Husband had 50% rating for deteriorating spine injury and went for reevaluation after several years. He was sent to outside dr who said condition improved. Husband went to a spine specialist for another opinion and gained evidence of further deterioration of the spine. We ended up getting our State congressman involved and the VA then determined that an increase was warranted due to further deterioration.
The first doctor that said your husband back has improved, is of no help to a veteran. A deteriorating back does not improve, especially with age. That doctor failed to provide the proper service.
I’m 100% disabled with Parkinson’s from agent orange in Vietnam. I would gladly give back all the money if I got my health back but I can’t I’m only getting worse. 😔

NOT because you have your cake and can eat it too, but bcs the VA violates federal anti discrimination policy in regards to disability and race discrimination with veterans themselves! I’m 90% but TDUI P&T paid at 100% rate for maybe 7 years now. Been rated 80% before that for 5 years (including back dating to my retirement/discharge date). Haven’t been asked for an exam since my initial claim ones. Not once.
I;ll bet money you're not one of the brothers, many of us are at risk, every few yrs for an exam without opening a new claim and rarely do we win at those C & P Hearings, when they call us in, we usually get reduced RATINGS

I received 100% P&T after 15 months. It was back dated to my retirement date. Having 28 disabilities after 31 years of service and a full copy of my medical records helped.
Question..received my 100 P&T other day. States what is granted (service connected) and also P&T is granted however, it also states that "the decision whether the veteran is competent is deferred". What's that mean? Also in decision letter it states "There is no evidence of record that shows that you are unable to manage your financial affairs.(38 CFR 3.353). The issue of whether you can be considered competent is deferred for the following information:Additional Development Required. Any thoughts would be helpful and appreciated. Thanks a Million!
Deferred means there waiting on additional information weither it be an exam of medical records or other information........But since they have already given you a P&T status....it won't change the outcome....As far as the financial it only stats that you are capable of managing you own fanancial issues.....

I have a question. My VA disability claim has been at High Level Review since November 2023. Shouldn’t I have received some kind of decision by now? Either I produce more evidence or an out right denial but 3 months, what’s taking so long? My initial application was June 2023. My military family members told me to make copies of everything in my medical, training, and personnel files. It was the best advice I was given before I entered the Army. I can't tell you how often I had to re-copy files to put in my official files because they were lost/misfiled.
I am 100% just on PTSD for 12 years, I wish I didn’t have this demon, I has this since getting out the army, it’s has been like a demon on me. I'm 70% with P&T and 30% unemployability. I've never understood how I could be rated P&T but only at 70% with the 30% unemployability. It literally means you are Permanently and Totally Disabled which is 100% disabled by the very definition of Permanent and Total
@@nealharris2381 that’s not accurate, if he’s getting TDIU prior to 67, he will continue to get paid at 100% until his death. It’s more difficult to get TDIU at 67 when filing a new claim because it’s considered retirement age, but not impossible to get TDIU. It depends on the situation.

Treatment is one thing, compensation is another thing. If that friend is in serious pain and requires surgery then your friend should go for the treatment or surgery. If that friend is already 100% P &T, a surgery won't risk his compensation. If he/she opens a new claim, then it could. There's no need at all to open new claims after making it to the hundo P&T.

They just one day decided to switch me from TDIU to Permanent and total but kept it down as unemployable. How do they mark someone as Permanent and Total (which i thought had no limits) but then also keep them unemployable? Does that limit me from doing school and earning with my GI bill? What happens if someday I want to start a business or want to decide to slowly venture back into a job?
Everyone is different. Some people are allowed to work and keep their disability. It's not really permanent and total anyway. It just helps them with their paperwork. Basically, you and I simply at the bottom of the pile. The last judge had no problem with me taking a course at a time. I do, in fact, do it for therapy. People say that when I write more, I do better with my thinking.

