He didn't understand what was asked, and if you give permission to search. ANY time during that search, you are legally allowed to say "i dont want you to search anymore" and they have to stop!!! They didnt have probable cause to search, cameras were there. I can say from living in el. El Paso they dont care about your rights unless a camera is on them. Ive been illegally stopped and searched for "speeding" with cruise control set on the limit lmao. I then told them even though I wasnt speeding;that still wouldnt constitute cause of a search. They got a dog and god mad he didnt hit. Lol. They get thirsty.

The cop was intentionally using tricky language in order to confuse the suspect into securing permission. Its a normal (and legal) thing that they do. Under pressure, its hard to get the response right, other than training yourself to say "I do NOT give consent".

The k-9 must've been on doggy vacation cuz usually when consent is refused the first thing they say is, " well I'm gonna run my dog around...blah blah blah" and invariably the dog makes a hit and "alerts" on something and bam nonconsent is trumped by probable cause.
It was determined by supreme court, the police can not lawfully make you wait for a police K9 to show up.
Most people are unaware and wait. However, you should bring it up and not just drive off. Even if the cop is in the wrong, about anything, you comply and take it to a judge.

That’s the first time I’ve ever seen an officer abide by someone not giving consent to search their possessions without calling a dog and automatically saying the dog alerted to them the presence of narcotics. Very surprised.
They can't call dogs unless there's a reasonable suspicion of a crime. No one looked high and he didn't give ID so a dog cannot be called.

I am sure it depends on the state but a lot of times if they are cooperative and have mostly a clean record sometimes cops will let them off easy.
j lara me and my partner were going to get something a couple towns over (we don’t have money) but our car isn’t legal no inspection no seatbelts it wasn’t registered the plates came back to a truck that we had gotten from some guy we didn’t know (bought it) so we get pulled over coming back from getting our stuff and this cop is really chill we had well over 500 dollars in citations we could’ve gotten and we only got a seatbelt ticket one not two just failure for driver to wear seatbelt. All after my partner complimented his car. Cops like people who compliment their cars.

most of the time people are committing actual crimes that would warrant a mandatory search , a traffic stop doesn't justify a search , she could of just said no and the whole situation would of just ended there and they would give the warning for the cited failure to make a proper stop at an intersection

The probable cause is there. Answering questions that were not asked, such as "the car is mine" and "I don't know him." The fact that she claimed to not know him throws up red flags all over the place dog. That right there is enough for probable cause. Giving someone you don't know a ride and offering up the information that you don't know him when you aren't even asked.
If I had to guess it was her dealer or a male prostitute. Since he had a backpack, I'm gonna go with a dealer.

I’ve been stationed at Ft. Bliss 3 times. I love and miss El Paso. Yes there are some bad people there but that’s with all cities. The good people greatly outweigh the bad though. Very friendly people live there.
