      The hard man couldn't even get the saying correct. He wasn't for punching anyone, unless he had a team behind him. In fact I believe that if a person says something like that, they will never act on it. People who are decent and hard don't tell you their intentions, they just do it.

    The “threatening man” with the anger management problem is probably an ex-con. If he can verbally assault a harmless member of the public, one can only imagine what he’s like after several pints & a few lines of low grade White Horse 🤢

      This is just a clash of the classes. Just a pretty normal reaction in lower-class communities, and I have no doubt that he'll have said it before with positive results, i.e. influencing a retreat from the threat of violence. And DJ's response was a normal response from a "higher-class" (name it what you will), i.e. presuming the protection of the laws. These kind of interactions fascinate me at the psychological level.

      @@J2897Tutorials As a good friend of mine once said to me, the so-called working class are likely to throw a punch at you, whilst the so-called upper class are more likely to throw you a lawsuit (having the funds to determine the lay of the law beforehand ).
      One thing’s for certain: the British social uprising is looming ever closer into view & will most likely be triggered when a serious & more difficult downturn in the economy causes the government to loose control of the economy like a bumper car driver at the fairground, when significant swathes of the working classes lose their homes.
      I think that will certainly be one of the key triggers. It’ll be like ConAir on acid but on a national scale & minus The Happy Ending & more of the “why couldn’t you put the bunny back in the box?” Be seeing you 😉

      Where in CJA1988 is that?

    • @davelordy
      @davelordy Рік тому +5

      @@simonrichards150 Assault comes under three laws (might be more, but three main areas), offences against the person act (really old, must be early 1900s), the criminal justice act 1988 and the crime / disorder act 1998. So you'd have to search through each, but the wording varies from (paraphrasing) "any act which a person causes another to apprehend immediate unlawful violence" to "the use of threatening or abusive words or behaviour" . . . but wherever in UK law you find 'assault' you'll see it doesn't require actual physical assault (battery, in law), but merely the threat or fear of physical violence.

    • @simonrichards150
      @simonrichards150 Рік тому +4

      @@davelordy Yes, I'm aware of that - but just to point it out for the sake of accuracy, it doesn't feature in CJA1988 that "threatening words" constitutes assault. It is ultimately a common law offence and as such is defined via case law - there is no statutory definition. You would never, ever get a conviction of assault for the behaviour shown in this video.

    The offence of causing fear or provocation of violence (threatening behaviour) is an offence created by section 4 of the Public Order Act 1986 (POA 1986). The offence can only be tried summarily in the magistrates' court '

    I do wish people would stop calling those vehicles MOPEDS. They are not, they are Motor Scooters. A Moped by definition has a small, usually around 50cc and a pair of pedals which can be used to propel it if needed. A Motor Scooter will have a larger engine, 125cc to 175cc and no pedals, just like the Scooters in the video.

    Legal language games. "I'd like to see you try mate" is one of those phrases that don't do you any favours in court.
    "Bring it on" is even worse.
    Why? Because the other side are going to use that to paint a picture. You went there looking for trouble didn't you? You were trying to provoke violence weren't you? That was your plan from the start wasn't it? You wanted to provoke violence to earn more money from clicks and views didn't you? Well why else would you have said all that?
    Now of course it doesn't matter if nothing happens and the matter doesn't end up in any court for any reason. But it really matters if the guy does then come over and punch you.
    Consider some of the other things that could be said that could not be used against you by a snide barrister. Work over the different angles in your head. Game it like barristers do.

      Legal language games. The phrases are ambiguous. So meaning unclear so the reply is not tainted.

      Consider that the phrases can be heard on the video. A common sense hearing of them has no ambiguity.

      Did it occur to you that I might know through experience in court? And that it is you that has overreached?
      You have not shown that what is said in the video is in any way ambiguous. You are showing yourself in a bad light.
      Remember, the video is itself evidence that would be played in court. You saying all kinds of nonsense that contradicts what can be clearly heard and understood in context on the video would annoy the beak and sink you.
      Come up with more appropriate things for the person in DJ's position to say in those situations. Can you do better than DJ did here?

      You need to wake up and actually read what is written instead of what you think people are saying. I made it clear that statement is ambiguous, your begging to look at the vide means nothing to the fact the statement is still ambiguous.
      Before making a reply try actually replying to what is said, over your fweelings.
