You are right, a fall off a bike can happen literally to anyone. A momentarily lapse of concentration, an animal running across the road, a diesel spill that you can't see because it's dark etc etc. Good luck with the construction company, I suspect it's going to be difficult to prove and will take years.

I had some Pirelli Angel II and I bought some Michelin Road 6 because I live in Thailand now and it's the rainy season now and I have been in that exact kind of sludge here sand and mud mix. I have crash bars unlike some people named Mike. I wanted to know the limits of the tire so I went through the sludge gradually increasing speed. My ABS flashed and so I turned it off to see if I could go down. I couldn't. I tried to crash and see if I could and I couldn't. That triple rubber is absolutely phenomenal and I've always been a Pirelli guy for road tires. The road 6s in the wet are the best tires I have ever been on. BMW F800R. They're 400 quid but you will not go down from shit on the road.
You're definitely having some bad luck. At least it was a company bike, and you're not badly injured. I'm honestly not convinced by these riding hoodies. Ride bikes long enough, and stuff like this happens. As an MT10 owner (who doesn't like to bounce off the rev limiter 😉), I'm genuinely interested in what went bang in that engine. As a fellow UA-cam biker, it's a shame you weren't filming when you crashed. Unfortunately, viewers love a crash vid.

Yep I think you have a good case. The site is responsible for keeping that road in a reasonable state, which it clearly wasn’t. Your vid and pics will be your best friend in this.
It’s down to the construction firm bud, under the CDM regs they should have proper wheel wash facility within there site to avoid problems like this. No way, is this your fault you’ve done nothing wrong.

They can't put any blame on you unless they can prove you were using the road without taking proper care, as you were under the limit you should be fine, so if you have a video of the fall showing your speed or failing that witnesses that can testify for you, you have a solid case. Your solicitor should also report this incident to the HSE.

Personal injury or damage to property ***If mud contributes to personal injury or damage to property, civil action can be taken.***! Level 3 fine Contravening sections 148 and 162 of the Act can result in a Level 3 fine of £1000 in the magistrate's court. Looks like you have a case against the company that deposited the material on the road. I think it's down to the Highways Agency to take up the criminal prosecution. Good luck with your claim!
@@nationalinterest1 interestingly - my solicitor has advised me that they can only represent me if I have an injury which lasts more than 3 weeks. If I’m healed before that I have to make the claim myself. So bit of a waiting game!

White dalton did a video on this with 44teeth. Get soil/ gravel sample asap to support your photo case. Id probably delete this video, youve said some things that could be used against you, if you do claim against the construction firm.
@@BikeLikeMike92deffo. I can highly recommend White Dalton. I used them when a 'friend' went into the back of me and shattered my left leg into 13 pieces. He refused to admit liability. Took 18months, but got a great result, just before it went to court.
I suspect the major manufacturers will stop loaning you bikes soon with your run of bad luck. You seem very blazee for the consequences of your actions. You have damaged a high value of metal so far in a very short space of time…
