      At this point this guy would be better off going Pro Se. This lawyer is awful!! However, you get what you pay for, so I’m assuming he didn’t want a court appointed attorney (which would have been much better) so he hired this guy at Discount Lawyers - and he is kicking himself now.

    Did the lawyer actually say that it's grievable for the prosecutor to prosecute someone who may in fact be innocent? Isn't that basically everyone? Innocent until proven guilty? That makes no sense to me, but I may have misunderstood.

      It's in the case that the prosecutor, based on available facts believes the person is innocent, and maliciously prosecutes.

      Prosecutors are not allowed to just ignore significant exculpatory evidence and continue with a prosecution. If there is solid evidence proving someone is innocent and the prosecutor moves forward with the case anyway, that would be malicious prosecution and a huge ethical violation by the prosecutor. It seems like the defense attorney is claiming that is what is happening and that he will report the prosecutor if she doesn't drop the case, but he has no real evidence to back up his claim so Judge Simpson is viewing it as the defense attorney attempting to intimidate the prosecutor into dropping the case, which is a huge ethical violation on the part of the defense attorney.

      Agreed!! I wouldn't want him as my attorney. We cant have a hearing beacuse we dont have the facts? and he may be innocent? UM, isnt that what going to court is supposed to do? I think this lawyer got his license out of a cracker jack box. I wouldn't want him as my attorney.

      Yep. I've seen Judge Simpson get loud and blister. I've seen him where you can practically see steam coming out of his collar. I've seen him take a recess to calm down. I've seen him reschedule things, stating that he didn't feel he could be fair at that moment.
      This? This was like the calm before the storm. When the air goes still, the sky goes dark, and even the birds are silent. It was almost scary. And as he got more pissed, he got quieter.

      ​@@meesh6257 Go back to when the attorney introduces himself at the beginning of the video. The prior incident is mentioned, the video thumbnail is shown, and OSG mentions there's a link to it in the description of this video.
      It appears that not only was it the same attorney in question, but it seems to involve the same case, if I'm hearing this correctly?
      If so, he's *extra* stupid to think he could casually lob threats across the table and the prosecutor (same one in the other vid, so she's already acquainted with his shenanigans) wouldn't say anything about it to the judge.
      I would normally suggest disbarment is too harsh, but this guy clearly conducts himself inappropriately on a consistent basis, at least in this venue. It seems pretty clear that he is either letting his emotional state pull him around by the nose, or he's got some deeply rooted ethical/moral issues he needs to address.
      If he already has a disciplinary history, this kind of BS should get him disbarred. If he doesn't, then he needs a good, stiff suspension, needs to take some remedial courses, and maybe some anger management/therapy before he returns to practice.

      She’s a public prosecutor who he has worked with on many cases where she performed very well in her role. It’s essentially going after a coworker that you work very closely with. This guy messed up big time

    Damn. I've seen Judge Simpson angry plenty of times at various types of misconduct in his court, but this is something else. You could tell how much he was holding back. Absolute rage. That attorney might want to look into a new line of work or possible retirement.

    so he didn't like the prosecutor moving forward on a case and so he decided the best idea to stop her is to threaten to report her to her boss. That is completely unacceptable and an insult to the court. If she did something legally incorrect or questionable that would be different, but in this case he just wanted to stop her from proceeding.

      If it was provable. He can file a grievance, but if he accuses the prosecutor of withholding exculpatory material, knowingly eliciting false testimony, altering or manipulating evidence to present a different result than what the evidence actually presents. Just him pissy because she won’t dismiss by his say so. He can challenge the veracity of evidence, challenge the calling of a witness that he believes isn’t actually a witness, challenge the procedures or protocols on a forensic test/report etc. Just not wanting a witness because they could be detrimental to his case- no. He could challenge the bona fides of an expert witness if he believed that expert isn’t qualified to testify.

    I've watched Judge Simpson for a while and when this prosecutor has a case in front of him, she does a great job presenting her cases. She never tried to pull any shady moves to win her case. Ture she knows the judge Simpson would blast her if she did. To strong-arm her into NOT doing her job he should be disbarred.

    I am in awe of this judge. He was PERFECT! Expressed his anger clearly, checked the facts first, absolutely nailed the errant lawyer to the chapel door, while still allowing the attorney to correct his error. Hopefully the stipulation will not harm his client too much.

    He argued that it is grievable to prosecute someone who may be innocent. That's like saying no one should be prosecuted who might be innocent. I think that would bring all prosecutions to an end.

    The only reason the attorney feels any "obligation" to report him himself is because he felt it would be better coming from him than from Judge Simpson. He's not doing it because he hasn't any integrity, he is doing it because it'll be less of a shit show.
    He is despicable and knew what he's doing from the beginning

    Being from Michigan, I am so proud to know there are judges like him in my State. He always seems to be fair, and does not allow either side to play games. He also has a zero tolerance for the games many defendants play.

    He knew exactly what he was doing. He was attempting to use her inexperience to his advantage through intimidation, and threat. Wow, he's in trouble. He will definitely, at a minimum, lose his ability to Practice for some amount of time determined by the BAR court panel.

    He done messed up big time. The only saving grace in this situation is that he set his client up for a perfect appeal.
    Appeal attorney: "Yes your honor my client was previously represented by a total idiot who prejudiced both the prosecutor and judge in the trial against my client by making threats against their jobs. We feel that this should be sufficient grounds for an appeal."

    So the judge gave him 18 hours to come up with a cogent argument after accusing him of partiality and literally warned him that he was incredibly angry and did not want that anger to affect his judgement. The defense decides to then file a grievance against the prosecution to manipulate the case. I'm only 3 minutes in; the balls on that guy.

    I've never seen the Honorable Judge Simpson swivel back and forth in his chair like that. The judge's body language implies someone's butt is in a lot of trouble. His controlled temper is fearsome.

He certainly made an impression in the previous hearings, which makes it all the more baffling that he made such a blatant false threat...then tried to almost gaslight the prosecutor in his "sorry she felt that way, but it wasn't how it was intended" nonsense. This judge (and many others you feature) have taken a dim view of gaslighting before.
      It did just seem that he hoped his empty threat would have scared them, and when it didn't, he found himself unable to explain away what he had said in a way that Judge Simpson would accept (because it was the wrong thing to do). Almost like "explain to me why you took a cookie from the pack I told you not to touch in a way that I'll accept". Not possible.

    OMG I watched this live earlier and thought that I recognized the defendant. My jaw dropped and now it's bouncing off the floor.
    This lawyer needs to get a heavy sanction and probably disbarred.

    Ow. I’m several hundred miles away from this, not in a courtroom of any kind, and not in any trouble. And I feel some severe puckering going on listening to the slow burn of Judge Simpson.
    I only hope if (heaven forbid) I ever DO get into trouble, I face a judge who is as fair and beyond reproach as Judge Simpson.

    This attorney is already in trouble with Simpson, but now he is digging his own grave. Don't make accusations to someone who can get you in more trouble than you are already in. Who is he to judge their ethical obligations, he s hould report that but quit making threats.

    You know what.... I watch a lot of court precedings on youtube, and Judge Simpson should really be praised for his conduct behind the bench. He is a shining example of how a judge should act in service of justice. Bravo Judge Simpson! I'd love to meet him (not in court) in real life!

    The judge lookd so crestfallen at the end. You can see he was taken aback at first, then he got angry at the realization thi it wasn't this guy's first time making threats, then discuss crept in befor he took 10. A sad day in judge Simpson's courtroom.
    But in the end, a good outcome.
