then they take 10 business days plus 3-4 more extra days so need to say 15 days instead of 10 before final approval

If I was receiving weekly benefits for carpal tunnel syndrome and my doctor says my impairment is 15% am I still entitled to a section 32
A section 32 settlement is by agreement and usually closes the case permanently . Closing the case with a schedule loss of use gives you the right to re open your case should your condition worsen. Most insurance carriers would prefer to close a case on a section 32 to prevent you from re opening the case.
If I was to receive a section 32 lump sum and then file for ssdi, does my settlement affect how much I receive from ssdi?
Hello Lino. Depending on how the Sect 32 settlement amount is "allocated" it may, or may not, affect the amount that you receive in SSD benefits. This is a case by case analysis and you should discuss this further with your attorney. Best, M. Serres