After 5 total bilateral knee replacements and pain in left hip I was aware 100% P&T static, after 4 years implant I am still in constant pain, I would swap my 100% P&T for my health. When walking my knees hurt I constantly take pain meds, I cannot do the things I used to do, walk long distance, climb stairs without pain terrible.
They can expand the definition of fraud as well. So you may not commit fraud in you disability. But if something is inacccurate else in the country and you sign the title. They they can remove your benefit for an unrelated fraud situation, that normally isn’t even a crime.
There is a title in which if you sign the title for what fraud is in any agency or department in the US. Then little errors with your signature can constitute as fraud
They gave me P&T as soon as I applied for disability. Blew out my back vertebraes and sent my knee off at a 45 degree angle which tore out my knee. After several surgeries I just got worse and have to wear leg braces to walk along with my walker They gave me 100% PT well over 20 years ago.
I am 100% disabled due to 2 right knee replacements 3 left knee replacement to include left knee infected which I was under 5 months of antibiotics, had many bilateral Bunin removals now my left hi is hurting me, Im living in the Philippines come March 2024 I am going to the USA, where I can receive better treatment, my last knee replacement was done at Clark air base in Pamapnga Filipino accredited surgeon during the surgery I caught a bad infection, he took me to the operating room open my one and did a flush out, closed the knee had failed to remove the contaminated implants so my knee swelled to twice its size blood dripping down my leg, I took the next flight to New York, upon arrival went the emergency room, they opened my knee removed the hardware washed out my knee and put a temp antibiotic implants for 5 months, everyday I'm being injected with antibiotics after 5 months they removed the temp implant and installed the new one, it took me over 1.5 years to recover knee was very painful taking Oxycottin pills everyday I was in pain, never go see a doctor in the Philippines, if you have any medical issues go home.
What if you've never considered needing a VA disability rating, but you get looked at and you're entitled to 100% disability pay since you were honorably discharged 20 years ago. Is it worth your time to make sure the va doesn't owe you a bunch of money, or does it make no difference to you, because the classified location where you were stationed at taught you more about wealth management and financial services than other servicemen were taught about battlefield tactics
Don't poke the bear, if your 100% P&T don't submit any more claims the VA will open your case and they can lower your rating, don't get greedy, don't listen to people who say submit another claim.

If you've been out of active duty and living with airborne knees and other life changing conditions for any amount of time. The amount of money the va rating payment might be owed to you and back dated to the first you visited the va and paid to you in a lump some. If they've missed giving you a 1000 dollar rating for 10 years; you might be entitled to a 120 thousand dollar payment. 10yesrs of 12 months missing 1 thousand dollar per month=120 thousand dollars lump some
Maybe those physical pains you've dealt with since you got b out back in 2004 are worth thousands of dollars. Money doesn't fix physical problems, but a new house down payment sure feels good to cashbin on
The other way the VA can take away P&T rating is if you become employed and make above poverty level. I am at risk of losing my P&T due to starting a small business that is doing much better than expected. It's a good problem to have. I'm using technology and automation that did not exist just a few years ago. Why would I risk losing my P&T? Because I want to feel like I'm contributing to society and have the potential to support my family beyond what P&T can provide. If I'm able to overcome my health issues with new technology, I need to try and succeed for my own mental health and wellbeing. This is not to say others with P&T should do the same. We all have our own unique struggles. Good luck to all of our brothers and sisters who are struggling. I hope you all get the help you need for serving our country.

Your va rating and diagnosis might not have been paying you what their rating scale requires and might pay you a monthly amount back dating 15 years and pay you 500 thousand dollars for shorting you a grand per month for however long the facts annotated by doctors indicate
At what point after the VA doesn’t see me or hear back from me again do they assume I died and stop my benefits if I have P&T? If Ketamine can cure or improve PTSD, would the VA will use that to take away my P&T? Can getting married and reporting a new dependent or spouse trigger VA to look at my PTSD p&T?
They will usually schedule you for a wellness exam once a year at least, you are 100% p&t, so go to VA dental etc. Also. No, getting married shouldn't trigger anything, it didn't for me. I've been 21 years p&t, never had a c&p exam since my award. Not even when I applied for SMC-L a few months ago, I had the DAV represent me, they awarded me in less than 4 months...
100% disibility Non-Hodgkin's lymphoma from agent orange taken away after 4 years . Classic upon re-examination at 4 year mark. Reduced to 10% (cardiac disease- agent orange) for one month, then re-evaluated at 60% due to other factors degrading from cardiac disease on retesting.

Every time Democrats get into power, I have all kinds of problems with the VA. Dems sent me a card that would allow me to receive treatment at a local hospital, I tried to use it 3 times, but was rejected and had to drive over 200 miles to the VA hospital. During the Trump presidency I used the card sent by him about 4 or 5 times with no problems at all.

Exactly I just told someone that they can call you in even if you’re total and permanent 100%. Your rating is only protected after 20 years.

Don’t give up.
Have your family member go to the local VA office for help maybe they can send an evaluator to your house for C&P exam, don't sit do something.
There are other UA-cam channels (including those claiming to be lawyers) saying that VA can and does reduce 100% P&T.

You will lose your rating IF you go to work.

Yes there is also PACT act you can file a claim if you haven't previously.

@joeabs4844: There are many SMC ratings that go well beyond 100%. I'm 100% P&T and also rated for SMC-S which pays an extra $400 or so extra a month.

