Landlords have been known to kill tenants or die in struggles with tenants, some of whom aren't even behind on rent. For example, a lot of landlords like to increase turnover so they can increase rents faster, or they might want your apartment to house their kid during college(the latter happened to me despite being ahead on rent).

Although I am not a live-in Nanny, I feel like if you’re going to go “cheap”, you’re going to get CHEAP... if you know what I mean. On Craig’s List, it could be anybody. I’m not saying {Care.com} is perfect (I don’t work for them, they were simply a tool for me to find a good family!) but they do as much as they can to ensure safety between both parties, which includes a background check and motor vehicles records check of the Nanny for the family. That wasn’t mentioned in the interview and Craig’s List doesn’t facilitate that. So, here’s what I meant about “cheap”: when people advertise (for example) 3 children; ages 4, 2, and 6 months, let’s say, and for 40 hours/week they want to pay a Nanny a flat fee of $200/week (😑). What type of person would answer a listing like this one? NOT ME. My background: I’m in my mid-40’s, I was an RN, in the medical field for 11 years, raised 2 AMAZING children who are both in college, and I’m just kickin’ it with my husband of 22 years ☺️ I digress 😂 But seriously, that’s basically what that family was paying the Nanny! Nanny AND clean house for room and board. She got the short end of the stick, for sure, but she agreed to this and that’s what I mean about cheap. I’m SURE she doesn’t have a professional or medical background or else she would have gone for a job with more money. Currently, I make $600/week for 1 darling little girl. I’ve been with her since she was 2 months old. And my only priority is her; I don’t clean or have to do anything else. Sorry so long! My point was meant to be that you can’t expect to get GREAT when all you want to pay is FAIR. I definitely know what that’s like... I was there once upon a time but somehow it all worked out. Regardless, that “Nanny” still has no right to do what she did. I’m curious to know what the outcome was!

The couple were breaking the law trying to offer room and board only for a job so they're fucked because they broke the law in California on that. They needed to be paying her minimum wage. But now they have to give her 30 days notice as proper eviction procedure. It’s called implied allowance. if a park is off limits to me, but I have the legal permission to sit on a bench in the middle of said park, then it is implied that I have the legal right to walk through the park to get to that bench.

Its equivalent to evicting someone that stops paying rent. She isn't actually allowed to stay there it just takes the courts a long time to agree with the family and makes her leave. Its kinda like criminals on bond, you dont actually stay in jail until that is what the Court decides even though you were guilty the whole time.
That was my exact thought. She wasn't a renting tenant, the room and board were part of her payment for the work she did. When she stopped doing that work, I assume they stopped paying her. I don't know why the courts are treating her like a tenant...her room and board was payment for work she no longer does, so why can't they evict her on the grounds that she no longer earns that R&B??
Because the family had no clue on how to hire someone that was a live in worker. They didn't have a contract that stated the right clause, so the police and courts hands are tied so they had to evict her
She has to be legally EVICTED. That is the LAW. They cannot just throw her out on the street. This is a very slow process, and it could take several months. It has to be done legally, or she could sue them, and end up owning the house.
I ended up with a roommate who cooked fish every single night, but claimed the smell of popcorn made her sick and forced me to stop making it. She put all my houseplants out on the balcony in the middle of winter one day to kill them because she didn't like them, and demanded I move all my books into storage because "you've already read them." Then she replaced them with her own. Her boyfriend moved in with her, and each of them then paid one-quarter of the rent while I paid half. I told her I was considering moving out, so she gave notice for both of us without telling me. I only found out I was homeless after she moved out and told me I had to be gone in a few days. She was an artist and she had painted murals on all the walls, which I had agreed to so long as she agreed to paint them over before she left. Of course, she didn't. So instead of trying to find a place to live, I spent what little time I had left struggling to carry her furniture to the trash and repainting the whole apartment. I ended up homeless, lost almost everything I owned, and ended up moving to a new city to start over. She ruined my life. Never have roommates. Ever. It's better to live in a collapsing, cockroach-infested hovel and have it all to yourself than to share a mansion with someone else.

