      @@haconk It's amazing how high ranking LE can literally state on video that it's their policy to violate state or federal law. Earlier this week I watched a police chief admit that his officer committed a federal felony to city council and was completely unaware he did so. He said that he didn't even consider the complaint that was filed over the felony relevant to a civilian review board, since it didn't violate his agencies policy. Not only can he be ignorant of the law, he has to be. Ignorance of the law is required to keep his special protection under the law called qualified immunity. What should concern people is the fact they're starting to stand up like this chief is and defiantly declare they're going to behave this way and peons better accept it. This department isn't even ashamed enough to shut down FB comments like most do when exposed.

      Actually, they should have to prove that they were acting in the NORMAL, LEGAL, and PRUDENT execution of their duties. Failure to any of the three points when case law, civil law and Constitutional Law is known should be automatic loss of immunity. This should be the FIRST question before any court in any suit against actions by an officer. If Qualified immunity is not upheld, then awards should be several, an award against the juris and the officer separately. In itself, the question also answers the violation of rights in itself! This wills shorten the entire process of civil rights suits.
      So the question would be "if the officer did these things in this order under these circumstances WOULD it have been a violation of civil rights?" If yes, then immunity is GONE. Then the trial can go on. IF upheld the officer has no immunity. Also, the officer would not be able to be represented by the Juris attorney or would have to repay the juris attorney if the plaintiff wins the first question and the action against the officer and juris. In other words, the officers themselves would be liable for their actions under law and when violating known rights have no protection of their employer.

      No "GOOD" officer should want qualified immunity to stand. It makes them all look criminal.
      I was watching some of the QI hearings a few weeks ago. One lawyer for the police was adamant that QI should be granted because a suspect was slammed into a palm tree rather than a pine tree.

      Where the officer violated a constitutional right, the officers could lose their immunity in court. And, as the officer suggests, "qualified immunity is a helluva charge". South Georgia here suggesting Clayton County research the 3 cases referenced by The Civil Rights Lawyer before attempting another excuse about an arrogant officer.

      Listen there are some pretty bad cops out there I’ve experienced that first hand but let’s be real for a minute did the cops go about this in the wrong way? Yes. Were the cops wrong? No. Most people don’t even realize the little details of this situation because we are so quick to want to call out the cops. Because if you noticed the cops cops started out calm and respectful while following up on a legitimate suspicion right up until the individual got confrontational. You don’t get a pass on breaking the law just because a cop had a humanly response to being lied to. It’s quite simple if you are a law abiding citizen who cares about your safety and the safety of others then you shouldn’t have a problem with answering a fuckin question instead of being an asshole. I pick my battles and these 2 are criminals so fuck them

      So what is helluva charge.

      I would also add to that take away the B.A.R.'s ability to hear complaints against lawyers. They are policing themselves in the same manner as police do. We investigated ourselves and found no wrong. It is extremely difficult to get charges against a bad attorney because of the B.A.R.

      I am trying to fair. I usually am very critical of police. The obstruction thing is nonsense. You don't have to speak, 5th Amendment! Obstruction charges are secondary, a crutch, and usually wrong.
      That being said, did they use force? You are using assault and battery in the broadest terms! Any arrest would be assault and battery. The cops should be punished, but I think if they were arrested and charged for this, you would have a lot fewer cops. In many areas, that has become a problem!

    Piggy actually said "obstruction is a beautiful charge." on HIS OWN body camera. And he was itching to use violence, telling the other officer to let him enter the code and open the door just so he'd have an excuse to assault him. Tell us you're a sociopath without telling us you're a sociopath. I think somebody needs to lay off the steriods. And when he asks why the victim is being so hostile, then immediately threatens to assault him... is he high? He's gotta be high, nobody can be that stupid and still manage to tie his boot laces. Did anybody check if he's wearing velcro? For his own safety, he should wear a helmet, if he's actually that dumb.

      I disagree. Officers acting within their law enforcement limitations and without violating the rights of the person should be afforded the right to be proven guilty without presumption of guilt in the course of their lawful duties. Different opinion on a subject for another day.

    Problem is everyone they come in contact with is presumed guilty. Then they always get tunnel vision. That officer wanted to go hands on from the start. It’s obvious. He not only dared his victim under threat of violence. He perpetrated violence on that man. He has a massive power trip and should not be a law enforcement officer at all. However his employer will protect him and the others.

    And the mistake here was the two of them engaging with the police. When that cops left the back of the house, the old guy should have walked around to the front, used the code and went inside, locked the door and ignored the cops. But instead, HE TALKED to them. She did too.

    I can not comprehend how the first line of the Miranda Rights is "You have the right to remain silent" but when you refuse to answer the cop's question they try to charge you with obstruction. To me, telling someone they will be charged with obstruction has become a go to threat by police to try and scare people into giving up their rights.

    Let it be known folks, tyrants aren't the brightest. Notice how they focused almost entirely on why police were investigating the cars, while completely ignoring the clear as day constitutional implications of the arrest? Their arrogance is so profound they still don't understand that free citizens NEVER have to incriminate themselves. No one was obligated to answer their questions or help them conduct an investigation. The department is so high on their own supply they genuinely stand behind the conduct of the two most unprofessional officers on scene.     I remember in the early 2010s I went to my towns police department and asked for a way to get a copy of the current legal codes and laws to compare to 100 years earlier in the same area for a college paper. I was told there's no such thing. I asked him, "How do you know you're arresting someone correctly?" And was TOLD to leave.

    The police knew he wasn't involved. According to their narrative, a male transported several females to the victim's residence and it was the females who caused the damage. They knew who that unnamed male was as he is who directed them to the house with the car suspected of being involved. The male they went hands-on with obviously wasn't the male who directed them to the house. He's therefore not the male involved with the females who caused the property damage. His only connection to the incident would be coming around the house to see who is on the property.

    The police blew up any case they might have had.
    Without a warrant, they did a search “behind the house” to find the vehicle.
    They used that improperly obtained information to question and arrest a man for damages reportedly performed by women.
    They ignored (actually actively violated not just ignored) 4th, 5th, and 6th Amendment rights in making the arrest.
    This potential crime will not be properly resolved BECAUSE these officers think they are not required to follow the law.

    The citizen has no such duty to identify as the cop stated. How these guys become cops is just mind-blowing. That guy acted like he just left a gang meeting that put a hit out on the man. Just absolutely unbelievable that these cops do this stuff to people.

    I think the obstruction of justice code needs to be revised; the word "opposing" needs to be removed.

      I believe it's been ruled that obstruction is a physical act but cops always do this anyway.
      It's actually interfering that's a physical act I got mixed up.

      @kabby29 my bad I remembered wrong it's interfering that has been ruled a physical act and looked it up it depends what state obviously but yes giving a false name is called obstructing information I think it said so sorry I got my charges mixed up, but can I be blamed when there are just so so so so many charges that can be put on you for any little thing you do.

    Not sure if it's been mentioned yet or not but if you listen closely to the ponytail princess patrol she tells the man at the door "You Can Go Ahead" completely contradicting what her partner is saying so the gentleman attempts to head in the house when Blue Line Road Pirate Gang Member Snatches him up .... Sound familiar, got several different tyrants on scene shouting different orders then getting assaulted for having done so.
