      If they don’t get your I.d. By illegally asking you then they ramp it up with the threat that your under arrest to get it because they know it’s not illegal to refuse, so strong arm tactics are used to force you to give it up, and you can’t sue them for false arrest because they have qualified immunity, you just can’t win with these clowns.
      Every cop should be required to take at least a couple of years of law classes before they even consider on being hired as a cop.

    I was napping in a mall parking lot with the car on waiting for my family to finish shopping. Cop knocks on the window and that freaks me out but he literally just asks if i'm okay cause someone was concerned. I told him I was fine and waiting on my family and he went about his day. That's how this should've gone.

      I've done this so many times too just waiting for family in the car. Give them a reasonable explanation which btw is just as good as plausible evidence and any reasonable cop which is most of my encounters will move on. Only once it happened where some rookies had forced themselves on to me to do a drug search. And even when they were in the wrong they would berate me. Those are the ones that need retraining or need out.

      that's a good portion of that blue Life In The Slammer. People say I've met some cool cops he could have taken me in or gave me a ticket or impounded my car.
      So it's cool if a cop uses officers discretion that they shouldn't have in the first place to decide when to do the job or not. If a cop is willing to do that he's willing to also abuse his position aswell. I've seen cops do things in front of a colleague and by the look on his face and his demeanor I could tell he was not for his fellow officers actions but his gang ties did not allow for him to intervene or speak upon the actions of the Bad cop.
      All good cop's know a bad cop and by doing nothing makes them all bad cop's. FTP i have no love or respect for a blue life they shatter more lives than they save escalating things like running a stop sign to dying checking to see if everything's fine to serving time healing mental illness with mental Stillness is the kind of fix pig's give.
      Look at the tools they equip guns full of lead in case someone needs dead batons to beat you until you're gone hand cuffs so victim's aren't so tough k9's with fire in the eyes and a mouth full of knives FTP. Now firefighters are good guys that save lives. EMT'S are tight they got it right and have the tools that save lives. FTP thank those other guys.

      If they were fired odds are another department would hire them. If she didn't settle and fought for criminal charges against these tyrants it would be a different story but very few people do this.
      Most settle the second they see a 6 digit figure.

      If they don't learn to completely separate wellness checks from investigations they're going to end up losing the 4th Amendment exceptions they've gained.
      If it's not in plain view during the period of your wellness check, than walk away. If you want to investigate something else, come back later.

      These cops were just threatening her with arrest but wouldn't actually arrest her for failure to ID. They illegally trespassed her and she refused to leave so they got her for trespassing to arrest her. Absolutely pathetic cops. This all happened because she didn't listen to their unlawful orders and it upset their huge egos.
      Really this interaction should have ended in 2 minutes. The 1st cop checking realized she is okay, they talk briefly, and he leaves.

    They did the same thing to my dad. Arrested him and took him to the station. Once they learned who he was, they were force to drop all charges. Why? Because he was NYPD and he said, you cannot ask for ID without reasonable suspicion of a crime.

      If only.
      Because they were on duty and acting within the color of the law, they have no personal responsibility. It will be the department that pays.
      HOWEVER, and the part I hate is we don't know the settlement. While I would have preferred they make a training issue of this incident to make every cop aware of what the Alabama ordinance actually states. Confidential settlements like this are always about filling their own pockets and not making long term corrections.

      I live near Guntersville and it is a very small, very poor, VERY conservative town that sits on a large TVA dam made lake of the same name so it relies on tourism, marina, and vacation dollars - and the people that live there don't take kindly to threats to their livelihood.
      If it got out that the city paid a 5, 6, or 7 figure settlement then that industry would be harmed from the negative press and EVERYONE in their city hall would be out of a job.
      Simply put - they settled out of court to save their ass.

      It allows a way for the extortion to take place. Because you are arrested rightfully or wrongfully if you want your freedom from your captors.
      You must post bond and if you don't pay it all at once even if the charges are dropped you will not get the money back.
      And the price is set high and most people cant afford to pay it all and are confused and overwhelmed and just want freed plus it's not disclosed that if you pay the percent you will not be reimbursed.

      The caller didn't give an actual time frame. The two hours statement came from the narrator of the video, and I can't find any evidence in any of the articles about this incident that suggest the caller indicated she'd been there for even two hours. The only audio that exists is the short snippet that is included in this video where she just says she's not sure if she's sleeping or if something is wrong with her. And none of the media reports or articles include anything about the caller citing a length of time that she'd been there.

      Ala. Code § 13A-11-9
      (a) A person commits the crime of loitering if he or she does any of the following:
      (1) Loiters, remains, or wanders about in a public place for the purpose of begging.
      (2) Loiters or remains in a public place for the purpose of gambling.
      (3) Loiters or remains in a public place for the purpose of engaging or soliciting another person to engage in prostitution or sodomy.
      (4) Being masked, loiters, remains, or congregates in a public place.
      (5) Loiters or remains in or about a school, college, or university building or grounds after having been told to leave by any authorized official of the school, college, or university, not having any reason or relationship involving custody of or responsibility for a pupil or any other specific, legitimate reason for being there, and not having written permission from a school, college or university administrator.
      (6) Loiters or remains in any transportation facility, unless specifically authorized to do so, for the purpose of soliciting or engaging in any business, trade, or commercial transactions involving the sale of merchandise or services.
      (7) Loiters or remains in any place with one or more persons for the purpose of unlawfully using or possessing a dangerous drug.
      So, as usual, these cops are full of shit.

      I have pulled over onto a side street from freeway at night. Safly off the road and not in a blind spot. Hazzard on. Officer woke me and told me to move on, there is a truck stop 10 miles down the road. I was traveling and unaware of the truck stop, but seriously! If I felt I could have driven another 10 miles without stopping I would have.
      Another time I was going through an unknown city and needed to stop (night again). There was a gas station. I parked out front, out of the way of any traffic and the pumps. Left car running and running lights on. Parked under a light. Officer again woke me and was checking for suspicious activity. Told me I couldn't park there and forced me to drive along.

But I went inside and bought something and asked the lady at the counter were could I take a quick nap with being a distraction. She pointed to a area and I was napping. Police showed up talking about I was trespassing and told him talk to the lady at the counter. He got in his car feeling stupid I'm sure and didn't have the balls to apologize for fucking with me. These idiots get a call and don't use common sense. I'm a truck driver and you are told if tired pull over and nap. So cop's are incorrect driving isn't their job so they don't know the laws on napping. They literally tried to get this lady to commit a crime to arrest her legally.