They own the home but she has rights since they allowed her to live their initially. It’s supposed to protect people from getting evicted for no reason so squatters get mail sent there and take advantage of it and claim the home as their residence, so they have to be fully evicted through court which takes time and money. It'd be nice, but these homeowners have to worry about harassment charges from their so called tenant. They could very well extend the eviction process or get a judgement against them should they not provide a habitable place to live.
The court considered her a tenant so she would be allowed access to the common areas of the house. To restrict her access, the owners would need a court order.
I'd get my husband to take the kids away on vacation for a couple of weeks so they wouldn't get caught up in the mess...warn the neighbour's...then make life so uncomfortable for her,She would be glad to leave..lol. To be fair, the law originally was worded to protect tenants of rentals from being thrown out by angry landlords getting revenge against their tenants in cases but due to its poor wording, squatters are manipulating it's original intent to benefit themselves and take the properties they don't lawfully own.
@lilly anne Should there have actually been a written contract maybe, but ultimately protected by the law that has been twisted due to poor wording, I believe there was no actual physical contract therefore wouldn't actually have any actual bearing as it would be taken as a He Say, She Say situation. Now as far as breaching the actual none documented contract, she would have broken it and should have been kicked out but with no physical proof she cannot be removed esp since there technically was some proof of her own residency there so that raises the Squatters abuse of the Adverse Possession that I'll re-iterate was originally used to protect tenants from the landlord retaliating should the tenant and the landlord be involved in some kind of legal matter and are in court against on another.

That's true, and the couple clearly knows they were getting a good deal with this set up. They know daycare costs run very high, est 800-900;a month more for smaller kids. Cali rent is friggin crazy. Not gonna rent a room in a house under 2700.00 or 3500 a month. Unless it's in the hood, and thats 1500-1900 or more a month. So the freeloader was drooling to take the job and live in a nicer area with free rent and couple was drooling to get free daycare. Think all three need to take responsibility.
The couple was in fact, exploiting the nanny. Not only did she have tenant rights, she had employee rights. She was entitled to at least minimum wage, social security, workers comp, and unemployment. They cannot charge the nanny rent if she is required to be living there at the family’s convenience. This couple got what they deserved for being freeloaders, not wanting to pay their help. The nanny should’ve also sued for back-pay and penalty for late payment.

That's all true except she was a homeless person before someone from the homeless shelter wrote her a character reference so she could get the unpaid "job". Then she ended up living in her car when the eviction finally came due. They tried to pull a fast one on her and be cheap and they got owned.

It is modern day slavery...learn the labor laws. I'm not defending the nanny by any means, she should have been gone immediately. But I'm renting a room from an elderly lady and she only pays her caregiver about $100 a month and she runs her down to the ground. I hate seeing it, it's just wrong. This poor caregiver is on food stamps and goes to food banks. Meanwhile, this woman here is sitting on property worth over $1 million, collecting $850 a month from me and renting out 3 more rooms in this house. She is also renting out the pool-house and part of the lot to 3 people that live in their RV in the back. This house was paid for many years ago...this is just so wrong. The caregiver recently almost suffered a nervous breakdown and was contemplating suicide. At times like these I wish I was an attorney. I know it takes little money to sue someone and no money to report them to the Department of Labor, but I need to convince this caregiver that she is protected with the law.
@Connor Pool - according to the nanny, they asked for a lot more work than what was agreed on. Legally, nannies are employees and are supposed to get salaries in addition to room/board, just room/board isn't enough, so what they did was illegal. If we forget this for a moment and imagine they could ask for work in exchange for rent, it'd be very small amount of work, and she'd be a tenant. Which is what was said - she is a tenant, so they should go through regular eviction process. Landlord - tenant laws exist for a reason, and yes, sometimes you get an unpaying tenant, you go through eviction process.

I'd imagine you could even find a lawyer on the web. Do you know why the caregiver didn't get a job through a reputable agency? They'd pay her that much a day or more. I have an 88 year old father with Alzheimer's. I am currently taking care of him myself and take him to daycare when I go to work, but when I go on vacation I leave him with a (private) caretaker. I pay $200 a day for days she stays with him, if she takes him to daycare - her choice if/when she wants to do it, I subtract the cost of daycare. My father sleeps through the night, and he is relatively "low maintenance" - mostly sits and reads and is quiet and docile, everything is OK with him. If I go through an agency, I'd have to pay them 250-275 a day, and then they'll pay the caregiver 130-150 a day or less.

Did you watch the whole video? She was a live in nanny offered to live-in, in exchange for work. Long hours, on call all the time being basically used as a slave and of course offered to live in with family because it only made it more convenient for them. Once they where done using her they asked her to move out without any type of notice. The nanny now has rights to claim residency and does not have to leave on short notice. Crooks will be crooks but the nanny was all in her rights. The only people who violated numerous laws where the home owners themself's. I agree the nanny is wrong for staying after work terms were terminated however, as a former babysitter I can attest that families like this one who post for childcare in exchange for living DO take advantage of the nanny. I believe that she was worked to death.... people who have nannies take advantage in some way or another-some more extreme than others. I don’t really feel bad for them at this point because they were essentially seeking someone they could take advantage of by using Craigslist instead of just hiring someone for fair pay via various sites that post nannies seeking work.

