You are probably one of the most intelligent auditors that I watch, you always comply with just whats needed. Some viewers think auditors should get arrested every time they are being wronged with law enforcement but those viewers have probably never had any experience with the legal system.

Not true. I've had my share of police interactions from both sides of the law. So yes I have a rap sheet, we'll leave it at that. About a year ago I was arrested on a charge that I knew was wrong. When I got to court the special prosecutor was asking for 7.5 years federal. She tried to get me to take a plea for 2.5 years federal time. Told her they would be no plea deal lets get the trial stated. Judge came in heard her then my lawyer and dismissed the case. Sometimes when you are in the right you have to stand up fight no matter what happens. We all have rights..... use them or lose them

From the Florida anti-prowling statute section 2. “ No person shall be convicted of an offense under this section if… it appears at trial that the explanation given by the person is true and, if believed by the officer at the time, would have dispelled the alarm or immediate concern.”
Most of these cases it might still be an important and useful legal defense to actually try to dispel a cop’s suspicions. Jeff knows this which is why he usually explains he is a journalist, he’s conducting an investigation, he has no ill-will, not trying to conceal himself etc. It’s important to stay silent but there are actually a few statements you might want to make not to give up too much info that can be used against you but just to quickly show that you have no criminal intent.

I usually love Jeff's audits, but this one...not so much. 1) He never asked the tyrant what was improper about the way he backed up. 2) He never told the supervisor that the cop was lying and he had the proof on dash cam. 3) He surrendered his ID, which is all the tyrant really wanted, which is why Jeff never got ticketed for all of those alleged infractions. 4) There's no indication that Jeff followed up with a complaint. If I knew Jeff was going to fold, I wouldn't have watched the whole video. I'm still a fan because most of his audits are better than this one.

Erroneous OT not in order to get federal funding for more dum dum to be hired, more ammunition, more pistols, more rifles, more shotguns, more suppressors(why do pubic servants need suppressors?), more armored vehicles. If Jeff really did so many traffic infractions he’d definitely get a ticket for something but as the Sargent said they just want to id him and they’ll give him a verbal warning. With all the dashcam proof of the original officer lying to Jeff and his superior, that’s enough for a small lawsuit. Pulling over suspicious vehicles with fake probable cause just for identification is a serious 4th amendment violation and he just proved, so easily, that Jeff’s investigation was spot on.

    • @eshootziscrs2868
      @eshootziscrs2868 2 роки тому +4

Yep, actually it does and ( removed an errant the) it was. If you take a moment to read the loitering and prowling law you'll find cops can apply that almost anytime they want. Add in to that things like Kansas v Glover where SCOTUS ruled that even information about the registered owner is sufficient RAS to make a stop. The information need not even be particularized to the vehicle or the operator and still the court says, lawful stop based upon RAS.
As I recently explained to someone, you can study all the court cases you like and think you really know what RAS is but you don't.
RAS is whatever the officer thinks it is. Maybe someday down the road if you're arrested, killed or injured a judge might review the evidence and maybe find RAS or not. Until then, the stop is presumed lawful, you can tell by the overhead lights. Had Jeff tried driving away the cops definitely would have used force to stop him. They couldn't do that unless they were acting lawfully right? And shockingly an unlawful bullet from a cop is just as deadly as a lawful one. In fact courts have actually found in situations like this that the stop was unlawful but based on good faith and any resistance or subsequent charges were still valid because the person knew if was a cop and the person is bestowed with the authority to adjudicate or judge whether the stop was lawful or not. Probably a very good reason the constitution and the fourth amendment don't speak of a warrantless arrest, almost like it was intended that a judge review the cause prior to asserting force or causing harm. Unfortunately, we don't see to have the ability and technology they had 200 years ago to contact a judge and get a warrant. Instead we just give every individual officer more authority and more discretion than we give judges. Can you imagine this officer has to forward his dash cam and his statement to a judge before he could actually make this stop. Would his statement be the same as it was on camera? I think most judges would be very ticked off to have an officer like this blatantly regarding the court. But hey, they are allowed to lie, why would a citizen need the truth when it's just their life, liberty and property that are being threatened?
I think you watch Jeff's face and understand, he's thinking this all through, realizes it's probably likely he will be required to identify because of the prowling and loitering statute. Even just suspicion of the crime is enough to authorize a traffic stop which is lawful as long as the RAS is lawful. Unfortunately only a court can make that determination, until then the officer has essentially unlimited authority. He says RAS exist, who are we mere citizens to argue? It's a pretty crappy system we've allowed and there are so many laws like loitering that can be broad, vague and easily twisted to fit any circumstances. Best a person can do is refuse to identify, let them arrest you, tow and impound your car, lock you in jail overnight and force you to give them money to get out. Then you can argue in court, get the charges all dropped and only be out a few days and a few thousand dollars but at least you win.
The process is more punishment than the sentence sometimes and cops know it. Argue if you like, refuse if you like, it's pretty hard to actually win. Oh and who knows, after the charges get dropped, maybe in a year or two the city will offer a couple thousand dollars to settle if you sue. Really the best any of us can hope for is to just not get involved with police or government. Unfortunately that can be impossible.

