- The plaintiff brought her jewelry to the defendant’s pawn shop due to financial issues she was experiencing at the time. When she had the money to retrieve the pieces, the plaintiff claims they were damaged, so she’s suing. The defendant insists he is not responsible for the damage caused to the jewelry.
This has to be one of the most annoying clients in people's court history.

The plaintiff is a scammer. Period. If she needed money bad enough to pawn things, she needed $5,000 from this case. And I am curious to see if she didn't launch a law suit against the other pawn shop too.

Like many, I've faced my share of hard times. I've sold things, I've cut bills out (no cable, no internet, etc.) I've reduced my grocery bill by learning how to shop smarter - but in all of my life I have NEVER pawned my jewelry, and I would NEVER pawn anything EVER that had been given to me by my mother.
My mother and father "gave" me a gold necklace for my 1st birthday, I still have it to this day (many, MANY decades later) - if need be I'd skip a meal or two before ever parting with it.
And this woman who wants to get all emotional about the Star of David her mother supposedly gave her continued to refer to it as a Cross of David - I laughed when the judge asked her "are you Jewish?" and when the answer was "yes" said since when? yesterday?
I think she's a scammer.
Plaintiff live in a mind of her own. She probably goes in to Macdonald’s…orders a hamburger then complains she ordered a filet mignon.
It's so important to her but she calls it cross of David repeatedly.

I work in the pawn industry, 15 yrs. She loses cause she signed for it. Simple as that. Deal with these kinds of customers daily.
yup.....customers have the RESPONSIBILITY to inspect the items they receive BEFORE signing and leaving the store. Once you sign, the transaction is OVER.
Yes but I think pawn shops that don’t properly document drop offs and collections give the whole industry the bad rap that it has - and deserves because of people like this defendant. I agree that plaintiff should lose but the pawn shop defendant does not come across as competent either. And he thinks what he had is good documentation - terrible business man.

I worked at a pawnshop when I was young. We once had a guy pawn a riding lawnmower. He ended up extending the loan a few times. The thing was there 3 years. Then he finally picks it up. It no longer works from sitting. He though we were suppose to be running it weekly for 3 years

there are pawn shop owners who dont properly handle items. That said, if she were that concerned, it would be hard to believe she would have continued the deal and left her stuff there. Its even harder to believe she wouldn't have inspected all the items at pickup.

Of course she did, that’s the reason the industry exists. The purpose of a pawn shop is to provide a service for people in desperate situations. They provide a similar service as title loans, payday loans, and bail bondsman. In many countries these kind of services are illegal.

I legit feel bad for the plaintiff. She is either confused, didnt check it or they have it and knew they could take advantage. I dont think shes a scammer. This is one of the many reasons why you should check on your folks.

Her story didn't make sense from the beginning. She says she watched him deface or break her jewelry right in front of her the day she dropped it off and then says she didn't notice the damage until three months later??
The lady was obviously going through some problems she probably just lost her husband or something, if she had any friends or family I think they should have came to court with her, l feel sorry for her myself, there is definitely something else going on with her

I am totally surprised that the Judge didn't make the lady stop talking while she was trying to explain things to her. I believe that's why the lady didn't understand everything that the Judge was saying/had said to her in the end.
Typically, Judge Milian stops the litigant from interrupting. I guess she was being kind to someone who seemed to have other issues.

She went to pawn jewellery. The file is used to make a scrape in the said piece of jewellery and then acid is poured on it. If it turns green, it's fake, not real gold or silver, basically it's costume jewellery. It's called: The acid test (also known as the touchstone test). The pawn shop guy will ONLY do this is you're pawning jewellery, basically selling the pieces because this test RUINS the jewellery.
What are you talking about? Pawning is NOT the same as selling. Pawning means the owner of the item is given a loan with an intention to get it back. Selling is selling. There are multiple ways to test jewelry for karat. The scratch test with nitric acid is most common, HOWEVER, if the plating on a piece is thick enough the scratch test may not catch it. Thats why a file is used on some pieces if you dont have and x-ray. The file will cut a deeper groove in the metal deeper than any possible plating. The acid is then placed on the cut to look for reaction. Filing a piece of jewelry does NOT ruin it if it done correctly and the piece is actually gold. The acid may discolor a piece if it isn't gold, but that is on the owner of the item for misrepresenting it.

If the Plaintiff had some jewelry that had sentimental & emotional value, "Why would she want to pawn it?" I'd never do that. She could never get The Star of David & THE Cross of David straight. There's no such thing, as far as I know, a Cross of David & I'm Jewish, too. She rudely interrupted Judge Milian throughout her case. She picked up all her stuff & claimed the loss 3 months later.
She also claimed to be Jewish through her grandfather, but was raised Christian through her mother. 🤔

There are a lot of instances where a person would leave a store without double checking their items. However, picking something up out of pawn IS NOT ONE of them. Also, constantly calling the STAR of David the CROSS of David is odd as h3ll. She said the man actually sawed through the gold chain right in front of her. That would take some time and she just stood there and let him do it?!? Then she didn't know she was missing the Star of David for 3 months? Again, makes no sense.
I've seen people test gold for purity.
I've never seen any of them FOLD it to test it.....
Why do people accept a few hundred dollars for pawning something, then want to claim it has "great sentimental value" when they sue?

My god this lady is a total mess. She's pawning jewelry at multiple locations. She swears it means so much to her, yet not only is she pawning it, she's not checking the condition or to make sure she gets it all back? Yeah right. If you notice she also contradicted herself cause she said both that she didn't realize the chain was "broken" until 3 months after she picked it up, but she also said that he broke it right in front of her with some sort of file...... This lady is nuts.

