- The plaintiff shares a common wall with his neighbor, the defendant. The plaintiff alleges he paid for roof repairs, which the defendant owes him money for, so he’s suing. The defendant claims the plaintiff’s half of the roof was leaking, not hers.

I'd say that it's fair, as in even, that he pays for the whole roof because she paid for the entire retaining wall. BUT, I wouldn't say that it's fair, as in equal. The cost of half of the retaining wall is far more expensive than the cost of half of a 30in section of roof, especially because one, it's virtually a flat roof, making it cheaper and easier because it's not on a steep pitch. And two, they only used that roll out waterproof rubber instead of shingling the entire thing, so that also makes it cheaper and easier because the material is much less expensive and far less labor is required.
Besides the point. I love seeing sons take care of their mothers. He was toting that purse with no shame all for his mom 😊
He's probably married and carries his wife's also. So yeah, he's a great guy.

Either this guy got seriously ripped off and taken advantage of, or he had that receipt extremely bloated to try and get more money from her.

If I was one of the homeowners I’d have that valley between the roofs removed. That’s a nightmare with it constantly holding water.
That's absolutely insane that a contractor designed their 2 sides to be connected by a FLAT connection. Physics 101: The water flowing down both sides will pool on the flat connecting area. I'm shocked this hasn't been a flooded disaster before. Plus, as the Judge says, it is kind of poetic that the shared retaining wall needed to be fixed years prior and he refused to share in the cost. Karma?

I actually feel bad for them. Dentures are not free. Even with insurance they cost a lot of money. My mom who is on Medicare had to go a year with no upper teeth because she was fighting with Medicare about it. They approve something then take the approval away. Another friend of mine has insurance and still had to pay $2,000 out of pocket. And it does a lot to people mentally to walk around looking like that.

@stacybstacyb It makes me so angry because it’s also a health issue. I watched my mother and my friend dump weight because they were not able to eat. And they hated looking at themselves. They both went into a depression. I personally think that in the future they will do away with bridges and dentures and do all implants. Then sadly you’ll see even more people with no teeth. I’m glad you were able to get yours done.
I thought he had some nerve asking her to pay for half. Very ignorant. He had the air of entitlement in his attitude. The judge ruled correctly in this case.

He should have went to the county courthouse and obtained a copy of his deed. It would have explained to legalities regarding the common wall and roof.

As a roofing contractor unless she agree to pay half up front and signed something he's screwed. They could have built a small retaining wall and eventually her side would have leaked. But if when they did the tear off and found out her side was rotten they could have called the city. Bottom line is he didn't go about it right and unless you've been up there it's a hard guess. But you have to tie into the shingles and that means going 3 runs up on either side. He should have called the city and told them he had to go up her side and put the pressure on her.
The city doesn't have anything to do with that. It would be up to his insurance to go after hers. His insurance basically told him it's time to replace your roof, which he still didn't do. Even if he did replace his entire roof, she's not obligated to replace hers.

I was thinking more of the city my brother lives in Florida where the city gets involved in everything. But you are correct. Thanks
Insurance company are not there to be of service to their customers. Just lining their pockets. That industry needs an overhaul and more accountability!!

That man had no business suing her for anything. Like the Defendant said, "she had no leaks!" First of all he was trying to get the fix done cheap, which is why he only repaired the leaky part. I'm surprised JM didn't ask the last time both roofs were replaced? His logic is flawed. The nature of the roofs being joined will affect the repairs. The only reason her side got fixed was because that's the only way it could be done but that doesn't obligate her to pay for it. Plus, karma was waiting in the wings. He didn't give a second thought to screwing her on the retaining wall & has been benefitting from it. That wall was something the Defendant could have sued him for & won. That's why JM brought it up. He needs to reflect on that.
He just wanted the money back from her and lied on how much it would be from an estimate from one roofer.
Insurance companies are snakes. That’s why they didn’t cover it. Why else would someone have homeowner’s insurance?

Absolutely not should the neighbor pay. His roof. His problem. When she needs to repair something, someone else may benefit. That's just how things go. I'd support a claim where someone did something that was a DETRIMENT to my home and property 😊 Common walls, areas, grass, etc should also be covered by HOA fees as well. Surprised HOA doesn't exist or didn't take care of it.

Legally, she may not need to pay however ethically, I believe she should contribute 1/4 of the repair cost because she will probably benefit from this repair in the future and she should be a good neighbor. I have a wonderful relationship with my three neighbors and it makes life so much better. We look out for one another!
Nope, She didn't authorize the work on her property. He is certainly not looking out for her. He wants her to pay for his roof.

I can tell you are a "borrower" that never gives back. "We should take care of each other" could be translated to "please, someone take care of me"
What's ethical about this? The damage was on the Plaintiff's side. Period. Now if he actually got his entire roof replaced, which would have included the valley portion. That may have been a case. He simply got a little bit of karma in the fact that the Defendant got some benefit from the fix. Just like he got from the retaining wall and I have a feeling she paid more for the retaining wall.

? I never heard in all my years that any common property is soly the reaponsibility of the 1st buyer of the property (and any new owners of that 1 same property) and not split between both owners. That's just Ludacris.
It's not, but you can't just go get something fixed without the consent of the other party. Both parties have the right to negotiate before a price is established. If nothing is said then she was not legally obligated. No contract was made. That's why JM was asking about the deed to see if she had obligated herself.
If people have dentures why can they not wear it when they going to be in front of the television when they're going to be on TV for millions of people to watch their teeth with mouth when they're talking!
Maybe they can't afford them. Maybe they are getting repaired or readjusted. Maybe thy accidentally left them in the hotel room.
What made you assume that they just don't care vs they don't have them. Dentures are very expensive and a long process that can take months to get fitted correctly.
