Again, I think Jennifer's take on the matter is so sound. She clearly has a good understanding of the balance between sharia, risk, reality on the ground, and tawakkul in Allah. Subhanallah!
This is a mockery of the religion . The niqabi says “I wanted an expensive breed cat.” Does she even know the practice of buying and selling cats was outlawed by the prophet pbuh. If you want to care for a cat , adopt one . There are so many that need a good home
In this day and age, I don’t think your complicating marriages by having prenups. With the feminist agenda and the woman taking half her husband’s wealth, I think it’s more important in this day and age to have a prenup.
You can also argue that men financially don't provide for their children after divorce. They only send a small amount of child maintenance which is nothing compared to the cost of their shelter, clothes, schooling etc.. should this also be included in the pre- nup? Would things not balance out to an extent?
I think if you are divorcee re-marrying and have children from previous marriage and considerable assets, it is natural to want to protect that for your children.
Jazakallah Khair for this conversation. Interestingly, upon much reflection, I think Desi's have better nailed this than others. The mahar may be low but the gifts for the woman are high. This way if the woman needs to return the mahar due to khula', she is returning back a low amount. My only qualm with gold is that I wish rather than gold it was £ gift, and I could've invested into Wahed or summa. The re-sale value of gold is rubbish. There's also maybe some unsaid expectation that the gold will be kept if all goes well to the next generation?
Thanks for the great content. I am a revert, my honest opinion is that Islamic divorce law leaves women vulnerable financially. In most cases women spend their lives looking after their families instead of pursuing careers. In the event that she wants to leave the marriage for any valid reason, or the husband decides to let her go, the woman is left with nothing, possibly with kids in tow. Just seems unbalanced.
Even after husband lets go of his wife, under islamic law he obligated to provide for his children. regardless they live with him or their Mother. secondly.. Allah has command man to give gift to women when u divorce her. women still can work, own business. But to take man wealth unjustly and forceing thru courts. is haraam
@farhan K wrong, mothers have rights over children but responsibility for child raising goes to the father. If they are over 7, then to the father and if younger than 7 to the mother but only if she remains unmarried.
It's good so that people don't renege on it and be unjust. The legal enforcement of it will help as deterrance esp. on popular issues like wealth during divorce or death of a spouse.
I don't actually know what Jennifer is talking about with natural separation, I've never heard of it and I've studied Islam and looked into marriage fiqh too. A pre-nup is allowed in the shariah so to me, it is tieing your camel to the needs of the time. The society we live in is not a safe one if marriage goes wrong.
I have my prenup with Allah. If hypothetically this or that etc I will be compensated for whatever anyone takes from me on the day of judgment. Either that or I will have something better as a reward for forgiving the person who took from me unjustly.
What Nusaiba is saying isn’t good. A divorcee lady is much supported in uk. Doesn’t she know this? Then why is she asking for a prenuptial when she knows the money of her husband is his.

Arent men are given custody of children, during a divorce, according to Islamic law?
@@Z901Z No. its what best inteterst of child.
As prophet mohammad said: mother has 3 times right over child than father.

@ZM-et7zt this is Hanafi mahab. In others child stays with mother unless she remaries.