So who's the leader of a country?
I'm sorry, you sent a one line reply asking a question about something as if you and I were just talking. Were we? Because I don't know the answer without more info.
Am I supposed to remember everything I've said in ever comment section for the last ten years? Or am I supposed to go back and read every comment I made in this thread?
The answer is most likely the USA since that's the country at topic. So which of us are you going to say is worse at communication. The person who can't grasp the context of a comment and needs to get it narrowed by country? The person who ask a question without a proper subject? Or the person who wrote things you can't comprehend?
See how that works for ya? No stupid questions, just stupid answers.
I'm joking with you mostly. I do seriously mean that if you are going to ask a question be complete. Tell me what you're talking about. I've replied to 8 replies in the last hour. Not on the same video same topic or same thread. What country am I talking about? Probably the US though it could be one of several depending on the comment. So give a guy something to work with unless you expect in going back to read comments just because you can't keep up.
Im guessing you didn't ask that question in a vacuum. There's more to it than that.
It seems most probably by the way you replied that you disagree with something.
If you want to discuss that something then simply state what it is and why you disagree, what your thoughts are and how you arrive at them. I'd you just want to argue, I'll set you up with others who want the same.
See, I'm going out on a limb here and using experience that tells me you weren't about to engage in a productive useful discussion but you are going to tell me I'm wrong, this is how it is and then not support your position with anything but rhetoric and emotion. Show me I'm wrong.
I'll look back at the thread and edit the country if necessary. I highly doubt it's necessary just as I highly doubt any reasonable person would have had that question after actually reading. But I'm often wrong, it's how I learn. You'd think I'd be a genius with so many lessons but, I'm slow.
And Van Man, I seriously mean no offense. I am messing with you, for reasons but I'm not mad or trying to make you mad, just wanted you to see how that reply looks to me. I'm talking about whatever countries in Uranus, wtf you think I'm talkin bout?

It's like dumb and plum, comb and bomb. I know, words can be difficult and tricky. Count of the country.
Would you hunt a punt as a runt around the front. Or is it frunt. Maybe just send a kite into flight without a fight or in spite as is your right Mr White from the height.
Roger target site in sight, bombs away, spirits aflight.

I love your style Jeff.. I'm going to see if I can get an on camera apology from Axel at the New Smyrna Beach brewing co tomorrow with a few of my students in Teacher training at the studio I work at across the street.. it's a lesson in Satya for them.. real life experience on what it's like to see if someone will admit they lied.. Axel, the manager, with his false report to the police that you were begging customers and harassing them was indeed false and could have gotten you killed and I am going to make sure he gets that through his "I'm afraid little brain".. it honestly disgusted me that they would call the cops on a guy for a sign that says God bless the homeless vets.. In my world, i would offer that person holding that sign a sandwich, not call men with guns to throw him in a fucking cage.. way to go authorities, you went a pissed off the yoga teachers of the world now.. Man, when you got the namaste lovin yoga teachers pissed at you, you have crossed a line! But to be fair, I'm sure Axel has already gotten the message and he doesn't deserve to be hassled in his place or work over & over. But the real teaching is to try to interrupt people's knee-jerk reaction to call men with HS educations & guns to come deal with non threatening & non violent situations. *They only make things worse for everyone.* As Axel can 100% attest because if those cops didn't screw it all up, we wouldn't know Axels name! The bad cops did that, not Jeff.

Axel is going to learn Satya today.. and I hope he calls the same cops on me.. I hope I have the opportunity to ask them how having a sign that says God bless the homeless vets is "baiting".. I want to ask him if I should worry about him slamming me on the ground because I won't give him my name or do what he says.. if more than 3 show up, I'll ask which one is the wife beater.. oh I got questions baby and they ain't gonna like it and I honestly don't care how any of them FEEL about it..

Correct me if I’m wrong but isn’t the driver in America? Doesn’t he have the right to free travel? Doesn’t he have the right to not answer questions? When did Suspicion become a crime & is it a felony or misdemeanor?
If & when you encounter law enforcement, always do the following: 1. Invoke your 1st, 4th, 5th and 6th amendment rights
    2. Never answer any questions without Your Lawyer present
    3. Confirm you are being detained and for what “CRIME” you’re suspected of committing
    4. When the copsplaining starts, request a supervisor
    5. Always record every interaction with law enforcement or city employees for posterity
    6. Remain calm & comply if things get physical. Remember you can win a court case on the side of the road
    7. Always get names & badge numbers of every officer on the scene for posterity
    8. Never go back & forth with law enforcement. The Supreme Court has ruled that officer’s can lie in the course of their duties.
    9. Whenever necessary, file complaints and lawsuits against tyrants. Attack the money & everyone will bow!
Hope these tips keep people safe! Never allow an officer that you pay to bully you out of your rights! Stand Firm On The Constitution!💯✌🏽