I worked at pawn shops for many years, this guy did not have his paper work in order. However, no one in their right mind would sign off on an incomplete inventory. She's clearly not fully Jewish :P

I agree that the defendant should have itemized it but I'd go a bit further and snap a pic of the items. He could assign a customer # to the photo and date which would represent the condition on pickup especially on that cross of david, i mean star... heehee.
@@MusicTennis Back in the day we didn't have camera phones, but you are totally correct. I would imagine that both the client and pawnbroker take pictures. But an itemized list should always be present if the deal is about various items. I imagine a picture would be handy if it is to record the state of an item when it is brought in. Say in the case of a guitar or some such.
Speaking of guitars a friend had me rescue his classic guitar he had in pawn. It was my only experience with a pawn shop. He actually had to sign over a power of atty to me.@@namnack

The plaintiff is likely experiencing dementia symptoms. She's forgotten that she picked up all the jewelry she pawned off and when the judge asked her why she deserves $5k, the plaintiff just had a confused look on her face.
She was so painful to watch.

What are frivolous lawsuit first of all If the jewelry had sentimental value she would have never pawned it to begin with especially family hairlooms regardless of hardship. The woman is a scammer she lost the case because she signed a paper stating she picked up her jewelry she would have obviously checked for damages after 3 months she is completely nuts.

That is my suspicion, I hope that's not the case for her, but her extreme state of confusion, pawning her jewelry at multiple pawn shops, her extreme exaggeration of the monetary value of the jewelry, and she seemed highly confused, and disoriented in the courtroom, and when talking to Dough Llewelyn in the hallway, accusing the defendant of damaging her jewelry without any evidence, accusing the defendant of keeping her jewelry despite having signed for it, constantly getting the name of the jewelry mixed up (that's what had the judge confused).
Her behavior is all too similar to a former neighbor of mine her last year living independently before her daughter moved her into a memory care center, she is in early stage Dementia. Of course I'm only speculating based on what I observed from my former neighbor, but yes the signs of possible neurological decline in this woman are there, unless she's on some kind of medication that is causing those symptoms, I would not be surprised if she ended up in a memory care center after this court hearing. The judge should have contacted authorities for her, and had her checked out, I wonder if the judge herself picked up on those signs.
By the way you are the only one I have seen so far in this comment section to have picked up on that, very interesting.
When the judge she's upset it's not funny, she was very upset, and I suspect that's due to the fact that she does not know what's going on with her mind, she knows something is wrong, but she can't figure out what, she does not understand the state of confusion and disorientation she's in.
She’s in pain for sure, but she doesn’t have the right to put other people in pain.

When I was getting ready to ask my (now) wife to marry me, I was blind, so I asked my mom if she would take me to a jewelry store to pick out a ring. She then told me about a pawn shop that has a lot of high end jewelry. I said something like, Mom, I’m wanting a nice wedding ring, so why a pawnshop? Then my mom said, Well why pay retail prices when you can spend the same amount of money for something better?
It made sense. My mom has an eye for good jewelry.
Anyhow we went to this high end pawnshop. My mom saw the ring that I bought. It’s a custom made ring with a channel set diamond. I wanted a channel set diamond because my wife is a nurse and I didn’t want the stone getting stuck on all of the pairs of gloves she has to use throughout her shifts.
I really didn’t know if it was a good ring or not. My mom finally told me that if I didn’t buy it, then she would buy it for herself. I knew then that it was a nice ring.
The man knew my mom as she had bought several pieces of jewelry from him over the years.
He sold it to me for what he had bought it for, which was $800. I had it appraised and the appraisal was $3,500. He even paid the taxes for it, he said as a wedding gift from him to me. ( I knew that he did that because my mom had bought a lot from him and she has bought more since then).
It is a gorgeous ring, ( I still have low vision, but I can see better now).
Last year a patient of my wife is a retired jeweler. He asked my wife if it was a 2 karat stone. My wife laughed and told him that it is actually a 1/2 karat. He asked to see the ring and once he took a closer look he could see what the size is. He was shocked at how well the setting made the Diamond appear larger than it is.
So if you are looking for jewelry, go to a high end pawnshop for your jewelry.
My wife has gotten a LOT of compliments on her pawnshop wedding ring.
Right after I asked her to marry me she asked me what jewelry shop I went to. Then she said, Oh wait, you’re frugal and your mom took you. Did you get this ring from a pawnshop? Of course I didn’t lie to her.
So now she tells everyone how frugal I am and that her ring is from a pawnshop.

If the jewelry was worth 5000$ why was she loaned 300$? Cause pawn shops rip you off by offering only a small fraction of what you're selling/loaning.

When you pawn they generally give you what it’s worth divided by 2.5. For pure gold maybe 1.5-2.
i bet you are one of THOSE people who pays $500 for a piece of jewelry and then gets OFFENDED if you try to pawn it and they won't loan you the full $500. Secondly she never said her stuff was worth $5k. She sued for that amount because of "emotional damage". Clearly neither she nor you understand the pawn shop model.

I think Millie is so upset because she knows she has a case she knows what she needs to do but she needs to proof so she can legally make a decision! She hates it when people are in business and they say that they're all about business but they don't act like it. Documentation is so important because anybody could take you to court for any reason and possibly win based off of a lie.
i think she just felt bad for her needing money so bad that she pawned her family valuables , not because she believed she actually had a good case . but i think the plaintiff was lying about the sentimental value to help her case , she is a habitual pawner .
