For what it's worth, Dangle also does not use footage for fear of this exact scenario. His podcast goes full slideshow city, tip-toeing through plays when they're recapping. I hate that the NHL can't turn to Hockey Psychology and just commission him to do his recaps for them, and grant him a bigger stage like their official channel/site. Especially when it comes to breaking down plays, he's transforming the original product in a legal sense, and doing incredible work when it comes to making this evolving game understandable - even for someone like me who's been watching for 30 years. Get with it, Gary. Let the content guys live. All they're doing is making people love your product.
Yeah, Steve dangle made the correct decision not to use any type of footage when covering the NHL in his Toronto Maple Leafs that being said, it is very difficult as a creator. When you take away the ability to use the NHL‘s footage, it makes the content a bit more dull, and that’s one of the reasons why I like to use the footage sure you can make nice commentaries or be on camera, but having the place shown on screen while you’re explaining them or talking about what happened the game is just a nice cherry on top and growing up on Sports Center, ESPN, where that was something you woke up to in the morning with a bowl of cereal or oatmeal that’s what I like to re-create with my videos personally so it sucks but I’ll just have to adjust with the rules and with the times
This is ridiculous. Those NHL videos are the types of videos that grow the game. Why can't Bettman see that? In fact Bettman should step down for this.
The video is definitely help grow awareness of the game, but unfortunately with these owners and the executives they don’t look at it that way they see it as people using their content to make money off of now I believe these videos fall underneath their use, but UA-cam, for whatever reason very rarely backs their creators. Sure, there is a content claiming system. You can dispute it, but having personally dealt with the copyright system on UA-cam, you can put a dispute in then they can say that your dispute has no merit and then you have to make another dispute and all this stuff going on for weeks and weeks. Ultimately, you’ll end up losing it and that’s a video you spent some time on now you’re not able to reap the benefits of your hard work
I understand the they have the right to defend their IP, but this feels more like an attack than a defense. Feels like they are getting just as bad as Nintendo.
I think there’s a difference between what they have a right to do and what is logical. As fans, we want the league to grow. We want the cap to increase so our favorite players can be signed. We want more teams because some of us don’t have a local team. In my opinion, the nhl hasn’t come up with a better strategy to expand viewership than independent content creators. So this is just another shitty thing fans have to deal with that actively impedes growth, and it’s getting so freaking frustrating. They change the winter classic to a time when most people are working and can’t watch, they blackout local games, they do ridiculous things with the schedule, they fine players for being honest. It’s just constant crap that makes it actively hard to be a fan. These content videos help us stay engaged and entertained AND recruit new fans. I’ve sent so many next man up videos that are hilarious to non fans and get them interested. The nhl doesn’t produce anything to replace that. So fine. They want to retain control over their footage and what not - then give fans a replacement. It’s like they are taking beer from the rinks because they don’t profit, but then won’t supply their own. The fans suffer from this bs and per usual, Gary must not give a shit. And maybe they’re the ones who need to adapt, not the creators. The FANS are crying out for independent content. A healthy business would find a way to give their customers what they want.
I don't think anyone is trying to say the NHL doesn't have the right to do this, just that they shouldn't be doing this. These guys videos are always posted at least hours after a game is finished if not days, like the weekly recaps. So it's not like any viewership is being taken from the NHL, because no one is going to watch these games once they are over. It would make sense if these channels were hosting watch parties where they were streaming the live games or doing play by play of the game. I would get the reason for hunting down that kind of content and shutting it down. But to give excellent and entertaining breakdowns of what's going on in the league helps many people, myself included, stay interested in hockey. Because due to a hectic daily life schedule I miss a week of games here and there and normally that would take my interest out of the season as it's hard to jump back in when you miss what has been going on. I have time to watch a 10 - 20 minute UA-cam video every week and it keeps me engaged. Taking that away is going to do nothing but harm to the NHL, even though they have the right to.
I don’t disagree, I believe the videos should fall under fair use. The problem is with the current system, it’s an uphill battle. I’d love for UA-cam to back their creators but I’d admittedly pessimistic regarding that
NHL complains about not increasing revenue yet does everything in their power to do things that decrease it. When will companies realize that they earn more money if they actually give a shit about their consumers
It’s not a good thing for them. As much as we hate Activision, they made the smart move to allow content creators to use gameplay footage in order to draw more attention to Call of Duty. Because of the popularity of UA-cam, Call of Duty was able to become the most popular video game of the 21st Century. That led to more sales and revenue for Activision. The NHL is the redheaded stepchild of North American pro sports. They need more attention on their product-which is the BEST product in NA team sports. This is a nose cut to spite the face.
@ You couldn’t be more wrong. CoD 4: Modern Warfare was popular in gaming circles but didn’t have commercial/crossover success. UA-camrs were promoting the game and growing to insane levels. WaW grew the playerbase a bit more. Modern Warfare 2 was heavily marketed by UA-camrs paid by Activision. Led to that game setting the then-record for fastest $1B in sales in the history of media/entertainment. The UA-camrs drove the popularity to the non-gamer. Myself and CaPTaiN PauL were heavily influenced by and a part of that marketing machine in that era. We know firsthand.
@Dr_Evil_Genius No. You are just clueless. You basically don't understand what you are talking about and think your ignorance is something more. CoD didn't have commercial success😂. How clueless can you be? CoD growth had nothing to do with UA-cam. From the first CoD on the series grew by selling games.
in next up man's case, it's not their right to claim footage they don't own, they claim the whole video when there's footage from leagues around the world not just the nhl
Agreed on that point, I’m mainly talking about the use of the NHL footage exclusively. If you have cut aways to on camera or graphics, it shouldn’t be claimed. But are we really surprised about the copy right system being used incorrectly? Shoot, I once got copy righted for some very minimal music in a video which happened due to it playing in the other room 😂
NHL has every right to block or dispute content.... however this is exactly what they did when they left ESPN... running for money instead of exposure. They are not even in the top 5 major sports now. And the blackouts for games is crazy... I stopped subscribing to NHL streams because they would blackout Vancouver games because I was in the market area... about 4500 or more kms away. Mind-blowing decisions they make.
