My case was settled received a lump sum with open medical treatment. (Section 32). 4 years have passed now i need another lumbar surgery. It was deny and they dont even want to pay for an MRI bill. What should i do?

I went to court and they said they have survalence on me and they made 20 minutes of questioning me under oath. I should have stayed in my house I had 2 surgeries and I have to go through this. So much fear you try to think what did I do did I bring groceries in did I walk my dog did I bring garbage out. And I don’t get to view the tape until after I’m questioned. So unfair that I can’t look at it see what the issue is and think of any defense I may have for that. That’s all the insurance company has done is deny me medical treatment how to use my regular health insurance to pay for one of the operations deny the epidural injections. Thank God. I got good health insurance and try to get me kicked off. So if you have a truck accident at work, it’s like this Use a workhorse until he gets old and sick then bury him and buy a new workhorse so now I have to sit in fear into March to see what they got on me and it could be anything

Hello, having surgery will my settlement talks change? My injury was my forearm but my median nerve is infected by getting hit in forearm injury. This surgery is a need due oxygen in nerve an could infected my mobility, can become permanent

Hello got diagnosed with nerve damage neck, cubital tunnel syndrome, and got hit in forearm area. Can I get for body parts . Now with settlement talks can things change as my diagnosis has changed.

Hola buenas noches yo quisiera saber llevo 2 años q me accidente al año y medió aprobaron mi cirugia de cervical ahora sigo con mucho dolor de cabeza brazos y piernas ya estoy en terapias por la cirugia de la cervical ajora estoy pendiente de otra cirugia parte lumbar el doctor del seguro me dio una discapacidad de 75% y ahora el cheque q me llegaba cada 2 semanas me lo han bajado y ahora llega cada mes y menos del valor q tenia aun el cirujano no me da de alta el dice q mi discapacidad es del 100% pero aun no me resuelven nada q debo hacer

Great video but my question is after that 10 day waiting period does it take an additional 30 days to get your settlement check? In my scenario the board takes its sweet time from the initial gearing date to send out the notice of approval. Because that's what you want for after the 10 days. Then after the notice of approval you wait 10 days after that.

Yall need to stop the 10 days waiting period lie... They make u watch the dum video that says 10 calendar days. But then they take 10 business days plus 3-4 more extra days so need to say 15 days instead of 10 before final approval

My attorney said that what we would do would be a finding and not a settlement but he told me that if I took the lump sum that it could be left open for medical treatment. Is that possible? He told me that if I do the partial disability that then I wouldn’t have access to ongoing medical treatment

You only spoke on the income side of it. What about the medical side of section 32. For example i have medical for life but they are trying to settle it. My attorney doesn’t care he says it’s whatever I want to do. I feel so stuck!

If I was to receive a section 32 lump sum and then file for ssdi, does my settlement affect how much I receive from ssdi?

In a nys workers comp case the lawyer does not have access to client funds. The money the client is due is paid directly to the client from the insurance company.

REAL STUFF: I am a client of Pyross & Serres my lawyer was Mr. Serres. After a couple of years of getting disability checks I asked for my case to be settled. As soon as the insurance carrier would agree to a settlement they would move my case to another insurance company. It took years and a lot of frustration for me and Mr. Serres but he was persistent and never gave up on my case. End result I was awarded a settlement. Great person and lawyer! I highly recommend them.