They can expand the definition of fraud as well. So you may not commit fraud in you disability. But if something is inacccurate else in the country and you sign the title. They they can remove your benefit for an unrelated fraud situation, that normally isn’t even a crime.

There is a title in which if you sign the title for what fraud is in any agency or department in the US. Then little errors with your signature can constitute as fraud

Does requesting the applicatiin of P&T open your claim up to reajudication or restart the protected DX clock (5/10/20 yrs)?
If you are getting paid at the 100% level and you open a new claim they CAN look at all claims and then you can possibly be reduced.
They gave me P&T as soon as I applied for disability. Blew out my back vertebraes and sent my knee off at a 45 degree angle which tore out my knee. After several surgeries I just got worse and have to wear leg braces to walk along with my walker They gave me 100% PT well over 20 years ago.

I am 100% disabled due to 2 right knee replacements 3 left knee replacement to include left knee infected which I was under 5 months of antibiotics, had many bilateral Bunin removals now my left hi is hurting me, Im living in the Philippines come March 2024 I am going to the USA, where I can receive better treatment, my last knee replacement was done at Clark air base in Pamapnga Filipino accredited surgeon during the surgery I caught a bad infection, he took me to the operating room open my one and did a flush out, closed the knee had failed to remove the contaminated implants so my knee swelled to twice its size blood dripping down my leg, I took the next flight to New York, upon arrival went the emergency room, they opened my knee removed the hardware washed out my knee and put a temp antibiotic implants for 5 months, everyday I'm being injected with antibiotics after 5 months they removed the temp implant and installed the new one, it took me over 1.5 years to recover knee was very painful taking Oxycottin pills everyday I was in pain, never go see a doctor in the Philippines, if you have any medical issues go home.

What if you've never considered needing a VA disability rating, but you get looked at and you're entitled to 100% disability pay since you were honorably discharged 20 years ago. Is it worth your time to make sure the va doesn't owe you a bunch of money, or does it make no difference to you, because the classified location where you were stationed at taught you more about wealth management and financial services than other servicemen were taught about battlefield tactics

Don't poke the bear, if your 100% P&T don't submit any more claims the VA will open your case and they can lower your rating, don't get greedy, don't listen to people who say submit another claim.

If you've been out of active duty and living with airborne knees and other life changing conditions for any amount of time. The amount of money the va rating payment might be owed to you and back dated to the first you visited the va and paid to you in a lump some. If they've missed giving you a 1000 dollar rating for 10 years; you might be entitled to a 120 thousand dollar payment. 10yesrs of 12 months missing 1 thousand dollar per month=120 thousand dollars lump some
Maybe those physical pains you've dealt with since you got b out back in 2004 are worth thousands of dollars. Money doesn't fix physical problems, but a new house down payment sure feels good to cashbin on
The other way the VA can take away P&T rating is if you become employed and make above poverty level. I am at risk of losing my P&T due to starting a small business that is doing much better than expected. It's a good problem to have. I'm using technology and automation that did not exist just a few years ago.
Why would I risk losing my P&T? Because I want to feel like I'm contributing to society and have the potential to support my family beyond what P&T can provide. If I'm able to overcome my health issues with new technology, I need to try and succeed for my own mental health and wellbeing. This is not to say others with P&T should do the same. We all have our own unique struggles. Good luck to all of our brothers and sisters who are struggling. I hope you all get the help you need for serving our country.
You mean if your 100% is under TDIU the VA can take it away. You can be fully employed under P&T.

Your va rating and diagnosis might not have been paying you what their rating scale requires and might pay you a monthly amount back dating 15 years and pay you 500 thousand dollars for shorting you a grand per month for however long the facts annotated by doctors indicate

They will usually schedule you for a wellness exam once a year at least, you are 100% p&t, so go to VA dental etc. Also. No, getting married shouldn't trigger anything, it didn't for me. I've been 21 years p&t, never had a c&p exam since my award. Not even when I applied for SMC-L a few months ago, I had the DAV represent me, they awarded me in less than 4 months...

100% disibility Non-Hodgkin's lymphoma from agent orange taken away after 4 years . Classic upon re-examination at 4 year mark. Reduced to 10% (cardiac disease- agent orange) for one month, then re-evaluated at 60% due to other factors degrading from cardiac disease on retesting.

Every time Democrats get into power, I have all kinds of problems with the VA. Dems sent me a card that would allow me to receive treatment at a local hospital, I tried to use it 3 times, but was rejected and had to drive over 200 miles to the VA hospital. During the Trump presidency I used the card sent by him about 4 or 5 times with no problems at all.

I got 100% P&T very easily under a Democrat administration. Many of my friends as well. You should definitely file for 100% PTSD.