They did it to themselves the NHL is very clear about using hockey footage without their permission. There’s a lot of stuff I don’t agree on with the NHL but they are pretty clear about using footage and these content creators knew that going in. This is why the Hockey Guy and Steve Dangle don’t use footage.
I like the spirit but you need to be more firm, they’re showing snips of gameplay that fall within the realm of fair use, short 10 second or less clips that exhibit a point that allows the creator to iterate on the material. This is a long respected doctrine that was codified in the 70’s when copyright law was being enacted. They’re overstepping, if someone were rich enough to hire a lawyer to handle all these claims the NHL would withdraw them but since they have all the leverage and the creator doesn’t - they can bully the creators. Thanks for bringing light to this important discussion The Locker Room! Subscribed, liked and commented. :)
The problem is that unless UA-cam honors the fair use laws, it’s an uphill battle. Will I stop making NHL content? Nah I enjoy the game far too much and this isn’t a main source of income for me. That being said, I believe UA-cam should stick by their creators that utilize footage in a transformative way. Thanks for subscribing!
I know a wrestling creator who creates a border around the content and only shows 2 to 3 seconds at a time followed by 20 or more seconds of commentary.
Yeah, THG definitely has a great lane. Just sucks when you like to utilize clips to showcase the game. THG has my utmost respect for building his channel with a whiteboard and charisma
Hmm..2 points here...Years ago the regional Leafs games on TV had a disclaimer that read about rights to the broadcast etc. Basically a "No-no don't use" type of thing, without written permission from the NHL and Ohlmark broadcasting. I have not seen that in 30 years.. MLB has for years not allowed a lot of highlights on regular TV sports on the news. You would see just about 10 seconds (maybe) of any MLB game..
That’s still a thing when watching local broadcast I’m from New England so when I watch on NESN that still will be played as a minor voiceover during the beginning of the game, but still these videos should fall underneath fair use
its the NHL. But the issue is probably the NHL still being the number 4 sport in the USA. So mainstream media can bully them around. Where the NFL on the other hand has leverage.
This is why it's always important to diversify. Don't just be on YT (let's Rumble?). Don't just use one source (in this case the NHL) for content (if NHL is your niche; broaden your niche to include all hockey). When you run a business you don't want 80-100% of your business coming from just one customer. On the geopolitical stage you're now seeing us here in Canada being threatened with 25% tariffs from the USA. This was Canada's mistake thinking that the US will always be a reliable trading partner. Canada should have diversified years ago so that if the US economy collapses (or tariffs are introduced), then Canada would still thrive because we would have had another 8-10 trading partners. Simply put: Don't have all your eggs in one basket. Lesson learned!
They are within their rights per a court of law. However, just like with Nintendo, the court of public opinion is a whole 'nother story and they're not winning there...
Yeah, Nintendo is the perfect example. One of the reasons why they don’t get much of their new stuff in videos. That’s the one thing I’ll applaud with Activision, they allowed their audience to make their videos without fear of it getting copyright struck
People aren't allowed to use NHL video, they usually display the disclaimer at the beginning and end of every broadcast. "Any use or retransmission of this broadcast without the express written consent of the NHL is strictly prohibited." Also, it doesn't make sense to curtail channels that promote the sport and the league in a way that makes the league look exciting and fun. Channels that retransmit entire games or parts of game unchanged would definitely be a direct violation. Channels like Hockey Psych that analyze teams and plays, or do a week recap with highlights from games seem like fair use and something they should embrace. What a shame.
Now there is some channel that just blatantly reupload full games but the majority of these channel make it transformative. It should fall under fair use but UA-cam rarely backs their creators against billion dollar organizations
Why can't the NHL do what the nfl did with Brett kollmann with the NFL. By supporting and even sponsoring youtubers to futher grow the game. This makes no sense. This is BS
UA-cam does not make decision about copyright breaks or not. They have a system they follow regarding to whom they pay out the money of the video. If those copyright strikes were challenged by the youtubers (in youtubes internal system), youtube would request that the person/company who filled for the strike would provide them proof of legal action in regard of the copyright infringment within 10-14 days iirc. If that time window passes and no legal document have been provided youtube would remove the strike and close the case and assign the payout back to the original uploader. This does not mean that the NHL could not take legal action at a later point in time anyways. This really long and drawn out process is why the reaction community (who infringes on copyright all the time) is not getting perma striked by big companies. It's not worth it for them, unless they do wanna make a statment.
As someone who has uploaded content for awhile, while you are correct on the process somewhat, i’ll tell you from personal experience I’ve had NHL videos of mine copyright struck, and while I dispute it, the NHL will win the dispute in a handful of days. Well, yes, reaction channels have gotten away with a lot on the platform from my personal experience, when it comes to NHL content, the NHL is far less forgiving.
I mean I wouldn’t be opposed to a younger generation in these positions. Show off how truly valuable this type of advertising for the league is to the sport
I don't like this. Beating on the lil man! I agree with you but the NHL is soo trash for this when they say NHL has a marketing issue with s*** like this, and they falling behind when other media vid games push their property to YTrs
Agreed, the UA-cam channels are beneficial for the league but they don’t look at it that way. They just see their property being used for profit. Even though I believe it’s Fair Use
i already dont go to games because the price skyrocketed, I need cable and ESPN + to watch my team, ESPN+ blacking out games because I live in the city of the team is fked... Is there a part of being a hockey fan that's enjoyable?
I stated in the video it should be fair use but UA-cam for a while now hasn’t protected their content creators. They are more worried about agitating their business with these billion dollar corporations
I mean nhl rev is dropping every year. No shit they coming after yall. They lost like a billion in rev after 2022. They looking to make the billion back somehow
I knew they'd get banned eventually.... you can't just take nhl copyrighted video from games and use them to make money on youtube.... its aa basic as it gets. Those channels are just ignorant
I appreciate all the comments and conversation that's happening in the comment section. I'll try to respond to everyone when I can!
The part that frustrates me is them claiming entire videos when some of the footage is not owned by the nhl
I don't even understand how they can do that
Yeah that part of the problem is complete BS, no way should they claim someone’s original footage and try to claim every single second of it
Didn't they claim a video about the chl
For what it's worth, Dangle also does not use footage for fear of this exact scenario. His podcast goes full slideshow city, tip-toeing through plays when they're recapping.