Although I am not a live-in Nanny, I feel like if you’re going to go “cheap”, you’re going to get CHEAP... if you know what I mean. On Craig’s List, it could be anybody. I’m not saying {Care.com} is perfect (I don’t work for them, they were simply a tool for me to find a good family!) but they do as much as they can to ensure safety between both parties, which includes a background check and motor vehicles records check of the Nanny for the family. That wasn’t mentioned in the interview and Craig’s List doesn’t facilitate that. So, here’s what I meant about “cheap”: when people advertise (for example) 3 children; ages 4, 2, and 6 months, let’s say, and for 40 hours/week they want to pay a Nanny a flat fee of $200/week (😑). What type of person would answer a listing like this one? NOT ME. My background: I’m in my mid-40’s, I was an RN, in the medical field for 11 years, raised 2 AMAZING children who are both in college, and I’m just kickin’ it with my husband of 22 years ☺️ I digress 😂 But seriously, that’s basically what that family was paying the Nanny! Nanny AND clean house for room and board. She got the short end of the stick, for sure, but she agreed to this and that’s what I mean about cheap. I’m SURE she doesn’t have a professional or medical background or else she would have gone for a job with more money. Currently, I make $600/week for 1 darling little girl. I’ve been with her since she was 2 months old. And my only priority is her; I don’t clean or have to do anything else.

Its equivalent to evicting someone that stops paying rent. She isn't actually allowed to stay there it just takes the courts a long time to agree with the family and makes her leave. That was my exact thought. She wasn't a renting tenant, the room and board were part of her payment for the work she did. When she stopped doing that work, I assume they stopped paying her. She put all my houseplants out on the balcony in the middle of winter one day to kill them because she didn't like them, and demanded I move all my books into storage because "you've already read them." Then she replaced them with her own. Her boyfriend moved in with her, and each of them then paid one-quarter of the rent while I paid half.
I told her I was considering moving out, so she gave notice for both of us without telling me. I only found out I was homeless after she moved out and told me I had to be gone in a few days. She was an artist and she had painted murals on all the walls, which I had agreed to so long as she agreed to paint them over before she left. Of course, she didn't. So instead of trying to find a place to live, I spent what little time I had left struggling to carry her furniture to the trash and repainting the whole apartment. I ended up homeless, lost almost everything I owned, and ended up moving to a new city to start over. She ruined my life.

in my state, you can get someone out in just 10 days notice for NONPAYMENT, (plus a few days court processing time) so as early as 11 days.

The couple was in fact, exploiting the nanny. Not only did she have tenant rights, she had employee rights. She was entitled to at least minimum wage, social security, workers comp, and unemployment. They cannot charge the nanny rent if she is required to be living there at the family’s convenience.

It is modern day slavery...learn the labor laws. I'm not defending the nanny by any means, she should have been gone immediately. But I'm renting a room from an elderly lady and she only pays her caregiver about $100 a month and she runs her down to the ground. I hate seeing it, it's just wrong. This poor caregiver is on food stamps and goes to food banks. Meanwhile, this woman here is sitting on property worth over $1 million, collecting $850 a month from me and renting out 3 more rooms in this house. She is also renting out the pool-house and part of the lot to 3 people that live in their RV in the back. This house was paid for many years ago...this is just so wrong. The caregiver recently almost suffered a nervous breakdown and was contemplating suicide. At times like these I wish I was an attorney. I know it takes little money to sue someone and no money to report them to the Department of Labor, but I need to convince this caregiver that she is protected with the law.

Legally, nannies are employees and are supposed to get salaries in addition to room/board, just room/board isn't enough, so what they did was illegal. If we forget this for a moment and imagine they could ask for work in exchange for rent, it'd be very small amount of work, and she'd be a tenant. Which is what was said - she is a tenant, so they should go through regular eviction process. Landlord - tenant laws exist for a reason, and yes, sometimes you get an unpaying tenant, you go through eviction process.

I have an 88 year old father with Alzheimer's. I am currently taking care of him myself and take him to daycare when I go to work, but when I go on vacation I leave him with a (private) caretaker. I pay $200 a day for days she stays with him, if she takes him to daycare - her choice if/when she wants to do it, I subtract the cost of daycare. My father sleeps through the night, and he is relatively "low maintenance" - mostly sits and reads and is quiet and docile, everything is OK with him. If I go through an agency, I'd have to pay them 250-275 a day, and then they'll pay the caregiver 130-150 a day or less.

Did you watch the whole video? She was a live in nanny offered to live-in, in exchange for work. Long hours, on call all the time being basically used as a slave and of course offered to live in with family because it only made it more convenient for them. Once they where done using her they asked her to move out without any type of notice. The nanny now has rights to claim residency and does not have to leave on short notice. Crooks will be crooks but the nanny was all in her rights. The only people who violated numerous laws where the home owners themself's.
