That does not establish a precedent and then the cops can immediately go out and do the exact same thing again with their qualified immunity still in place. This part is speculation on my part, but I bet lawyers who will take up a case against a police department make their client sign an agreement that obligates the client to take a reasonable settlement. That way the lawyer can get paid as quickly as possible and doesn't have to worry about how a judge or jury who may be sympathetic to police will decide or the possibility of having to drag it out for years in appeals if they lose.

Are you on meth? A big payout will not stop them. The money does not come from the cops. The money comes from the taxpayer or the city's insurance policy that the taxpayers pay for. It will only stop when qualified immunity is outlawed, cities are barred from indemnifying the cops, and cops are required to pay for and maintain their own liability insurance. Just like any insurance policy, if the insurer has to pay out too many times the premium payments go up and you will eventually be uninsurable. Become uninsurable and you become unemployable as a cop. The dirty little secret that most don't know about is that even when qualified immunity has been stripped from a cop the vast majority of city's or the state that he works for will still cover the settlement or jury award. The taxpayer has to be completely taken out of the equation.

Actually you are required to know and obey the law no matter if you are an attorney or not. If you violate it, you go to jail. Cops are not required to know the law, even thought that's their job. If they violate it by wrongfully kidnapping you and imprisoning you, there is no penalty.

Are you on meth? A big payout will not stop them. The money does not come from the cops. The money comes from the taxpayer or the city's insurance policy that the taxpayers pay for. It will only stop when qualified immunity is outlawed, cities are barred from indemnifying the cops, and cops are required to pay for and maintain their own liability insurance. Just like any insurance policy, if the insurer has to pay out too many times the premium payments go up and you will eventually be uninsurable. Become uninsurable and you become unemployable as a cop.
The dirty little secret that most don't know about is that even when qualified immunity has been stripped from a cop the vast majority of city's or the state that he works for will still cover the settlement or jury award. The taxpayer has to be completely taken out of the equation.
