The moment the Police arrived He should have told them to leave the property and told them He was a Security agent for the Property.
Most people do not realize it but Security personnel have more Enforcement abilities than even the police in some instances. This scenario is one of those instances.
The Police must comply with the demands of Authorized Security Personnel to leave when they are directed to do so from private lands.
The only exception to this is if they have a warrant signed by a judge with a sworn affidavit attesting to their reason for such search warrant. Or something called the "plain view doctrine" which stipulates that the police may enter the property if they spot something that is illegal from off the property that is within view of the officers.
Since they could not verify simply by looking at his uniform if it was fake or not (they would have needed to investigate) it did not fall under the "plain view doctrine"

@B. Duello Wrong. He was trying to get paid as an off duty police officer performing security work for AEP. The only problem was that he worked for a shady company that bypassed the bonding process. He is not a sworn officer and so nobody would bond him. I bet he lied to his employer too and now they are in trouble, im sure. He was there to direct traffic for a few hours. He probably would've made a cool 200 bucks.

He remained free with that gun for a whole hour.
@Marcus P I think the argument is that if he is being detained (not arrested) he would be disarmed for officer safety. It seems strange to allow him to remain armed with a loaded pistol for so long while they conduct their investigation

@@mollycollins498 actually you're wrong to work in a state prison or jail you do have to be qualified and go through either correction officer training which is similar to the police department training and be certified to hold a gun as well as a taser you'll be tased and pepper sprayed in both trainings. I know this because I was a CO as well and I worked for a state prison The only time that May not be necessary is if it's a private prison or private jail but in this case it's a county jail because it was under the police departments control. Also with state prison if you work it for 2 years you can forgo going through the police department training and just transfer right over into the police department
