  • There have been several cases of police nagging people in the name of investigation and lawyers are the only hope they have to run to when faced any such harassment from the police! No matter in which area of law you are, Criminal law will still be relevant to you and therefore, knowing how to deal with the police is crucial.
    Multiple instances will come where you have to deal with police like in white-collar crimes, in fraud cases, perjury, non-compliance, etc. Thus, projecting that you mean business and you can’t be taken for a ride in front of the police is of utmost importance.
    If you have this skill, you don’t have to be afraid of any kind of mistreatment from anyone, ever again because knowing how to tackle police and knowing how to seek the desired action from them can give you a gargantuan edge in personal as well as in your lawyer’s life. If you are a young lawyer, this skill is of utmost importance in order to make people take you seriously.

I agree your doubts are highly valuable as well, but asking your doubts mid-sentence breaks the flow of the story being told by Amish Sir.     Nice attempt but even after waiting for 2+ hours the discussion didn't come even close to the topic. What a advocate do in court is different but what expected from this topic is how an advocate handle the case in police station before it comes to the court for trial

    Police does a lot of drama when one goes to file FIR and will do their best to reduce the charges or not file an FIR at all if it is against a big person.
    Can one file and FIR online instead?
    Because usually whosoever files FIR first strengthens his case.

      Just teach your department that they clear a exam to get police job so don't act or behave like uneducated or 3 rd class department .. because the language of low levels constable low your department reputation so tell them to be in law n order.. because public is head of your department

    With due respect, I would like to mention my feed back here. I listened to the session for 1 hour, but still the conversation is going on regarding how our presentation should be in the courts in front of Magistrates. However, the title of the session says "How to deal with police as a lawyer?." The title gave me different expectation, but I did not feel that session is going in that way..

    My mother was murdered and I gave a written complaint against criminal but Fir was not registered. A lawyer went with me but didn't speak a single word at police station. A gave him his fee. Later on I came to know Lalita case FIR mandatory for cognizable offence. Lairs are lawyers and I am sure he has taken money from accused. If he would have argument at police station with SHO then my FIR would have been registered. I studied and from internet I came to know about cognizable offence and Lalita judgment. Third class professionals lawyers. Be away from 3 coats black, white and peti co-+@t . Lawyers, doctor and wom ----en

      If FIR not filed by police, u can file private complaint directly to magistrate.

      Morality issues. I myself refuse to accept Divorce cases and hardcore crimes.
      All the succesful criminal lawyers (the one that works for actual criminals and not accidental criminals) make a lot of Big money. But they have lot of health problems, have a disabled child, bedridden wife or some other Karma hitting them back in someway today or tomorrow.
      Blood money is always a curse.

    Sir, I had filed a consumer case in 2005 till date the lawyer is telling that the consumer forum is still doing the case (it was a car purchase case) should I believe him . What I can do please advice

      No, don't believe him. Consumer cases usually take 1-2 years to get decided by forum. Ask your advocate that you want to see all the case documents and want to go through your file. Ask your advocate's munshi to provide your file to you. You can even check the case status online / can ask court clerk as well. Begin with asking the next date of the case.

    Statutory provision and constitutional provision can't be mingled up...... In Jharkhand HC defects is pointed out for Sec.482 r/w Art.226...... reason may be that a constitutional jurisdiction could never be supplemented by statutory jurisdiction or vice-versa.

    It is most noticeable in every district level, police stop the passers-through police station, also towards the road to the hospital and even in front of court, police stops them to check up the DL and Rc other things. This is a kind of atrocity to the public to someone or somebody hurrying to relief for aggrieved impliedly or expressly. My question is what act has permitted to do such places and what act prohibits this kind of atrocities for the ambit of public welfare.

    What to do if a policeman files a false case against you and wants you join an investigation on a saturday afternoon on an election day on trumped up charge and you get bail when the judge checks out the video evidence. Can you complain to the State Police Commission?