A workaround I've discovered was zooming into game footage slightly (125% or so) and I've not had issues with cooyright there
I know a wrestling creator who creates a border around the content and only shows 2 to 3 seconds at a time followed by 20 or more seconds of commentary.
You know, I’ve done that as well at times. I think it’s a work around but man it’s silly we would have to do that
Reminds me of when I watched some tv shows on UA-cam with a huge border and multiple part videos when I was young
That Hockey Guy doesnt use footage for this reason. His videos are great, but with how other hockey channels act, i can see why its not for everyone
Yeah, THG definitely has a great lane. Just sucks when you like to utilize clips to showcase the game. THG has my utmost respect for building his channel with a whiteboard and charisma
He's not safe. He uses official logos on a whole host of items. I wouldn't put it past them to at least try and and claim his stuff.

One of the channels I saw the today the guy said he just got to a point where his channel was his main source of income and had quit his job.

The NHL UA-cam channel sucks. So instead of looking at the content creators as contractors, they just take everything. Gatekeeping.
It’s sucks, but it’s the unfortunate hand we are dealt.
They are within their rights per a court of law.

I mean Hockey Psychology makes great videos, I think Eck has his audience that enjoys the short videos. A lot of people love that content
The solution is that the NHL makes clips available for a reasonable price. How do news stations get the rights?
The NHL is stupid and outdated, as usual. By the time they figure it out they will have lost a chance many new fans.
There is still time for them to re-analyze the situation but I don’t they do so
@ there is if they are willing.
Why can't the NHL do what the nfl did with Brett kollmann with the NFL. By supporting and even sponsoring youtubers to futher grow the game. This makes no sense. This is BS

I mean nhl rev is dropping every year. No shit they coming after yall. They lost like a billion in rev after 2022. They looking to make the billion back somehow
Big Fail and missed opportunity by NHL.
Rev share forsure, actually so busted that they claim 😂 youtube is nuts man
I think revenue sharing be the best solution so the NHL could feel like they are benefiting from their game
@TheLockerRoomYT absolutely, sad that copyright often leads to this greed
You dont own their content, they do. You are profiting off of their content. The NHL is in the right here.
Never said I owned their content, but there is fair use laws
I knew they'd get banned eventually.... you can't just take nhl copyrighted video from games and use them to make money on youtube.... its aa basic as it gets. Those channels are just ignorant
