Ship is not the part of any MOU. Ship can be inspected by any port, irrespective of MOU it represents. So you may go to Europe or even In a port within Tokyo MOU, they can inspect a ship whenever they feel...
Sir, what if any state which has not ratified particular convention and any foreign ship calling to that state whose Flag state has ratified that convention, Is that state authorized to inspect for that convention? Consider Example of Ballast water Convetion which is not ratified by India, so Can India inspect for Ballast water treatment plan? If yes then what is the reference for that? Thank you sir
Hi Shivkumar, If not ratified the they cannot inspect for that convention. Only reference for this assumption I came across is this, "The Bunker Convention 2001 is already in force internationally since 21.11.2008 and maritime nations accounting for 91 percent of world shipping tonnage are Parties to this Convention. If India does not become a party to Bunker Convention, Indian flag ships visiting foreign ports will have to continue with the present dispensation of approaching foreign countries for bunker insurance compliance certificates while foreign ships visiting Indian ports are not subjected to compulsory insurance." This make is it clear that they cannot ask for a compulsory insurance certificate unless they ratify it.
