- The plaintiff used to be close friends with the defendant and rented an apartment from him. He says he left the place crystal clean when he moved out, but now he can’t get the security deposit back, so he’s suing. The defendant argues the apartment was a mess and gouged holes in the floor. He’s countersuing for two months of rent.

It still amazes me like judge M how people turn up without a shred of evidence in this day n age. I had a court of protection case regarding keeping my late husband in residential care (not the same court cases, granted) but the folder of evidence I took with me you could've broke an arm if you fell off of it lol you have to be prepared 🤷
Ikr. Even as a kid I knew you can't just sue or charge people without being able to prove it!
I can understand not having everything the Judge asks for but having some, but to show up empty handed is just plain stupid.

On many occasions we have seen a defendant turn up with no evidence, but this is a first, a plaintiff with no evidence whatsoever, doesn't he understand what taking someone to court means? ha ha ha

I was waiting for someone to mention about the returned security check being written on the 8th of the month after the 30 days following the move out. Some states require you to send it within 30 days. Wasn’t sure if the tenant was going to get the full security back on a technicality, but no one ever mentioned that.

Plaintiff needed a day off from work.... Who shows up with NOTHING?
I had a tenant move out of my rental house and the move-out day was on the 15th. I told them I would do my walkthrough on the 16th. She told me that the 16th is the day they're doing the cleaning... I was like WTF!!! I told my wife then that's another month of rent because they are not out on the 15th. My wife told me to calm down and that it's only one more day it's not going to be a difference. Augh! After doing the walkthrough we found 4K worth of damage. The biggest is painting rooms back to their original colors. damaged doors, damaged hardwood floors, damaged bathroom vanity, and the condition of the backyard was horrible! They only had a $1,700.00 deposit.
But here's the thing we documented everything from move in to move out. Without those pictures were would've been SOL!
What a horrible tenant. So in addition to the $1700 did you win the entire $2300 balance in small claims court? I hope so!
Good. Landlords are scum. Money for nothing and the entitlement is through the roof. I pay my deposit, knowing FULL WELL that the Landlord is going to keep it no matter what condition I leave it. It happened last two apartments I've had. I left the place SPOTLESS! Then they claim it was trashed and was infested with roaches! I've NEVER had them.
@@TopherGrantmake sure to take detailed photos upon entry and exit, and preferably video walk through on exit. Due to this, I've never lost any security. That said, landlords can selfishly attempt to claw money out of your deposit!

As a former cleaner/detailer I had several accts I cleaned for a landlord. If I moved into a place like that I'd expect a rent reduction for having to clean. There's a difference between dusty, dirty, disgusting & apocalyptic. That place is between dirty & disgusting.
A rental needs to have a cleanliness standard, like at least a 3 star hotel clean.
I'm with the defendant but I am going by as a former professional cleaner.

I'm a property manager for 8 rentals (all homes) I do all the maintenance & handyman work..I charge $3-$4 sq. ft. to sand and stain a floor..So an average room is around 200 sq. ft. So it would be $600-$800 As for garbage removal depending on how much & what it is I charge $30-$40/hr. My girl does all the "Deep cleaning" on any move outs.. She charges $40/hr. So the charges weren't outrageous or anything.. 🎯
